we get the latest market details from jason brooks with kcbs and cbsmoneywatch.com. good morning. >> reporter: good morning, elizabeth. absolutely ugly start on wall street today. poor earnings bellwethers like 3m and dupont really hitting the market hard. let's look at the big board right off the bat. the dow is dropping by 171 points. nasdaq is down by 29. s&p giving up 17 points. yahoo one of the few bright spots today. the company shares run 4% after a reported earnings happened yesterday. earnings topped expectations but melissa meyer addressed analysts in public appearance for the first time saying that more than half the company's employees should be focused on mobile, the scenario where the company lagged behind. and, of course, apple stock will be in focus today with the ipad mini being unveiled. they had a huge rally yesterday ahead of the event up 4%. today apple is giving some back. its shares have down by 1%. but it promises to be a rough go overall for the market. back to you. >> thank you, jason brooks with kcbs and cbsmoneywatch.com. >>> here's a bran

jason brooks with kcbs and cbsmoneywatch.com joins us on a holliday.onday. >> reporter: good morning. american express and walmart getting together on a prepaid card for consumers without access to traditional credit checking accounts and debit cards and right now the prepaid market dominated by cards that have heavy fees and not the same consumer fraud protections that traditional debit cards and checking accounts have. in this case, amex and walmart say that their prepaid card will have that protection as well as far fewer fees than typical on the prepaid cards. the governor signing in that gas suppliers and gas dealers can start selling their winter blends earlier after gas prices spiked big time over the past few days across california. statewide, regular unleaded at $4.68 the highest average on record quite a bit higher around the bay area. winter blend is not sold until november 1, cheaper and as soon as it starts getting into gas stations they could knock prices down immediately by 25 cents a gallon. oil lower this morning on the world stage fal

kcbs radio's matt bigler joins us from the plant with more on the investigation.att. >> reporter: well, details are very sketchy about what happened here outside a baby are us store at the plant shopping -- babies 'r us store at the plant shopping center. we can show you what happened in the last few hours. there is a bullet strike on a window in between babies 'r us and an office max store. there's another shattered window over here. apparently, there was obviously a shooting. what we're hearing is that a woman armed with a gunshot at another woman outside the entrance to these two stores. there's also some evidence of blood splatter over here on the sidewalk. this was not a fatal shooting from what we understand. and arrests have been made. but this is all secondhand information at this point. not confirmed by police. we're waiting to hear back from san jose pd to to find out what happened outside the babies 'r us store in san jose. but reports indicate a woman armed with a gunshot at another woman and has been hospitalized. live from the scene in san jose, matt

here to talk about that more is kcbs moneywatch reporter jason brooks.ing. >> big dollars at stake here. there is a fight with samsung and apple. apple won a $1 billion jury judgment against samsung recently regarding patent infringement on the iphone and ipad and now samsung is appealing that and now adding another apple device to its own patent case against apple this time the iphone 5. at the same time, the judge presiding over the case in san jose in federal court decided to lift the sales ban on the galaxy tab 10.1 that was the one samsung device that the jury said did not infringe on apple's patents. a lot of legal maneuvering going on between them. speaking of tablets, hewlett- packard, which got out of the business a year ago, is getting back in with a new tablet that's aimed at the enterprise market based off of the palm web os software system that it bought a couple of years ago. >>> automakers sales in september, chrysler sales up 12%, its best september in five years. ford reporting that its sales were down a tenth of a percent on lower truck

joining me on our news panel tonight are barbara taylor, kcbs city hall reporter and scott shafer, host of the california report on kqed public radio. and carla marinucci, san francisco chronicle senior political writer. carla, there is so much going on in politics today. let's start with the vice presidential debate. people said they wanted action. what did they get? >> that's right. you could almost hear the cheers coming out of san francisco, the bars and so forth as it was going on this week. a slugfest, a political slugfest. this is what the democrats wanted to see. if joe biden had one job at this event, it was to pump up the base. he did that job this week after obama's disappointing debate. and we saw obama here this week. this was a very busy week in politics. and it is all about enthusiasm in the base in places like san francisco, northern california. if voters here on the democratic side are not enthusiastic about getting out there for obama, if he doesn't have -- if they don't have his back, he's got trouble in congressional races and fund-raising and everything else. an we

earlier today, the governor spoke at kcbs radio with phil matier pushing his initiative that will raise state income tax on the wealthy and increase the sales tax by a quarter percent. >> the last ten yards to get over the goal line is this money for schools. it's an either/or, on or off, either money into schools or money out of schools of. >> reporter: at stake, $6 billion in automatic cuts to k- 12 schools and universities. >> and if the no vote prevails, there is no doubt automatically the day after the election money comes out of our schools in the form of fewer class days, fewer teachers, higher tuition, and fewer classes at our community colleges. >> reporter: the governor says the state budget needs this to get back on track and he hopes that in 7 years california could have a balanced budget. >> to do that, i'm going to have to be dr. no. it's not pleasant. i don't know if i fully realized how much i have to say no. but that's the vocation i have chosen. and i will exercise the fiscal discipline to keep this state moving on track. >> reporter: and in his personal life the gover

i want to bring in now art barren, from our affiliate, kcla or kcbs.e police say that the family may know who the shooter is. what is the connection? and what sparked this? >> martin, i have been speaking with some neighbors today in inglewo inglewood, and what i'm hearing time after time is the person they believe is the gunman, the suspect, was someone who rented out a room, a back house, if you will, from the residents there in inglewood. and the other thing that we're hearing is that apparently he became behind on his rent, and so they sued for the backrent and then served an eviction notice and then came back and shot the family. now, that is unconfirmed. i did ask the police chief of inglewood, he said, i know of that. i have heard that story, we're looking into that, but he couldn't say if that is confirmed or not. that's an angle they're looking at right now. as far as the gunman himself, we don't know his whereabouts, but the police believe he may have died inside the fire because when authorities got this call this morning, it came in as seve
