[ inaudible ] told the prosecution earlier are not things they witnessed or been participants of. another key witness said he no longer wants to testify. and the prosecution was unable to persuade that particular witness to testify. and related to that is the fact that the prosecution seems to have been -- almost playing catchup as the case evolved. because the judges in several decisions have noted that the prosecution ha

katherine soy jin joins us. who's claimed responsibility? >> darlene, let me start out by saying the 36 bodies have been moved from the scene and are now in the mandera town. this attack happened at about midnight. the work has most of them who are not residents of mandera, they come from other parts of the country to mandera, they were sleeping at that time when the gunmen about 20 of them surrounded them and ordered everybody to get out of their tents and they lined them up and shot many of them. some of them we're told were beheaded as well. a person i was talking to at the scene said he saw two decapitated bodies. there were passers by, five of whom said they hid in a trench. there is a crisis meeting, being headed by the president, still waiting for official response. >> why has this area been the scene of such frequent attacks? >> this area is right at the border of somalia. this border is very porous, it's very easy to -- it's very hard to control movements in this area. the towns, mandera town and the town across the border in somali

katherine soy is is in nairobi and joins us. does this mean he is probably off the hook?rter: we can't really say that, david, that he is probably off of the hook. the prosecution is indeed under immense pressure to continue with the trial, but she said many times before that this case is struggling. we have witnesses who have been withdrawing at unprecedented levels, according to her weird -- words, that she has so many withdrawals, so she is under a lot of pressure, and she said the government also has been refusing to cooperate. the prosecution has asked the government to provide personal documents that they say are crucial in continuing the case, and these include telephone records, bank statements, also records of his personal wealth. the government has said that it has given the prosecution that all it needs to give now are the international criminal court chamber -- trial chamber said that in this statement that was issued not too long ago, that -- requested the decision that the prosecution indefinite adjournment. the trial [ inaudible ] also rejected the defense
