i also represented that very brave witness, kelly johnson. but one was not enough so at the end of that first criminal case where there was a deadlock, a mistrial, i said publicly, i urged publicly for the prosecutor to once again renew his motion to allow prior bad act witnesses to testify and this time i said, i hope that the court will allow more than one. because i felt that more than one would be required in order for the jury to really fully understand that mr. cosby has a common plan, scheme and design to drug and sexually assault women. i thought it would be important for them to know that mr. cosby could not have been mistaken about whether these women or andrea constand consented because if they saw that other women would testify under oath that, in fact, mr. cosby had also drugged and sexually assaulted them that they would see he couldn't have been mistaken whether andrea consented and he would know if he was drugging and assaulting a woman. if the jury believed that, that in fact, they can't consent incapacitated and that's why t

in fact, at the end of the first criminal trial where one other of my clients and accuser kelly johnson testified, i was very proud of her as well. but that case ended in a deadlock. and i said after that we need to have more prior bad act witnesses, in other words more -- other accusers be permitted to testify. fortunately, this judge, who was the same judge as in the first criminal case, did allow five to testify this time. and i felt that would make a difference. and i do believe it made a difference because it demonstrated to the jury that mr. cosby had a plan, a design, a scheme, to drug and assault women, and also that he couldn't have been mistaken about whether andrea consented or not. because if someone has a plan to incapacitate a woman by drugging her and then sexually assaulting her, then he knows she's not consenting. >> as i was watching, one of the women said the justice system is eons behind the culture. this is the first conviction in this "me too" movement. do you think this is just the beginning, gloria? >> i think it's very, very significant. i do. and of course my c

he let one in, kelly johnson. but the second time around, let in much more evidence. we heard from other victims. this course went only to the issue of whether or not cosby committed this offense on the night in question against andrea constand. the fact that they brought in other women to testify, typically as a defense attorney, that's the kind of evidence you fight tooth and nail to keep out of that courtroom. because the argument goes it has nothing to do with the incident that occurred that night. now, another really interesting ruling on the part of judge o'neill, he let in a confidante of andrea constand saying that she could extract money from a celebrity making up a false accusation. lot of us in the media, we thought maybe that was going to be sort of the nail in the coffin for the prosecution's case. it seemed like it was a little bit of a balancing act on the part of judge o'neill. he let these other women testify. now he'll let in sort of this character assassination on andrea constand. well, jury's not buying it. >> shepard: i have to say, we don't do th
