the parents of kaylee goncalves are here today outside the court anxious for this issue to be resolvede research and we could only find two cases where igg has been attacked by the defendant as being an illegal search and then both of those cases the defense, they were not successful. those defendants were found guilty, all of the evidence was allowed. that is expected in this case we will have to see with the judge rules. >> will: i'm trying to make sure i understand. it is pretty fascinating. they collect evidence of the crime scene, they trace it back through publicly available dna evidence for ancestry.com for example. so for bryan kohberger to say that is an illegal search i guess you would have to say all that public information is private or in some way needs a search warrant to access. that would be a hard argument to make i would think. >> that is why these other two cases one in ohio, and one in washington state were unsuccessful. the judge has ruled exactly as you said these were voluntarily given dna samples to make a profile by some of his relatives to build the family tre
