nbc's ken dilanian has a copy of that letter and the response from the fbi what is going on, ken?, chris, i spoke to the ngo that identified those other police stations, safeguard defenders, this morning. they told me they're sure there is another chinese police station in los angeles and in another unnamed u.s. city. in those other cities, there's something called chinese overseas service centers which they suspect could be a place where chinese government agents are attempting to harass dissidents and go after opponents of the chinese government on u.s. soil. what the fbi is saying is they take seriously any attempt by china or anyone else to break u.s. laws or target and harass u.s. residents and they will use their lawful authorities to pursue it. they haven't said if they're investigating those other locations. once they indict two people in new york, that sent a signal to other chinese agents doing anything illegal across the united states that they needed to clean up their operations, so it remains to be seen what action the fbi will take but the chairman of this homeland s

joining me now, ken dilanian and chris cont kristin welker ken, you read through the unsealed affidavithat can you tell us about this? how does this happen ten years after edward snowden >> that's the question this affidavit doesn't really answer it. it does suggest that the fbi was neck and neck with the news media in terms of identifying and then arresting jack teixeira they only confirmed his identity with a witness through a photo i.d. yesterday some pretty da ramatic and rapi turnaround we are learning more and more about what his friends and associates say his motives were and what they were not he was not a whistle-blower. he was not trying to turn this material over to a foreign power. really, he seemed like he was trying to impress friends in a chat room. listen to what one told "the washington post" >> he was not hostile to the u.s. government. he disagreed with waco and ruby ridge and thought that the government is overreaching in several aspects. there was no heavy snowden-like conspiracy here, like some people believe >> he is not charged with trying to injure the united st

arsenal of weapons and tactical gear at his house nbc news justice and intelligence correspondent ken dilanians with us now. ken, what else are prosecutors revealing ahead of today's hearing in this 18 pages of a filing last night? >> this filing really does put this case in a somewhat different light than the notion of a 21-year-old misguided young person just sharing information to impress his friends first of all, in arguing to keep him behind bars, prosecutors are saying, look, he's facing a sentence of 25 years or more and he has access to classified information far more than has been made public, and they fear that a foreign power could recruit him and spirit him out of the country unless he is confined broader than that, they looked into his history of making violent and racist posts on social media, even going back to his school days where he apparently joked about using a molotov cocktail and disturbed the local police when they declined to grant him a gun permit somehow he got a top secret clearance after that and they also talk about him destroying evidence after he learned that the

nbc's ken dilanian is following this for us. ken, these numbers are staggering. tell us what we know about this, and what the fbi's planning to do about it. >> yeah, this was a budget hearing, alex, and highlighting the fact that the fbi's cyber corps is vastly outnumbered as he seeks more money for more hiring. china has stolen more of american's personal and corporate data than all other nation's combined, and there are more than 2,000 open counter intelligence investigations involving china. he warned that a recent passed house bill which would cut the fbi budget by 22% would be very harmful. take a listen to what else he said. >> 22% reduction, scores china left unaddressed and i can say assure the chinese government is not cutting back. the hacking program is bigger than that of every major nation combined, so 22% reduction would be cutting capacity against more and more attacks which hit critical infrastructure. >> it's remarkable. they have so many more people to throw at this problem than the fbi does. the fbi is requesting about $63 million in additional

joining us now nbc news justice and intelligence correspondent ken dilanian, who has been all over this story from the very beginning, and frank figliuzzi, former assistant director for counterintelligence at the fbi ken, set our expectations for what's going to happen in court today and then later at these briefings. >> well, ana, in terms of court, it looks like this will be a brief appearance where jack teixeira will affirm to the judge that he is essentially willing to stay in jail for another two weeks. this was his motion, after all, requesting to delay this detention hearing. it suggests that he's cooperating with the government, that he's talking. it suggests that, we haven't confirmed that, but -- so he'll be in custody awaiting another detention hearing in two weeks, and then in terms of the briefing today, look, senators have, you know, a laundry list of questions both about specifically how this leak happened at this particular air base, and it seems very clear that normal dod procedures for handling classified information were not followed strictly here. is highly sensitive

so i want to get right to that story with nbc's ken dilanian who has been following this for us ken, what do we know >> well, chris, this airman in cape cod was first identified by "the new york times," two law enforcement sources confirming to nbc news that he is the chief suspect and that he was the leader of this chat group posting highly classified documents that were then distributed and then became public and what's so remarkable about all of this in this astonishing story is that this person was 21 years old. he is 21 years old, born before 9/11, worked for an intelligence unit within the national guard, and it's really not clear how he had access, if he did, to such highly classified information. that's going to be one of the big questions here, whether he had access as part of his job or whether he somehow secured -- again, allegedly, these highly classified documents and posted them to this chat group. we're seeing evidence that he was promoted to the rank of airman first class, someone by his name was promoted in this intelligence community of the massachusetts air nationa

that breaking news officials have identified a suspect in the classified documents leak nbc's ken dilanian is back with us ken, minany minute now we're expecting to hear from the pentagon what are the main questions we need to have answered here >> the biggest question i have is an arrest imminent in this case it looks like there is we have colleagues near a house associated in public records with the person we have identified as the suspect in this case. it appears police are getting close to doing something there but of course questions for pentagon officials also include did this 21-year-old member of the air national guard in cape cod have lawful access to all of this highly classified information as part of his job or is the allegation that he stole it or somehow gained inappropriate access or a third possibility, was he some kind of technical role, i.t. role, as was edward snowden ten years ago, which gave him so much access. it boggles the mind, as we have been talking about, chris, how somebody at such a low level in an intelligence wing of the air national guard had access to high

nbc's ken dilanian has spent that time digging through this announcement and the charges ken, what more have you learned? >> it's so fascinating, chris. just for context, a human rights group last year identified 110 overseas chinese police stations around the world this, we believe, is the first time that it's been charged as a crime in the united states, and what the complaint says is that essentially these two men were running what they called an overseas police station in chinatown in new york city, and in some cases, these police stations provide services to the community of overseas chinese in whatever city they're in but in this case, what the justice department is saying is they were also instruments of repression by the chinese state. they were harassing dissidents they were trying to persuade people wanted in china on corruption charges which may or may not be valid, to go back to china from the united states, by putting pressure on them and their families they were engaged in all sorts of behavior on behalf of china, according to this complaint, without registering with the a

but ken dilanian is with us this morning. what is the latest on this >> good morning. the intelligence community is scrambling, first of all, to try to figure out who this leaker is but also to try to prevent this from happening again and re-evaluating their approach to social media platforms like discord. this is a really thorny issue, jose the fbi would need a warrant to eavesdrop on a private chat room of the kind that was described in that "washington post" article where the documents were first posted so, they would first have to know the crime was being committed. that's a really difficult thing. when people get a top secret security clearance, they do authorize the government to monitor their social media generally. but you have to know where it is and so, if this person didn't disclose that he was doing the stuff in discord, that goes some way to explaining why this stuff was sitting there for as long as a year according to the account given to the "washington post," before the government even discovered that it was there now, as to president biden's comments t

nbc's ron allen is covering the civil trial in new york city ken dilanian is covering the d.a.'request in the criminal trial, glen kirn kirschner is a former federal prosecutor and an msnbc legal analyst. so ron, what's the latest from inside that courtroom where you are? >> reporter: it's been a very emotional day here, chris. e. jean carroll is on the witness stand. her testimony is continuing, and she has described to the jury in painful detail and breaking down in tears often about the alleged encounter where she says donald trump raped her in the fitting room of burgdorf goodman's luxury department store here in new york back in 1996. she described a very violent, aggressive encounter where he forced himself on her, where he pushed her against a wall and she banged her head against the wall she describes how he allegedly tore her tights, pulled her tights down and then allegedly raped her, and she describes how it was extremely pacinful and ho she was glad to get out of that particular situation by kneeing him, lifting her knee and kneeing him and getting out of there. and

and now all it needs is a judge to approve it, and these families can get their money, chris. >> ken dilanian, thank you for that. >>> now to a new report on jobs that just came out this morning, and it could give us clues on where the economy overall is headed cnbc's jeff cox is here. good to see you again. what are the numbers exactly and who how do they fit into the big picture? >> the fed got reports on bad news is good news when it comes to the job market. the first came tuesday when it comes to the labor department that job openings are below 10 million for the first time since around may of 2020 the second one came today. 180 p, which is payroll processing firm, told us there were just 145,000 jobs created in march, which was a substantial drop and we're actually on a quarterly basis creating less than half of the amount of jobs that we were creating last year. so for the fed, this kind of takes a little bit of the heat off them they're worried about inflation, and in familiar, the red hot jobs market, the wage increases and the pressure that's putting on inflation so this maybe gives

joining me now is nbc news justice and intelligence correspondent ken dilanian the messages about wantings shooting, what else did they find when they were going through teixeira's record in his house that gave him reason to think that he is dangerous? >> he had a number of firearms, and he was outfitted with camouflage and tactical gear he painted a picture of a person who has been emotionally disturbed going back to high school, talking about a molotov cocktail the local police denied him a gun permit wouldn't let him have a license to get a gun he got a top secret security clearance in the airport they're also saying that he may have access to a lot more classified information than already has been made public they're concerned about that they're concerned that a foreign power could help him escape, and they think he's a flight risk. he's facing 25 years in prison and therefore should be held without bond the defense presented an entirely different picture of a person who they say is a law-abiding 21-year-old with no criminal record and supportive family in the area they want him to st

let's bring in ken dilanian who has been following this with us. n, a little bit frustrating that we didn't hear more about the gun that was used but still quite a bit of information. >> yeah, i don't understand the police department's reluctance to say, particularly when we're having a debate about assault weapons in this country, what kind of rifle, but leaving that aside, look, there is no one profile of mass shooters in this country, they come from all different demographics but i have never seen a mass shooter with this particular kind of profile, someone with an advanced degree, a masters in finance from a reputable university, working at a bank. if you look at his linked in profile, he's commenting on the training program that he attended and talking about how wonderful it was and he got to meet all of these great people usually when we're looking at these profiles in the aftermath, distressingly common situations, you see darkness, we hear about social media posts and the police did say he live streamed this incident on instagram, which we s

ken dilanian joins me now. ken, it's unclear what was said behind closed doors yesterday.e a critical account, right, for the special counsel. >> reporter: i think that's fair. while a lot has happened to mike pence, he was after all the central focus of donald trump's efforts to disrupt that congressional session and prevent congress from certifying joe biden's victory, pence has never talked explicitly about his conversations with donald trump in detail. you know, there was reporting, for example, there was a phone call where -- testimony actually, sworn testimony where trump called him a wimp and worse before that january 6th session. but pence himself going before that grand jury and we presumed discussing the details of what trump said could be really important evidence because these prosecutors want to try to get to donald trump's state of mind, they're trying to establish whether he committed crimes while he was essentially perpetrating this plan to try to hold up the certification of the election and put forward a false slate of electors. so pence's testimony very

starting us off today, nbc's morgan chesky in louisville and justice and intelligence correspondent ken dilanian thank you for being here morgan, we know there is a press conference coming up at 11:30. what are we learning now about the victims this morning and what can you tell us about where this investigation stands? >> reporter: still a very dynamic investigation and overnight we heard an unfortunate update in that the shooting has now claimed five lives. we'll explain more on those victims in just a second the crime scene tape has come down overnight here around old national bank and this is where authorities say it was around 8:30 yesterday when this gunman now identified as 25-year-old connor sturgeon walked inside, armed with what has now been described as an ar-15 type rifle and opened fire, wounding nine people two of those, bullet wounds went to police officers we know one of those injured, ana, is 26-year-old nickolas wilt, he had just been sworn in two weeks ago, and as a result of that, we're told that his wounds had to have emergency brain surgery done he's in critical but stable

i want to bring in nbc's justice and intelligence correspondent, ken dilanian, gets hard to keep track suing him over this time >> chris, donald trump is claiming that michael cohen is guilty of breach of contact, breach of attorney/client privilege, unjust enrichment this is a 30 page complaint, he details all the nice things that michael cohen has said about him over the years, when michael cohen was faithfully representing him as his attorney and the whole saga of how michael cohen ended up turning on donald trump, and michael cohen is the key witness in the criminal case against mr. trump in new york, and this legal complaint has the feel of a press release. it reminds me a bit of the lawsuit that donald trump filed last year against hillary clinton, the democratic national committee and a host of other defendants over alleging that they engaged in the quote unquote russia conspiracy. that suit was essentially laughed out of a court a judge said it was completely unfounded. this one we'll have to see how it fares in the courts i've reached out to michael cohen's attorney, i haven't
