michael zeldin and ken cuccinelli, attorney general. great to see you. >> first to you.when does the fbi conduct a predawn raid when the subject is actually cooperating? >> when they think the subject actually is not cooperating. i think that's what we saw here, which was that they didn't believe that manafort was cooperating as quickly as they wanted to. in order to get a search warrant, you have to convince a judge that a person has probable cause to believe there's a crime and that the evidence of that crime is in the location to be searched. that's a serious, you know, bar to jump over for any prosecutor in normal circumstances. in this case, when the person is cooperating, it's higher. they achieve that and went into his house and took what i expect to be a lot of electronic information. i'm not sure there's so much paper there as there is hard drives and cell phones and other matter that is not easily acquired unless there is a search warrant or full cooperation. >> ken, as michael lays out perfectly, to get a search warrant, they have to show there is probable cau

joining us to discuss, cnn legal analyst michael zeldin and former virginia attorney general ken cuccinellisible ramifications for jared kushner? >> the eb-5 program set up under the immigration act of 1990 allows permanent resident status to make a million dollar investment ep generally or $500,000 in targeted unemployment area, high unemployment area and a perfectly lawful program if done right. the problem here, as it has been alleged, is that the properties that the kushner companies used for these eb-5 programs and they use it because they get lower interest rates on the loans, were esurly gerrymandered districts that incorporated into the district areas that really were not adjacent to it in order to sort of squeeze them in as we'll be told, how they do that in political gerrymandering. so if they find that that was done inappropriately, then there may be liability for violation of the eb-5 program and the s.e.c. brought, you know, cases against companies that have done this improperly. >> ken, i want your take. and add in there jared kushner's name being dropped. is it a crime to do

ken cuccinelli, you were the attorney general in virginia.l counsel trying to squeeze paul manafort? >> squeezing is probably giving him too much of an ill motive. this is an information gathering tool. it's appropriate for special counsel to use. they're using it. it demonstrates they've gathered some information and they have more questions. of course, manafort, with his failure to file exposure to other foreign banks, in particular with respect to his ukraine work with pro-russian individuals and entities has exposed himself to exactly this kind of inquiry from the special counsel. so i don't find anything unusual about it. i think if i were in robert mueller's position and manafort had filed a year late the kind of disclosures that he did, i suspect that i would have sought a warrant to go into his house, too. >> brian fallon used to be the spokesman for the department of justice in the obama administration. do you agree? is that the only reason, or do you think it's possible they were worried he might destroy the documents? >> i suspect
