. >> it is ken doyle again. i have a question about what, having so many legislatures elected, what does that do to the legislature? has it changed the dynamics of the legislature itself? and if so in what way? >> i can speak to that based on what i understand. i have only served under public financing, so it is hard to get a full appreciation for how things have changed. i have a couple of anecdotes. connecticut like many states have a bottle deposit law. everyone time you purchase a bottle you return the bottle you get the nickel back, if you don't, what happens to that nickel? for years, due to a loophole in the way the law was constructed that nickel for the unredeemed bottles would stay in the beer distributor's pockets. it was supposed to go toward promoting recycling. they were very active in political campaigns and that loophole was not corrected. my first term in the legislature in 2009 was the first year the legislature was publicly financed. i can't point to a direct correlation, i believe it was two

i'm ken doyle. i wanted to ask if panelists agree that the decision in the case is likely to be another 5-4 decision as most of them are in this area. and with justice kennedy as the likely swing vote. is there any way to tell where justice kennedy will come down from the argument? >> justice scalia said we only need five votes. >> early in the argument, justice kennedy was testing the petitioner on hypotheticals that had to do with how mass is mass? and how direct is direct? and is -- one on one, that's okay. how about two on one. if there's three people in a room, does that count? and he ended up by saying, well, then, we're off to the races, aren't we? by which he meant we're going to get a, quite a pattern of -- i took heart from that and so did jim bob. i don't know what to tell from it. i think he -- i took it to mean that he recognized the great difficulty of having opinions kind of work out -- how about -- maybe not inside the courthouse on the steps, how far away from the courthouse does it

. >> hi, i'm ken doyle. the list of solutions that you have in are pretty wide ranging from specific, fairly specific things like amending the disclosure and coordination rules to something that's very ambitious like amending the constitution. do you have priorities or ones that you view is more achievable? do you think about achieving things in stages? or is there a road map to what you're trying to do? >> yes. i mean, i think the momentum that we've spoken about and the huge number of organizations that are working in this space mandates that we have a road map and a plan. certainly, you know, all of these solutions are necessary, and we think they need to happen in a row. we need disclosure to understand what's going on so we can advocate more effectively for public financing and for the amendment. each of those distinct campaigns. so, you know, we think we can win things on disclosure at the federal level. whether it's a new securities and exchange commission rule making or a strong irs rule making aroun
