katie marzullo is following the story with more at the top of the hour. >> oakland police are vetting the murder of a man sitting to his car on international boulevard near 26 at 7:00 last night. police say the man was killed when someone in another vehicle drove up and shot him. so far, no word on a possible motive. the suspect is still on the loose and this is oakland's 3st homicide of the year. >> a mother accused of grabbing a boy by the neck for bullying her daughter insists she did not touch the boy. the 30-year-old delia garcia-bratcher faces felony child abuse. police say it happened on friday at olivet charter elementary school in santa rosa and delia garcia-bratcher may have grabbed the wrong kid. she tells the press democrat she only talked to the 12-year-old. the school has given all parents a letter describing the accusations. delia garcia-bratcher will make the first court appearance on thursday. >> there is a collective sigh of relief in pleasant hill, the city clerk kim lehmkuhl has resigned after failing to do basic duties of her job. >> i am paraphrasing president fo

katie marzullo is in the newsroom. >> a large march landed for sunday in salinas with protests expect thousands to turnout as the show against what they call police brutality. here is a portion of the amateur video leading to the shooting. officers are following the 44-year-old man down the street yelling commands at him and he is waving garden shears at them. an officer's taser malfunctioned and they fire. see the video has fueled citizen it rage. a when protest turned violent and someone was shot and killed by a civilian. demonstrators knew bricks and bottles and rocks at police. the salinas police chief is speaking out defending the officer. >> letting him walk around the corner to a more crowded street and it could have turned incredibly tragic. >> the man was obviously drunk. why not knock him over? or taze him? every officer has a taser, if one misfires the other should bp right this ready with the next one. >> he is the third person shot and killed by salinas police officers in resolution evening woulds. two officers fatally shot a man may nine. the officers killed someone marc

katie marzullo is in the newsroom with the latest. >>> the fires have turned deadly. during a check for hotspots firefighters were alerted to a transient encampment and found a badly burned body. the investigation is ongoing. police have made two arrests, two young people, a 19-year-old and unnamed 17-year-old, unnamed because he is a juvenile, were arrested on suspicious of try together start ii fires. investigators are trying to determine if they had any involvement in the massive fires that now is done so much damage. in fact, there is another fire. authorities say there are ten fires burning in san diego county and they have scorched more than 15 square miles. they have destroyed dozens of structures and forced 125,000 evacuation orders since the fires broke out. the most active fire is in san marcos and cal fire says it charred 1,200 acres. the biggest fire is at camp pendleton marine base at 6,000 acres and a firefighter there had to be treated for heat exhaustion which is the other known injury at this point. crews took a break from the heat and the wind today.

katie marzullo is in the newsroom with the latest on the firefights. >> greatest concern is with an active fire at zero percent contained that has burned 700 acres. 21,000 evacuation notices have been sent out. cal state san marcos has been closed with commencement ceremonies canceled. in carlsbad, eight homes have been destroyed and schools are closed. there are nine wildfires bunking in san diego county right now and have burned 9,000 acres. 6,000 were charred by the fire on the marine base. overall, the firefighters are doing well and some of the original 120,000 evacuations have been canceled and homeowners are telling stories of close calls include a dog rescued from a burning home. >> the material we can get again but as far as family and pets... they are priceless. >> look at this video of the fallbrook area you can see the fire funnels into the air similar to a tornado. drought conditions high wind and record temperatures spread the fires and this morning there are whispers of possible arson. the mayor says this many fires in this amount of time is a coincidence and the "los angele

katie marzullo has the latest. >> the donald sterling are telling very different stories. shellly is saying she is selling the team and donald sterling said "absolutely not." well start with mrs. sterling, she has set a deadline for today for buyers to submit the first bids and she wants did have a buyer before june 3rd and that is the day when nba owners will vote whether to force a sale of the team. her attorney has released a statement saying donald sterling has authorized her in writing to negotiate the sale including his 50 percent owership in the team. now, donald sterling's side, his attorney said he disavowed anything shelly is doing and says "it's my team and i'll sell it when and if i get around to it." donald sterling sent a 32-page response to the nba saying he will fight the sale. he says this is no basis for stripping him of the team because it was jetly recorded during a lover's quarrel. bids start at $1 billion. donald sterling's attorney denying reports that he has been offered $2.5 billion for the team. the attorney says they will fight the sale "to the b

katie marzullo is in the newsroom. katie? >> there are 100 medical marijuana dispensaries in san jose. a lot of people have stake in the issue whether they operate, patronize or live or work near a club. the proposed changes include no dispensaries 1,000 feet of schools, day care, churches, rec centers, parks, libraries and other dispensaries and they have to be 500 feet from rehab centers and 150' from homes so that takes away a lost -- lot of locations. all marijuana must be grown at a site in san jose by the dispensaries. there are parking and liter problems, the mel is too strong and children are exposed to drugs. others say you cannot blame the whole industry for a few bad seeds. >> if you take this away from us i don't know what i will do, you will push us to the black market and i don't want to be a criminal. that is why we are medical cannabis patients. you will be creating more crime with the regular legislations. >> with the regulations veto a chance to stop the infiltration of marijuana in young people's lives. >>

katie marzullo is in the newsroom with more on that story. e this is on video. >>> caught on video. the security officer was fired the day it happened. the 23-year-old mitchell is scheduled to be in judge june 13 for felony inflicting of injury to a child on may 15. it started with two security officers urging several lingering students to go to class. officials say the student in the wheelchair who is a freshman refused or wasn't moving fast enough for the officers. mitchell pushes the student's chair and he slapped mitchell's hand and mitchell handcuffed him and continues to push him until the student spits in his face. that is when mitchell starts punching the student and dumps him on the ground. >> the fact it happened to a student would has cerebral palsy only come pounds the damage and how awful this incident is. >> the second guard ultimate intervenes and restrained his partner. oakland high school's principle apologized to the school community in a letter the day after the beating that reads in part "this incident is future reflective

katie marzullo, what a nightmare. >> fire is still burning 15 hours later and we understand it is windy in that area. state transportation officials now are saying interstate 15 will be closed for up to two days. back to the live pictures, the overpass over highway 15 shows the flames with crews still on the scene. when everything is clear and the fire is out then the investigators can go in there and assess the condition of i-15 because the lanes could be damaged from the falling steel. the overpass has been burning all night and firefighters have been on the scene all night along with the construction crew using large equipment and bulldozers to tear down the dangerous dangling chunks of what is left of the structure. it caught fire year afternoon when a worker using a blow torch ignited thed woulden supports. traffic came to a standstill backed up for mile and people were trapped for hours in their cars. >> a lot of traffic. the fire was insane. >> trying to get to my daddy. >> winds were blowing out up to 35 miles per hour during the fire which hampered efforts to put it out with 60
