ken dilanian joins me now. ken, what more do we know about this?>> reporter: lester, the fbi has joined the nypd in investigating a letter containing a threat to kill manhattan d.a. alvin bragg. officers today were at his office. bragg is overseeing that investigation into former president trump regarding that hush money payment. police say the letter was postmarked tuesday from orlando and contained white powder that authorities determined was not dangerous. all this as mr. trump has been ratcheting up the rhetoric on social media overnight warning of a potential death and destruction if he is charged. he also showed images of him holding a baseball bat near bragg's head. those posts coming before the death threat was mailed, but there are still concerns tonight. a senior new york law enforcement official telling us, bragg has received a couple of dozen serious threats. >> and, ken, meantime, mr. trump suffered some setbacks in the special counsel, that separate investigation. >> reporter: yeah, lester, a judge ruled that mr. trump could not use e

ken dilanian has that story for us. this has been quite the mystery for many months, what do we know now? >> i remember you and i talking about it years ago. this is as definitive a product from the u.s. intelligence committee as you get. a two-hour briefing where top intelligence officials answered every question about this. what they found is no evidence to support what had been a long standing hypothesis which was that some of these mysterious symptoms suffered by as many as 1,500 u.s. spies and diplomats around the world were the result of an attack with a weapon of some kind from a foreign adversary. they found no evidence of that, and in fact, they found evidence to the contrary. a leading suspect was russia. they implied that there was reporting or intercepts from adversaries, including possibly russia, expressing puzzlement about these claims, and wondering whether this was a u.s. disinformation campaign, and they found no evidence of any development of a weapon using microwave energy or any other kind of energy

joining me now is ken dilanian. this is incredibly disturbing to say the least. >> the kind of case we're seeing more of. the fbi got on to this man because ofth his twitter accoun i've been through, the work of a very disturbed individual, and includes atu lot of anti-semiti and these threats to michigan state officials, and when the fbi began investigating, they learned that hebe was also unde investigation by the michigan state police, who suspected him of stealing a handgun, as you said, theygu learned from his mother he was heavily armed, he had access to military style weapons and they became concerned,th tracked his phone, they arrested him a few weeks ago and he's now in custody charged with making threats. as you said, the attorney general of michigan, this is not in the courthi documents, but s said publicly she was one of the people he was targeting. also reports he was targeting elissa slotkin who is jewish, but this comes in a context in anes uptick in anti-semitic incidents and hate motivated extremist motivated attempts at violence nationwide. >> s

vaughan hillyard and ken dilanian, thank you. now we want to move to other news in which president biden wants to hold the management of the banks that collapsed liable. >> and last night a lifeline thrown out to failing bank republic bank. we start with brian cheung and allie raffa. >> well, we heard president biden want to vow to hold these bank managers accountable. he wants to expand the fdic's authority to take things like stocks and bonuses away from the banking executives involved in the banking failures. the banking executives accused of mismanagement, and taking too many risks with the depositor's investments there. and he wants to call for a barring of the executives to hold a job in the industry after the banks have failed saying that if they were responsible for the banks that have failed, they should not be able to turn around and lead another bank. he is calling on congress to expand the fdic's authority to issue fines and to sue the banking executives involved in the failures, and whether or not this could come to

joining us is ken dilanian. what does this mean for the lawsuits that have already been filed?s entered in a particular case where some capitol police officers and members of congress have sued donald trump and a federal judge has already ruled he wasn't immune, now it is in the appeals court and the appeals court asked the justice department to weigh in, so it is deeply significant because the justice department generally jealously defends presidential immunity. in this case, they're saying what donald trump did by giving that speech at the ellipse, and what he may have done on twitter had nothing to do with his presidential duties. they're not saying it is an issue of incitement, but they're saying he can be sued, he can't invoke presidential immunity to shield him from the lawsuits. they said in addition to the one at issue here there are five other cases that they're aware of that are making the same argument. it really opens the door to a lot of litigation against donald trump. >> yeah, i mean, is there -- is this in some way fast track any more lawsuits filed against him

nbc news justice and intelligence correspondent ken dilanian joins us now. evan corcoran. we don't know what was said behind closed doors today. but the fact that donald trump's attorney was testifying in a criminal investigation involving these classiied documents is a momentous development in this investigation. a federal judge ruled that the crime fraud exception applies here, and that attorney/client privilege could be pierced and that donald trump's lawyer could be compelled to come to this grand jury and testify, and what we believe the special counsel wanted to ask them about was the representation that was made by corcoran and another trump lawyer to the justice department. corcoran drafted it, another lawyer signed it. back in june a document that said they had looked for all the classified documents and they hadn't found anything. everything they had had been turned over. that was false. the fbi found documents including some in donald trump's office. who lied to the justice department? did the lawyers lie? did donald trump lie? and the real import

i want to bring in nbc's ken dilanian, tali farhadian weinstein, ken, what more can you tell us aboutling? >> this opinion holds that president trump does not have absolute immunity from multiple civil lawsuits filed by police officers and members of congress, which seek to hold him liable from damages -- for damages stemming from the january 6th riot. the point the justice dmt is making is speaking on public matters of public concern is a traditional function of the presidency. he would be immune from lawsuits regarding that kind of speech. a speech far outside the president's office that allegedly incited a riot is not covered by that immunity according to the justice department, and a federal judge in one of these cases has also held that position that trump can be sued, that his speech exhorting people to go to the capitol on january 6th was not covered by presidential immunity. now it's in the appeals court, and the justice department has weighed in in favor of allowing trump to be sued. now, the justice department is not taking the position that trump's speech was incitement. th

for more i want to bring in ken dilanian she thank you for being with us this morning. your team was dispatched to provide medical care on the scene of the shooting. what was those moments like? >> initially for our responders, those moments were like any other moment. unfortunately, they are trained for those moments, for responding to those emergencies. obviously, when we found out that there were students involved in this senseless act and adults that were ultimately killed from this incident as well, those moments turned to somber feelings and a heavy spirit that now is carried throughout our community. that's what we're feeling this morning. we're feeling that heaviness because this has now impacted our community locally. but out of that, we are rising and we are also feeling very proud of those that had to face this head on. that went in to encounter that shooter and prevent this from turning into something that was more tragic and we're very proud of the response time and very proud of what our first responders did, which was not easy on anyone. we are very sombe

nbc justice and intel correspondent ken dilanian joins me now. stices are leaning on this case? >> reporter: it was hard to tell, chris. the court appears closely divided. the three liberal justices seem sympathetic and so did conservative justice neil gorsuch. others appeared more skeptical. amy coney barrett asked tough questions on both sides. this case could have a profound impact, not only on the largest native american reservation, but on millions of people across the west who are facing an historic water crisis. the navajo nation sued the federal government 20 years ago now, seeking more access to water from the colorado river and other sources. nearly one in three navajos is without running water. they argue, among other things, the united states is in breach of an 1868 treaty which came after u.s. troops forcibly relocated the majority of navajo men, women and children from arizona to new mexico in a brutal and violent military campaign. in 2021 a san francisco appeals court handed them the victory but the biden administration appealed as

nbc news justice and intelligence correspondent ken dilanian is joining us now. ter: well, the attorney general of michigan, aaron, dana nessel said on twitter she was one of the officials targeted. the criminal complaint does not name others but there's a report that congresswoman elissa slotkin who is jewish is among those who were threatened. this man according to the criminal complaint was posting these threats on twitter, i've reviewed that account. it's full of rantings and ramblings, it's clearly the work of a very disturbed person and what the fbi says is once they began investigating they learned that the state police was also investigating this man for the theft of a handgun and learned from his mother that he possessed weapons including a high-powered military-style rifle which got them very concerned. they tracked his phone and ended up arresting him. he's now charged with making these threats and he's in custody in detroit, aaron. >> you know, ken, we've talked a lot about the rise in anti-semitism and violence connected to it in the last few years. t

joining me now is ken dilanian. explain this ruling. >> many viewers will remember that he was freed last fall after 23 years in prison after the prosecutor in the case said that he was not the murderer. that they had evidence pointing to other suspects. the first thing to say is there's no reason to believe he will be going back to prison. this is a proceed yal issue. the court ruled the victim's family was not given proper notice to appear at the hearing in september. so the court is ordering what they call a new legally compliant and transparent hearing on the motion to vacate where the family of lee is given notice of the hearing that is sufficient to allow them to attend in person and where that evidence to vacate the conviction will be presented again and the court can once again state its reasons. in other words, they can just do the whole thing again with members of the family present and the court can vacate the conviction. there's not going to be anyone arguing against doing that because the court denied t

ken dilanian is following the story and joins us now.ny one particular cause. what they are saying is that after years of intensive investigation, they have not been able to tie any of these incidents to an attack by a foreign adversary or any deliberate act of any kind. there was a working hypotheses when this first emerged in 2016 that this was a foreign adversary, likely the russians, using some kind of microwave division that was causing brain injuries. a lot of people believed that. they've done a lot of investigating since then. i was briefed on it for two hours today by intelligence officials. they say they investigated every possible scenario. they have not links to a foreign adversary and they have intelligence contradicting that it was russia, china or cuba. they say it's extremely unlikely. about as definitive as you can get in the intelligence world. they're not saying they disbelieve these people who suffered very real injuries, including brain injuries, they are just saying they were caused by other things, and they're not

joining me now, nbc justice and intelligence correspondent ken dilanian, sam stein and susan page.alk about the propriety of a former president of the united states, a target of a grand jury investigation, attacking an elected district attorney investigating him with violent language and now a trump attorney is asking for an investigation into alvin bragg, asking the state u.s. -- new york department of investigation official. >> andrea, were that to have happened when i was the u.s. attorney or federal prosecutor, we can be certain the fbi would have been knocking on that person's door to determine the nature of that veiled threat, if it's a veiled threat at all. what president trump has tried to employ in the past as it relates to people who would listen to what he says with regard to protest is he wants peaceful protest. he was surprised by what happened on january 6. now we know and he most certainly knows the power and influence his words have upon a certain number of his followers. we know that some of those people will read those words and think it's a call to violence. when

ken dilanian has that new reporting. what's going on between the u.s.d morning, jose. current and former u.s. officials are telling me that it's the worst it's been in decades. in terms of cooperation between u.s. law enforcement and mexico law enforcement against the drug cartels right at the time when that cooperation is most needed amid this epidemic of fentanyl deaths this week, we learned a 16-year-old danteenager died in texas after taking a pill. this is being produced by two drug cartels in mexico right now, the u.s. is not -- rather the mexican government is not allowing the u.s. to join operations there's very little intelligence sharing. there was a senior level u.s. delegation that went down to mexico city right around the time those four americans were kidnapped, two killed. there were prearranged talks on the fentanyl crisis. the u.s. delegation hoped to announce something good, then the president of mexico made a bizarre statement on the day of the talks saying mexico doesn't have a fentanyl problem, we don't produce fentanyl down there.

. >> joining me now is justice and intelligence correspondent ken dilanian. this is the annual assessment of global threats. she talked about the threats from russia, the war in ukraine, iran, north korea. her main focus is china. what else stood out to you? >> what stood out is their assessment of china becoming authoritarian and the belief in china that china's rise depends on essentially america's decline. they can only gain power and influence at the expense of american power and influence. that's a recipe for conflict. that's a zero sum game. it sounds dangerous. >> what about the possibility of china working more closely with vladimir putin at this pivotal moment we believe in the war? >> you know, they reiterated their belief that china is considering providing lethal arms to help russia in the war in ukraine but they haven't made that decision yet. >> the hearing, when i was watching it before i came out here, was focusing on section 702. this gets down in the weeds. but it's the foreign intelligence surveillance act post 9/11 with potential for abuse

justice correspondent ken dilanian has the latest on the probes into silicon valley bank. i'm also joined by andrew wiesman, former jl counsel, who also served as director of the fbi's enron task force ron, let's start with the tanking stock price. what's going on here and how does it fit into the larger story involving silicon valley bank >> well, we're worried that this problem in the banking sector, which was local with respect to silicon valley bank and regional banks had exposure to specific industries they had assets that were declining in value as the federal reserve raised interest rates rapidly over the last year now we're seeing this spread across the pond, which is an institution that's never been deemed to be up with of the most credit worthy among the european banks. it's hitting the european markets hard one of the larger shareholders said they would not put anymore money in and that triggered as 24% sdrop in their shares to a new all-time low now there are more concerns about whether u.s. banks, sm smaller banks are healthy and will require anymore activitie

joining me from washington, nbc news intelligence and justice correspondence, ken dilanian. he has the breaking news. nbc news correspondent vaughn hillyard, outside the d.a.'s office is nbc news correspondent garrett haake, "new york times" political correspondent michael bender. ken, what are you confirmed? >> a source briefed on the matter has told us that a federal judge ruled friday night that the justice department established that donald trump committed crimes through his attorneys such that that judge ruled that the crime fraud exception to attorney/client privilege should be invoked and trump lawyer evan corcoran should be required to testify before the grand jury about conversations with his client, which is a deeply significant advance in this classified documents case because one of the things at issue has been who caused a document to be given to the justice department that said that a diligent search had been made and all the classified documents had been turned over in june, which wasn't true because in august, the fbi found more than 100 classified documents a

. >> i want to bring in justice correspondent ken dilanian. what is the fbi saying? >> i had a chance to ask the attorney general, merrick garland, who was having a news conference on an unrelated matter. he was not in position to confirm what the mexican government is saying. he said, as soon as he learns more information, he will give it to us. i asked him, what does this say about the ability of cartels to operate with immunity in some parts of mexico? listen to what he had to say. >> cartels are responsible for the deaths of americans. we are fighting as hard as possible. the dea and fbi are doing everything possible to dismantle and disrupt and ultimately prosecute the leaders of the cartels and the entire networks that they depend on. >> as you know, the u.s. intelligence community is working hand and glove with the mexican authorities to go after the cartels. they use some of the highest capabilities of u.s. intelligence, eavesdropping, overhead video, aircraft surveillance. we can assume they are using that right now to try to try to justice the people that c

nbc's ken dilanian has been digging into this story.e suspect and where this investigation stands? >> chris, according to the criminal complaint, the fbi got on to this suspect because of his very disturbing comments on twitter. i've been reviewing that account. it includes a lot of nonsensical ranting and the specific threats to target jewish public officials in michigan. when the fbi called the state police, they learned the state police was investigating this man for the they felt of a handgun. when they talked to his mother, they learned he has had a lot of weapons, including a military style rifle. they became very concerned, have arrested him, and charged him with making these threats, as you mentioned, the attorney general of michigan has said on twitter that she was one of the people threatened. the court documents don't say which officials were threatened. there are reports that congresswoman elissa slotkin was among those he was targeting, and this isn't the first time this has happened. just in december in michigan, another m

i want to bring in nbc's ken dilanian who just got new reaction from the attorney general and frank figlucci. what do we know about the investigation and the whereabouts of the two survivors? >> the best information we're getting so far is from mexican officials, the attorney general of the town of tamaulipas saying that in fact the two americans who survived have been transferred to u.s. custody. we are seeing photos of an ambulance from brownsville, texas, going across the mexico border back to texas. we have not confirmed whether that's related. u.s. officials steadfastly unwilling to comment on any of this, presumably because they want to wait and talk to the victims' families once they know the full story. but, i have been told by law enforcement sources that what happened here, as you said, a case of mistaken identity. these four americans were crossing the border because one of them was en route for a cosmetic surgical procedure in mexico where it is much cheaper to do that and they were fired upon by cartel gunmen. and one working theory about what happened here is the cartel thought
