yesterday after the debate, kay hagen concedes she wasn't at another hearing, she was at a fundraiser. >> you know, there was one and what it happened at that hearing, it was scheduled for early in the day. and then votes were scheduled and that hearing, that hearing then had to be postponed later that day. so, yes, i did miss that one. >> yes, she did miss that one. and that does happen sometimes. the schedule does get juggled around. but the staff knew where she was. and the staff was trying to suggest for some time that she was at another hearing. does this have an impact on what she has been slightly ahead? this is one of the races democrats have been happy about, where you have an embattled incumbent slightly ahead. does this hurt her credibility? >> it's one of the surprising issues that republicans have used, not just in north carolina, but in new hampshire and iowa. the issue of missing committee hearings. it happen as lot, no the that uncommon. but voters at a time when they're angry at washington, are

and in north carolina, where kay hagen leads tom tillis, 48% to 46 %.aces, let's bring in john king at the magic wall. >> eight or ten races like that within two to four-points heading into the weekend, it will be a wild election night. we'll start with 55 democrats and 45 republicans in the united states senate. the 55 d's is two independents. we have 36 senate races in all. but we know how most of them will go. democrats will win in oregon, republicans will win in texas. and we've assigned those. but now let me get rid of three more. even most democrats concede and we'll watch south dakota, but most democrats concede montana, and south dakota, and that would get republicans up to 45-45. and then ten left. all in single-digits. all from alaska to new hampshire in single-digits into the final weekend. where do we go from there. one scenario, they are worried about the states i'll call the blues, but in this scenario i gave the democrats iowa, and new hampshire where jean shaheen is ahead of scott brown. in this scenario, colorado, president obama caried

it said if kay hagen doesn't win, obama's impeachment begins. it has a picture of what appears to be a lynching. that's not the only incident in north carolina. is this because the democrats can't run on health care, the stimulus, or they don't even want to admit to a lot of candidates they voted with president obama, 95, 97% of the time. why are they doing this? >> they're worried about black turnout. this is a non-presidential year and they don't have obama running. his policies are egregiously popular, so they're desperate to turn out the black turnout, and we are seeing that the only thing they can do to appeal the blacks is cause them to be further alien ated. democrats have convinced them that we hate them. this is starting to loosen up. people are finally realizing, blacks are finally realizing, slowly but surely, that they're being exploited. if just the slightest change occurs in that demographic, democrats are seriously in trouble, beyond just this election. i'm glad to hear juan say what he just said. this is insulting and patronizing

new hampshire, jean shahin, the incumbent, kay hagen the incumbent, and in kansas where greg orman callsimself an independent, but democrats expect he would caucus with them, he has a very slight lead over pat roberts, the three-term republican incumbent. but republicans lead narrowly in the other eight races. let's look at those. begich of alaska, pryor of arkansas, udahl of colorado, are all in big trouble right now. then you go to the next set of democrats in trouble. bruce braley, joni ernst is leading him in the polls. mary landrieu in louisiana, democratic incumbent also behind michelle nunn in georgia has been closing, but remains narrowly behind in polls averages. finally two other races, kentucky the marree race. mitch mcconnell. union attractive opponent in allison lunder grin-grimes. south dakota a three-way race, with larry pressler, but mike rounds is the favorite. where does that take you? to a nat that looks like this, 52 republicans, and that would put mitch mcconnell in charge for the last two years of president obama's terms. some of these poll results are going to be o

in north carolina, where senator kay hagen is up by four points over republican statehouse speaker tomhawn hall takes 7% of the vote. hagan benefits from a 19-point advantage among women. tillis, though, carries men by 13 points. we're seeing a gender gap. in iowa, ernst narrowly leads bruce braley 46 to 44. there's an enthusiasm gap there. 51% of braley voters strongly support him. while more than 6 in 10 ernst supporters say they choose her because they actively support her candidacy, a majority of braley supporters say opposition to ernst is motivating their vote. we're going to get to that in just a second. we have some breaking news from pete williams who's juoutside i front of the supreme court. is there some breaking news? >> some very big news. a real surprise here. the supreme court has said it will not hear any of the seven same-sex marriage cases that were filed over the summer. now, that means a couple of things. first of all, obviously, it means at least for now, at least -- well, it possibly could last through the whole term. the supreme court will not have the last word

interesting here partisanship being the closing message here that republicans want to make about kay hagen. and the reason why she has held up better than most democrat incumbents is because she's made hay over the partisanship in the state legislature. in fact, you know, that, to me, is sort of -- that's what north carolina voters are sitting on. sort of like what offends them more. one style of partisanship versus another style of partisanship. and that's -- you know, that's in many ways it's been the issue in a nutshell for voters all around the country. but it's especially accuute her in north carolina because they don't like -- there's a majority that don't like a lot of the actions of the legislature. just like they're not happy with some of the one party control things that democrats did in those first two years that president obama was in charge. so that's the tug-of-war that's taking place here. ultimately, there isn't a swing voter, i don't think. this is about finding those that swing between voting and not voting. there really are not any persuadables left. >> your review of th

and i have to wonder what kind of effect is this going to have on kay hagen's ability to get back toenate? >> well, the reality is we didn't wait on the courts. we knew what they were doing since last april. in fact, they gave the signal that they were going to do this march of 2013 and then the day after shelby senator apodaca said now that the headache has been removed we can move forward and they turned a 12-page bill into 57 pages. they've been registering people to vote and we've been going every week, county to county and people are moving in a mighty way and so what we're going to do now is we're going to move those who are already registered to vote. lastly, there are 400,000 white women and 287,000 african-americans already registered who didn't vote in 2010 and voted in 2008 and 2012 and we'll turn this vote out like it's never been turned out. this is an election on and not an election off. >> has the naacp notice good other attempts to hamper voting rights in north carolina other than this law thand this ruling that's anyone into place? >> oh, sure. >> such as? >> they've

know you've been following early voting in north carolina where senate candidates tom tillis and kay hagenng neck in neck. any surprises? >> well, what's really surprising is that it seems like it is not a traditional midterm electorate here in north carolina. we're probably going see well over a million votes come in. we're already over 900,000. we have today and saturday to finish up our early voting and democrats are doing actually quite well. the black registered voters are casting ballots, they are at 25%. in traditional midterms they're usually about 20% of the electorate. in a presidential year they're about 30% of the early votes so they are right in the middle. what's really surprising is that unaffiliated voters are up substantially over where they were four years ago so i think we are heading into a much higher turnout than we traditionally see about 45% in 2010. we may get closer to possibly 50% voter turnout. i think at that point all bets are off because it is very much a different type of midterm electorate here in the tar heel state. >> and we thought no one cared about the
