keith? >> at the moment of the struggle, there's clearly the officer when he takes -- withdraws his gun, he believes he's entitled to use deadly force. and he may actually be at that moment in time. unfortunately, once that momentum is psychologically set in place the suspect detaches himself and begins to run and the officer is incapable of turning off the switch to not use deadly force. >> is that the defense? >> that's manslaughter, not murder. >> i disagree. the supreme court standard is the officer can use deadly force for a fleeing subject if they will cause injury to someone's life. based on what we know, there's no indication of that at all. >> let's look at the third piece of video. officer slager goes to walter scott's body, drops something next to it could be the thing we saw him picking up earlier. thoughts, dan? >> it could be the taser. the officer had said in his statements before he knew there was a video that the suspect grabbed for his taser. so certainly moving the taser c

i'm keith jones.ice say this all began earlier this evening when the teen fired a gun several times, and then ran from officers into a friend's home on north 11th street. that's where we find nbc 10's matt delucia. police were finally able to get the teen out of the house with a phone call right? >> reporter: and keith, police tell me that may have made all the difference. the scene looks a lot different than a couple of hours ago. this entire area was filled with police cars and right over here, that is the house where the barricade situation started. we'll go to some video right now. when we got on scene, we could see police focused on that house. i'm told that there were plainclothes officers in the area around 8:30 tonight. they saw someone randomly firing a gun at least five times in the street. when officers walked up to that man, the suspect runs into this house on the 900 block of north 11th street. they can see this guy and the other people out the back window. and they refused to come out. n
