let's get the latest from capitol hill and congressional correspondent kate bolduan.? >> reporter: i will tell you, we are just getting late information, carol, that i could say we are working out what this means for the vote but it is definitely a new step in this back and forth battle between the department of justice, the attorney general, and the chairman of the house oversight committee darrell issa. we received word that the department of justice has sent a letter to congressman issa saying the president is asserting executive privilege over certain documents and i believe these are the exact documents that they are really fighting over now. documents from the department of justice between the dates of february and december of 2011. we can get into why those dates are important in just a second. but this is -- a very new development and obviously a very important development as we are waiting any moment now for this committee to begin its work. big question in my mind is -- does this kind of put this contempt citation vote in question? we don't know yet. this is

kate bolduan has more. kate, what does the ruling say? >> hey, joe, it was a big day at the supreme court. one that has both sides trying to spin the ruling in their favor. the high court put the brakes on aggressive state efforts to crack down on immigration, at least for now. from the arizona border to the usz supreme court, the justices offered a split decision on the controversial, illegal immigration law. known as sb 1070. writing for the majority in the 4-3 ruling. justice anthony kennedy said arizona may have understandable frustrations with the problems caused by illegal immigration. but the state may not pursue policies that undermine federal law. and so the high court struck down three of the four key provisions in the law. unanimously upholding, at least for now, the most controversial piece. the requirement the police check immigration status while enforcing other laws if the officer has reasonable suspicion they're in the country illegally, giving jan brewer reason to claim at least partial victor victory. >> today the state

kate bolduan begins outside. >> reporter: absolutely, wolf. a bombshell ruling. the individual mandate, the centerpiece, but getting to that conclusion was a surprising revelation. the chief justice writing for first unconstitutional under the commerce clause and later writing it would be upheld under the taxes cause. congress' power to tax a very unexpected legal route and reasoning barely got any attention in oral arguments when they were hearing this case. now, here's a little bit of the chief justice writing in the majority opinion explaining the reasoning here, chief justice writes "the federal government does not have the power to order people to buy health insurance. the mandate would therefore be unconstitutional if read as a command." . he's talking about the commerce clause but goes onto say, the federal government does have power to impose a tax on those without health insurance. it can be reasonably read as a tax flt i'll tell you, wolf, that reasoning seemed to be supported by the chief justice alone. but on the basic question of should the individua

kate bolduan is here to help explain. >> reporter: well, the white house is involved because some of the documents are esensitive and are under the purview of executive workings, and they are under the president's communications with his advisers that they do not think it should be part of the investigation. in this letter, suzanne, that the deputy attorney general sent to darrell issa, the chairman of the committee, he lays it out clearly. he says we regret that we have arrived at this point after the many steps that we have taken to accommodate the committee's legitimate concerns over the operation fast and furious, but we are disappointed that the committee appears intent on continuing with the contempt vote. they are working to find a satisfactory resolution of the outstanding issues. they are saying to leave some room there to work out some kind of a resolution there, but make no mistake, they are moving forward with this contempt vote, and the chairman of the committee feels differently about what this contempt, what this executive privilege assertion is with the white house. >

congressional correspondent kate bolduan is live in washington and she is breaking it all down for us. what are the key issues we should be expecting today? >> reporter: good morning, zoraida. the nine justices need to apes a question. they are facing four issues today, and we will finally get an answer as we've been talking about this for months now. first off, the justices need to answer the question, should they take a kind of legal time-out here, not deciding this case, not taking up this challenge until maybe after 2014 when all of the main provisions kick in. that has to do with pretty archaic, not well known law called the anti-injunction act from the 19th century. that's likely not to happen, but then the big question is the center piece. the individual mandate requiring most -- nearly all-americans to have health insurance or face a penalty. will that stand or will that go? and then the next question right after that is we kind of call it the domino effect. if the individual mandate's ruled unconstitutional, if it's ruled to step beyond the bounds of the authority that congre
