and yet that is that is what's happened katelyn polantz described aileen cannon as skeptical of the notion that trump had the power to designate records as personal and take them with him to mar-a-lago when his presidency ended. but she did say that that could be a quote, forceful trial defense so it's sort of unclear where she stood at least from that. is there any merit to that argument >> none. >> and in fact, at 30,000 feet, you have to ask yourself, how would that ever get in front of the jury? the only way for that to get in front of the jury, the argument that trump head designated the documents as personal to himself is if trump testifies and trump's never going to testify, i mean, he would get eviscerated. >> so >> in the absence of any evidence that supports a legal argument, you can't make the argument the arguments have to be based on the evidence and based on the facts and based on the on the jury instructions relevant to the jury instructions. and there is no jury instruction that says under the under the pra the public records act that a president can designate things person

i did mention katelyn polantz is reporting from inside the courtroom and she was in there. she saw trump tie appear to grow impatient at 03:00 in the afternoon. that was a five-hour hearing. so it was just before it ended. he started to get impatient but obviously it was there by choice. it's a long time for him to be there. so he began shaking his head according to her reporting, as doj prosecutor stood up to deliver his closing argument before that, she said people in the courtroom seemed a bit more relaxed than it prior hearings at one point, judge cannon even let her hair out of being pin back at one point. so just maybe sort of a more casual set of interactions what do you make of that? that there was that sort of calmness, but then trump choosing to be there the entire time. >> well i think he was there the entire time, basically as a complement or waved to her. i think he recognizes as does most of the litigating world that yeah she has really gone out of her way and that got her rebuked by the 11th circuit to favor trump in these proceedings. and i think he wanted t

let's start with cnn's katelyn polantz outside the courthouse in fort pierce, florida. that's where the classified documents, cases, kaitlan, judge cannon seem pretty skeptical of the trump team's arguments today. >> she did jake and what the trump team is trying to do here in florida in this federal case about classified records is the same thing. they're trying to do every everywhere else. they're either trying to get the case dismissed or to make things take a really long time until everyone's set to go to trial today. they spent five hours in the courtroom in arguments before judge cannon, where she didn't rule, but she did express some skepticism to these arguments trump is making to have his case dismissed on the ground. who's that these were his purpose personal papers that he wanted to take out of the white house and that the law around national defense secrets is a little too big for him to have known he shouldn't have taken them out of the white house and to mar-a-lago, judge cannon said it would be an extraordinary step for her to dismiss the case on these gr

and at the courthouse, cnn senior crime and justice reporter katelyn polantz let's start there outside the courthouse. katelyn, what is the latest out of this hearing? >> boris, brianna, this was a big, bold argument that donald trump's lawyers have been making in court especially this afternoon, trying to tell the judge he had a lot of ability to claim the classified documents at the end of his presidency were personal and that's the reason he took them to mar-a-lago. he should not not be prosecuted for a crime. judge, aileen cannon already is expressing skepticism at that argument and an argument they made earlier today that the law is too vague around national security records. just now, just a few moments ago, she told trump's lawyers, it's difficult to see how this gets you to the disk it's missile of an indictment. she also pointed out that perhaps some of the things that donald trump's lawyers are arguing today are the things that you would have as a defense at trial saying he didn't know he was taking the documents, he didn't willfully want to break the law in this situation. t

. >> katelyn polantz how likely is it that trump would eventually go to actual prison if, in fact, he were convicted? >> wolf. that would be a long way away, and there would be a lot of questions that the judge would have to weigh if trump were to be convicted, and then we would get to a sentencing hearing. there is the possibility with these types of charges that there could be what's called a custodial sentence, sending someone to prison. but one of the things that makes this case a little bit different from all the other criminal cases donald trump is facing, is that from what my sources are telling me, everyone in trump's legal circles seems to believe that this is a more parochial case. it's very much about new york, not the whole country. and it's one that seems to have the least likelihood of a prison sentence. the judge would have to take into account bad behavior in addition to just the charges, for it to end up in something. if trump were to convicted to also have him in jail. >> jamie gangel trump claims he would have no problem. he says he would have no problem testifying

katelyn polantz. thank you for that. now, let's bring in cnn's kristen holmes, who is in washington, and kristen, a reminder as this so often the case and as a reminder that trump's legal strategy and campaign strategy are often one in the same he doesn't actually have to be there at these legal proceedings today and he is ready. >> he does not have to be there. but one thing to note about this particular case versus what we have seen in the past is that we're not going to see donald trump today. there is no microphone setup. there are no cameras there. he's got basically going into a garage, going into court. there's no cameras there leaving and going back to mar-a-lago, not delivering remarks, not making a spectacle of it. so it is slightly different from what we have seen on the campaign trail. the other part of this is that we are told that donald trump wants to participate in his defense, particularly in this case, and he wants the judge to see him as a willing participant when it comes to this case, but soon he is

other thing that i notice about this witness, and it's in the write-up that kaitlan collins and katelyn polantz did, is this winter this is not eager to get trump. there's a moment when he tells them something like, i realized as the fbi was questioning me that my information was going to be used against trump and i didn't like that, but i felt important to tell the truth and so as a prosecutor, i think that's a really important indicator of credibility >> and kerry, would prosecutors likely have some sort of a deal in place with butler, this well, he hasn't been charged, so i think his fact there's a couple of things. so first, the facts are that are relayed in the interview that kaitlan has done, doesn't sound like he knowingly was a participant in the unauthorized mishandling of classified information. so it doesn't necessarily sound like he knew exactly what was going on, but he knew something's sort of squirrely was going on. so i'm not sure that there is evidence that the justice department has again, just based on this interview so far, that would indicate he could be charged it also sou
