could you have happen what happened at sandyhook and your answer is, according to kelly, kelly, i want to be fair, kellydo any of the proposals you've heard about controlling gun violence in america, do you support anything that would actually reduce the number of guns in circulation? >> yes, absolutely. i support true background checks that allow us to know who has the gun, meaning without registering them. that doesn't work. michigan has had a law since 1927. you have to register -- you have to have a permit for a handgun. and have you seen detroit lately? so i'm for true background checks and true knowing who has the gun if it's -- and knowing about that person who wants a gun. here's a great example, piers. you know, the hipaa laws and all of these privacy laws that medical conditions mean that i, as a gun seller, could do a background check on somebody who wants a gun, but there's no way that i have any access to know that that person is mentally ill, which has been the pattern with some of these most recent shooters that you point out. >>> so, i, as a mother of children ages 8, 8, 5 and 3, you're

kelly o'donnell. kelly o, give us the timing. this is the first amendment that will be offered. give us some sense of the timing of it and where this sort of head) >> yes you need a spread sheet or a calculator today to keep things going. what we expect is when the senate is back at 2:00, they may spend part of the afternoon talking about some of the substantive issues within the bill. you'll be seeing senators manchin and toomey whose names are now totally associated with the expanded background checks measure. available on the senate floor to talk to their colleagues, to try to proverbially twist arms. we expect a vote will come wednesday. so what it really falls down to, chris, are a very small number of senators who are considered on the fence. and we know that the majority of democrats are in favor of this, the majority of republicans are not. and there are a few senators who are not yet disclosing which way they will go they're studying it, they're reviewing it, they have different political circumstances as well. that could shape this. but it is a critical 48 hours for this measure. >> i want to talk about you because i think most people have made their minds up. we've got kay hagen for north carolina. saying she would vote for toomey/man shinn. but there are a hand full of folks, let's show some of their names. i want you to talk about the politics that go on here. on the democratic side, mary lan droou undecided. max baucus undecided. heidi heitkamp undecided. deanç helder of nevada, jeff flake and retiring georgia senator saxby chambliss. i want to focus on the democrats here, kelly because this is something that president obama has made a big priority. mary landrieu, heidi heitkamp, up for re-election in 2014. >> not heidi heitkamp. >> yes, baucus and landrieu. >> for baucus, his fellow state senator was just re-elected, a democrat as well. but montana is gun country there are many people strong advocates for the strongest gun protections for gun owners there. so he is one to watch. max baucus. will he be a no, will he be a yes? he surprised us a bit by voting yes to begin the debate. that's a very different calculus than voting on the measure itself. heidi heitkamp is from north dakota, similar circumstances there. and when you've got mary landrieu, louisiana, her fellow representative of louisiana, david vitter, a republican, so sometimes it's what happens with how voters in a state will judge the two senators who represent them. when they're both from the same party, it can be easier if they cover each other. if they are of different parties in landrieu is in

kelly o'donnell with us from capitol hill where she's been covering all day. kelly, good evening. >> reporter: good evening, brian. what we are talking about is a swing from politically undoable to the surprising number of republicans who signed on with democrats to say it's time to start working on the guns issue even though they deeply disagree. how did that happen? many here say the newtown families made the difference. snapshots of fallen children and teachers of newtown inside the senate. outside the capitol, a 23-hour vigil reading gun victims' names. >> jamie stafford at the age of 31. >> reporter: crosses to remember them on the national mall, and family members here to witness the vote. >> we are standing here because her sister and my mom can't be. their voices need to be heard. >> reporter: under that emotion-fuelled pressure, expectations shifted. >> literally the political landscape of america on gun safety is changing before our eyes. >> the motion is agreed to. >> reporter: today, senators took one small but significant step opening what will likely be weeks of heated debate over gun laws and violence in our culture. 16 republicans voted to begin that contentious negotiation. >> it goes way beyond guns. that's why we need to have the debate. >> reporter: two red state democrats up for re-election next year including alaska's mark begich voted against taking up a guns bill. >> i vote what's important for alaska. it's not a party decision. it's not conservative versus liberal. >> reporter: in today's nbc news wall street journal poll overall 55% of those surveyed want tighter rules on gun sales. down six points since january in the immediate wake of newtown. the biggest divide on guns is along party lines. 82% of democrats favor stricter gun laws while just 27% of republicans do. >> i am not interested in congress voting on a measure that would have no impact on the horrific violence we have seen in recent months. >> reporter: after victims' families left the senate chamber, some described another set of emotions. >> the tears we had were tears of joy. tears of remembering this is happening and we are here because of what happened to us. >> reporter: we reached out to the national rifle association to get their reaction on today's vote, but got no response. the group has already said it is against any kind of new gun restrictions and will closely watch what the lawmakers do. it gets going early next week with the start on background checks. brian? >> kelly o'donnell on the hill again tonight. kelly, thanks. >>> weather making news again tonight. a strong line of storms that cuts the eastern half of the country like a knife from north to south. there have been very severe storms spinning off this system. tornadoes on the ground now for the second straight day and night with twisters in arkansas, mississippi and alabama. while it's all moving to the east it's punishing some of the places in its path. that includes birmingham, alabama, where we get our report from nbc's gabe gutierrez. >> it's coming toward us. >> reporter: a massive tornado barrelled across mississippi this afternoon, killing at least one person and injuring several others. dozens of homes and businesses in kemper county destroyed. preliminary reports say the tornado was on the ground for 56 miles. >> on radar we saw extremely violent signature with this. we saw tornado debris signatures with this. we have seen video of the big wedge or big cone-shaped tornado. >> we have

kelly o'donnell with us from capitol hill tonight. kelly, good evening. >> reporter: good evening, brian. the mood inside the senate chamber, which was packed, was intense with emotion as gun victims, survivors and many of the newtown families watched senators they had personally met with vote down expanded background checks. tonight, the president gave the rose garden microphone over to a newtown dad, mark barden. >> we'll return home now, disappointed but not defeated. >> reporter: the president, clearly angry -- >> the gun lobby and its allies willfully lied about the bill. >> reporter: -- lashed out at congress. >> this was a pretty shameful day for washington. this effort is not over. i want to make it clear to the american people. we can still bring about meaningful changes that reduce gun violence so long as the american people don't give up on it. >> reporter: from the steps of air force one last week to the u.s. capitol again today, newtown families who know the pain of gun violence had been unwilling to give up. >> our hearts are broken. our spirit is not. >> reporter: gabby giffords, who has personally lobbied senators, called the failure to pass expanded background checks unthinkable. today being heard or consoled was not enough for patricia. tucson shooting survivor who shouted at senators, "shame on you." >> shame on you! >> order in the senate. >> they have no compassion. >> reporter: some newtown families held more private meetings. no media coverage. republican senator mark kirk's staff took these pictures. the latest nbc maris poll shows nearly 9 of 10 surveyed want tighter restrictions on gun sales. four republicans voted yes to extend background checks to commercial sales at gun shows and the internet. >> expanded background checks would not have prevented newtown. >> reporter: conservative opposition was strong. >> this is the first step in the erosion of our rights under the second amendment. >> we are trying to take it to the violent criminal. rather than taking it to the innocent second amendment law abiding citizen. >> reporter: usually a vice president arrives to preside over a winning vote. biden was here to witness its defeat. >> the amendment is not agreed to. >> reporter: four democrats from red states with high gun ownership also voted no. in talking to those democrats who voted no, they say they had intense pressure from their home state constituents who did not want to see expanded background checks. also tonight, senators voted down an assault weapons ban and limits on high capacity ammunition. it is possible that democrats will simply shelve this legislation in order to try again some day down the line. brian? >> again, the president calling this round one. kelly o'donnell on the hill tonight after an eventful day there. kelly, thanks. >>> still ahead for us this evening, the unsettling development elsewhere in washington. who sent letters laced with ricin to the president and at least one u.s. senator? evacuations there today as memories of the anthrax attacks came rushing back. >>> later, making a difference. they are here with the help of some very comforting visitors at a hospital in boston. >>> we're back. as we said, contributing to an overall feeling of unease today was this word out of washington starting last night that the poisonous substance ricin, which most of us first got a lesson in in the days after 9/11. ricin has been found on letters mailed to the president and at least one u.s. senator. the letters were stopped at a sorting facility and never were allowed through. nbc's andrea mitchell in our washington newsroom has been covering this today. andrea, good evening. >> reporter: good evening, brian. nerves were already on edge

it's where we begin tonight with nbc's kelly o'donnell on capitol hill. kelly good evening. >> reporter: good evening, brian. what we watched today really involved only one piece of what has been a big, complex debate about guns, and it includes just a few senators, and yet the impact seems so much larger, in part, because of the emotion that helped make it happen. driven by their loss. >> i feel like i carry my daughter's spirit when i go into those meetings. i wanted them to hear me as a mother. i asked them if they could, please, give me something i can tell my son.

kelly o'donnell and kelly, i understand you've got more breaking news on this as well. >> craig, there is so much happening here, i've got a couple of things i want to tell you, first, on guns, we were first to report that kelly ayotte, republican of new hampshire, will be making it very difficult for those who are supporting manchin toomey to get that passed, but just seconds ago, we had a loud speaker announcement here at the russell senate office building where police say there is a suspicious package near the office of richard shelby and therefore, they are trying to clear the area. everyone here is on high alert because of what's happened in boston and because of what's happened with a ricin letter, a suspicious letter sent to roger wicker, republican of mississippi. off site, they detected as a mail facility, a letter that contained a white granular s substance that in an initial test proved to be ricin. work on that continues. where i'm standing now, if you can hear overhead, there's sort of a muffle ed sound of police announcing they are clearing the area around richard shelby's office because of a suspicious package. now, that is a function of the world we live in now. there are often circumstances w
