katie marzullo is at a fire station with more. katie?he is 53 and this morning he is held without bill. we have pictures of him from his facebook page. he is accused of selling methamphetamine to children. sources say he was committing sex acts with children. investigators do not believe he was committing any of the crimes while on the clock but they do fear he could have abused his position as such. he was assigned as a community outreach officer. authorities took mario cuestas and custody at the administration offices where he was currently assigned. they took his commuter. we were able to talk with a young president for the san jose fire department. he says this is upsetting to the entire department. >> any time a member of the fire department is involved in something that is not consistent with what we are here to do it is always very disturbing. every person in the fire department is going to be donely touched by any bad news like that. >> the san jose four department issued a statement reading we are surprised this event happened a

katie marzullo is in the newsroom. >> doctors are looking into 25 cases in all of california with the five confirmed cases in the bay area left five children paralyzed. one is a four-year-old, her left arm is paralyzed. she will probably not regain the use of the arm but they describe the case as "mile." other childrens ages two to 16 are paralyzed in more than one him. it is polio like symptoms, leading to paralysis. researchers suspect it could be a virus but they do not know the cause. >> you can see the kid loves to climb and there are certain things she can not do when she is there. most of the children have not recovered use of their arm or leg. we want to emphasize this is extremely rare. >> researchers do nut want parents to panic. it is not a widespread outbreak but they want the wore out to doctors so they can alert the california department of health in they see similar cases. the illness has been selected since 2002 when a doctor sought a polio test for a two yield in berkeley the first known victim. polio was eradicated in the united states more than 3 years ago. >> devel

katie marzullo? >> san jose police have left the scene so we can get closer. house where the shooting happened. i have talked with a neighbor who lives a couple of houses away and he says there is always trouble at this house with people coming and going and it is a suspicious situation. the shooting happened before 8:00 last night and police got a 9-1-1 call and responded to the house on pine ridge way. a man said someone was trying to break into his house and the person fired some shots so he fired back in the person's general direction. police did not fine the suspect and the man who did the shooting said he took off with one other person in a car. a short time later police got a call a man with a gunshot wound turned up at a local hospital and died. investigators do believe the two incidents are connected and the man who died at the hospital was one of the alleged burglary suspects at this house. they have not identified that person and they are still looking interest whether this was, indeed, self-defense. it is the eighth homicide in san jose for the yea

katie marzullo is in the newsroom with the details. >> this is the fourth deadly pedestrian accidentcisco this year and the third on van ness. there is a strange twist that led to the arrest of the driver. the inspector in charge of the investigation said after the crash which was just before 1:00 o'clock a.m. at van ness an officer came upon the scene by chance and first went to try to give aid to the victim and witnesses pointed owe the driver who gathered up the belongings from the car and was walking away. the undercover officer made the arrest. the driver now is booked on charges of vehicular manslaughter and felony hit-and-run accident and run. the driver was not drunk or on drugs but they have not ruled out speed. he was headed south on van ness when he hit and kill the man. police do not know if the victim was in the crosswalk or not but later today, they will look at surveillance video from businesses which should help them put together the puzzle. southbound van ness between pacific and broadway was closed five hours while they investigateed. it just re-opened. >>> one pers

katie marzullo is in san jose. katie?he crime scene investigators are here and san jose police, the mobile command un is on the scene. we have activity between the to homes on pine ridge way where investigators still are trying to determine what happened out here. if you look at video from last night the shooting happened before 8:00. police got a 9-1-1 where a man said he shot at someone breaking into his home and that person also fired some shots in his direction but he was not hurt. police are look around and could not find that person or find a car. the suspect took off in a car with at least one other suspect. it was a short time later a man with a gunshot wind turned up at a local hospital. that is where that person died. police do believe he is a suspect in the break in, in san jose. he has not been identified. it is san jose's eighth homicide of the year. investigators still are trying to determine whether the man was justified in shooting someone who appeared to be breaking into his home. >>> san jose mayor laid
