firefighters are at the scene so is katie marzullo. >> reporter: this is a tough one.can tell the mood out here is hopeful, but realistic. the latest news that a family of four is unaccounted for, mom, dad and two younger children. you can take a look at the scene behind us. you can see this fire is out. the fire has been out for hours, the 911 call came in at 1:00 this morning, took firefighters about an hour, more than an hour to put it out. it has been out since 2:00. the fire fully engulfed home and did so much damage the house is not structurally safe for crews to go in and do the full search the room by room search they want to do. neighbors know a family of four lives here. there are two cars parked on the driveway. but the family is unaccounted for. they could be out of town, they could be on vacation. it is everyone's hope out here that the family is in a safe location. we just won't know that for hours. they are waiting for the sun to come up when the structural engineers can get to work and get on the scene until then, it is a waiting game. crews putting out

katie marzullo is live with the impact on us. >> reporter: the numbers are big almost unbelievable with when it comes to our state. california gets nearly 2/3 of the entire settlement. >> it is the largest joint federal/state civil settlement in the history of this nation. >> reporter: attorney general holder made it official this morning after years of foreclosure abuse claims, five banks, bank of america, jpmorgan chase, wells fargo, citibank and ally financial will settle with 49 states to the tune of 26 billion dollars. the deal means nearly one million households with will reduce their loans and 750,000 people whose homes were foreclosed on will get a check for $2,000. >> all told this isn't just good for these families it is good for their neighborhoods, their communities and our economy. >> reporter: california attorney general kamala harris did not like the original deal and held out. it is paying off. now out of the nearly 26 billion dollar total the golden state will get 18 billion. in a statement harris said, this outcome is the result of an insistence that california receive

katie marzullo joins us from walnut creek with the story. >> reporter: we've seen confusion and worry and frustration. it would be scary enough finding out your bank closed. for an elderly person it is scarier and this branch is in the rossmore neighborhood there are a lot of elderly customers. home savings of america was shutdown by the federal government friday, not only here but two in california and one in minnesota where the bank is headquartered. banks have to have enough capital on hand to cover all customer deposits, home savings of america did not. and the feds couldn't find a buyer for the bank. >> in this circumstance, we were unable to find another bank who would assume the operations of the old failed bank. normally, we are able to find someone who will come in and assume the deposits and substantially, all assets. and the customers are not having their banking business interrupted. >> what happened to my deposits? automatic deposits and automatic payments? >> it is due on the 1st. where will it go? i don't want to be penalized. >> reporter: a lot of those transactions ar

katie marzullo takes a look at the issue. >> reporter: the study published in nature claims people eatd drink too much sugar and it is toxic and addictive, like alcohol and for your own good the government should tax and regulate it like alcohol. >> there have been other public health campaigns which seem to be very radical. today they seem extremely mainstream. >> reporter: for example, having a designated driver or banning smoking indoors. the researchers say social change is needed in part because the healthier the population the less money everyone has to spend on health care. >> the fact of the matter is, we are talking about saving billions of dollars. potentially in terms of the amount of nine is spent on noncommunicable chronic metabolic disease. >> reporter: the sugar association disputes the findings saying to label a single food as the one and only problem misinforms, misleads and confuses consumers and adds to the problem. health expert dr. richard besser weighed in this morning encouraging people to take their health into their own hands. >> tax will cut down on it in some

katie marzullo, abc7 news. >>> livermore police are searching for vandals who used a launching device to hurl big rocks at homes, cars and mailboxes, nine incidents were reported. all the attacks happened saturday between the hours of 1 and 2:00 in the morning in one case a rock ended up in a wall next to a child's crib, fortunately, nobody was injured. police released a picture of a car leaving a scene of a vandalized home. if you have seen the car you are asked to call the livermore police. with we have their number on our website under see it on tv. >>> federal and local authorities are trying to determine what lead to a midair collision near the contra costa county border. luckily the pilots suffered no serious injuries. this happened after 7:00 last night a helicopter and plane collided in the air above the rio vista airport. the helicopter landed hard in a field near sherman island. the pilot of the plane attempted to make it to the airport and crashed short of the runway. both pilots walked way from the crash. >>> in san jose investigators trying figure out what caused a fire t

here's katie with more news and eric. >>> 4:31. right now in the news, oakland police have cordoned off the area around the 2100 block of 62nd after an officer shot and wounded a suspect. amy hollyfield is live at the oakland police department. >> reporter: police are trying to sort through why this happened. they haven't said why the officer shot at the man. they did say the man was armed with a gun. this happened about 11:30 last night in the 2100 block of 62nd avenue. police say someone was robbed. police did make a vehicle stop. the passenger in that car ran away. they say that passenger had a gun and that is the man who police shot. that man is expected to survive. in the hospital in stable condition. no police officers were hurt. that is what police have told us so far. we have a few more questions. we know they are working through this. we hope to hear from them later this morning. amy hollyfield, abc7 news. >>> we are following developing news near the richmond-san rafael bridge the coast guard has spent all night searching
