katy zachry is a few minutes out.ll get a live report from her shortly. >>> and now to a story we brought you as breaking news last night at 11:00. a $2 pack cigarette tax that will help the philadelphia school district clear a major hurd until haurding in harrisburg. yesterday at that time that that tax plan was on life support. now it might not make it. what changed? >> yeah, it looks like it is going to make it now because of drat mattic change that happened yesterday in harrisburg. this tax is so critical for philadelphia schools because it's expected to generate $45 million immediate tly that coul be used for the upkoomicoming s year. nbc 10 was in harrisburg all day waiting for an outcome on the vote. republicans were holding out their support in the house of the tax until some democrat leaders would agree to reform funding for the state pension program. something governor was pushing for. there was a lot of back and forth behind the scenes negotiations. philadelphia leaders including mayor michael nutter were i

nbc10's katy zachry is live at the criminal justice center. aty, what are you hearing about the case? >> reporter: well, tracy, for the last two weeks, millen mateo garcia has been held without bail. he will appear at 11:00 here for this preliminary hearing. at that time, prosecutors will lay out every piece of evidence they have against him. 28-year-old milton mateo garcia was found carrying the victim's keys, just 72 hours after the rape. police said he followed the 26-year-old doctor as she walked home alone. surveillance captured garcia approaching the victim at 19th and spruce streets. police said he forced her into her apartment where he repeatedly raped her. he took the victim's keys and cell phone and they tracked him to his south philadelphia neighborhood. they pinpointed him after doing old-fashioned police work. he's being charged with rape, robbery, aggravated assault and kidnapping. he is a citizen of honduras and according to immigration officials, this time last year, he was deported. courting live outside of the criminal justice

nbc 10's katy zachry is live outside the chester police department. aty, tell us what you know right now. >> reporter: so detectives were on scene right at the 1400 block of congress street where this all broke out just shortly after midnight. they were there for several hours and came back here to the chester police department. they were able to piece together what happened and give us the latest information. let's take a look at our video. police say when they arrived at the consistent, the 1400 block of congress street, they found five people injured, two of them teenagers, a 14-year-old boy an a 14-year-old girl. those teens were shot in the foot and the leg. officers also found three adult men who were shot. the victims were all taken to crozer-chester medical center where we understand they're in stable condition. from the bullet katings on the ground there were at least eight to ten shots fired. and police learned from witnesses who were there, the group of people, the group of victims were standing around, talking, playing on a basketball court

nbc 10's katy zachry is live in center city to tell us why the governor is holding out. what's this about, katy? >> reporter: according to governor corbett, the budget which is on his desk there as of last night falls short when it comes to pension reforms with made calls to lawmakers to find out how long we have to operate under the old budget before services are cut. we learned we have about a week before key services are cut. the $29.1 billion budget does not raise taxes. it was passed by the republican majorities in both houses. democrats say it relies too heavily on one-time revenue sources. late last night, governor tom corbett issued a statement saying because pension reform was not addressed in the spending plan, he will not immediately sign it. another sticking point, the cigarette tax. that will inject philadelphia public schools with $80 million, much-needed money there. that was not part of the budget plan, though. >> nothing is more important than public education. it is our, and it should be the governor's number win priority. >> i think it's still possible

nbc 10's katy zachry is live outside the chester police department. katy, what happened?> reporter: the shooting happened around midnight. we are still sorting out the details. we've reached out to the detectives and police chief who we understand were at the scene. here's video of the scene, the gunfire erupted at the intersection of th and tillman streets around midnight. five people were shot at this single scene, from the bullet casings you see on the ground there were at least eight to ten shots fire. chester police and chester fire responded and blocked off the area for several hours. we are waiting to hear back. i've reached out to the chester police commissioner about the details surrounding the gunfire. i've still not heard back. no arrests have been made. all five people who were injured were taken to crozier chester medical center. at this time, we're trying to find out their conditions. five people at a single scene were all shot. detectives are still working out exactly what happened. no arrests have been made. if you have any information, call chester police

nbc 10s katy zachry is live with what's being done to fix that bridge today. katie? >> reporter: hi, chris. i have to tell you the latest word is that repairs here to the bridge, they're moving pretty quickly and on schedule. later today we should see concrete poured into the bases to give you an idea of just how big a job this is, these bases are 64 feet long, 8 feet tall and 6 feet wide. before the concrete could be poured, crew has to insert steel rebar cages into the shafts. it's all part of a larger plan that includes drilling new concrete foundations into the bedrock to support the bridge and replacing two piers that have shown the worst tilting. we won't know if a 400 foot section of the bridge needs to be rebuilt. that would really delay plans for reopening the bridge. as it stands right now, crews hope to open the southbound lanes of the bridge by labor day. it has been closed, of course, we know since june. 90,000 drivers a day have been affected. an estimated 90,000 drivers take this bridge every day and for the last month they've had to find routes around

katy zachry is live at the airport to explain. >> reporter: this exercise bike program is part of theairport's summer long customer appreciation program which of course is it also coincides with a busy travel season, of course we're talking about traveling during the summer months which means more people are exposed to these exercise bikes. the bikes have been so successful here in the airport that 20 more are being delivered today. it all started last month when a fitness retailer in king of prussia partnered with the airport to promote healthy active living. you can end up spending a lot of time sitting and waiting at the airport. now passengers have the option to work out. the hope from here is that other airports catch on. right now, you'll find the bikes in the concourse between terminals "b" and "c." there's a pop-up gym that moves throughout the airport. the idea is basically for a low-intensity workout as the airport is not offering any showers or any lockers for you to lock up your stuff. the whole point is that people will have a lower cardio workout and not get too intense
