melissa: let's bring in ken paxton as well. ken, do you agree that is one of the problems? when we see interviews with peep in the caravan, some say they're coming for asylum. a lot of people say they want to find a job. they're good people. they want to work. we have seven million open jobs. we don't seem to have a organized system in order to get people in here legally and efficiently. what do you think is the solution? >> i do, i think that is absolutely correct. solution is for congress to come up with a lawful way for the workers to come. it is clear, in my state, while we do want to prevent illegal immigration, we do need legal immigration because we are short on workers. there is all kinds of businesses in texas that could hire legal immigrants. we're certainly open to that in texas. melissa: james, why is it so hard to have that conversation at the same time? i mean it seems like it gets lost in the yelling that for people that don't want illegal immigration, they're not against legal immigration. if we could straighten out the system, we could get workers we need,

we're joined by texas attorney general ken paxton. good morning and thanks for coming on.eing told on these troops at the border and heading home? >> these troops were not sent there to detain or stop entry of illegals. they were went there for building barriers to entry and providing logistical support. my understanding is they've done a good portion of that and so after they finish it the point of them being down there is gone. >> sandra: when you say they've done a good portion of that. you talked about barriers. what more can you give us as far as details what the troops were able to accomplish during their time? >> my understanding is they've completed about 75% of what they were trying to complete in building barriers to entry such as concrete barriers, some of these fences that they put up. shipping containers. they've used various methods to stop illegal entry. i think they've completed about 3/4 of that job. >> sandra: according to the report some troops will begin leaving the area before the migrant caravan arrives at the border. does that sound right to you? >>

attorney general from great state of texas, ken paxton facing a tough re-election fight of his own. joining the show. >> great to be back. i think it's a great day in texas and i think things will go quite well today. charles: it is amazing. texas is becoming a litmus test for the entire country? is that true. as texas goes, so goes the rest of the nation? >> i do think that is true. you're seeing so much money in the state. if we lose texas it will be difficult to elect a republican for president. they're trying to put in millions of dollars to defeat our texas candidates. charles: texas you have a booming hispanic population. folks say they will out number white residents and even 2020 issue, we have the caravan which is approaching how does all of this play in the current day politics? how will it play in the future? >> republicans have done pretty well going back to george w. bush, governor perry, governor abbott has done well with hispanics. they share a lot of our values. they're hard-working. they're very faith oriented. i think a lot of those hispanics are voting republican.

at the same time, i was watching ken paxton saying the group that's arriving appears to be doing what the president asked, which is to present themselves at a port of entry and ask for asylum. that's fantastic progress. no? >> it is. there's a really important point here which is critics, as you said, were talking about the fact that they were so far away and not a big deal. even more than that, they were saying the whole thing was cooked up as some kind of election stunt. this is not a real issue. why is the president whipping up fear and hatred? well, because it's a real issue. there really are people crossing the border illegally, not just the caravan. it's a big issue. that's why it's encouraging to see consistency from what happened before the election after. >> senate republicans right now, we understand, mitch mcconnell is there somewhere. you see him there on the right. they are discussing the leadership elections. >> we have had divided government in the past and obviously republicans can work very well. we've demonstrated that i think in the last couple of years. we'll have

supported it and it doesn't seem to have been worthwhile, seems like a political loser, that was ken paxtonwe criticized him, you probably wrote the editorial, kate, no, it really did hurt them. >> it did, it's unfortunately it's not going to convince john roberts to strike down the affordable care act, he already went through so much struggle to find a way to uphold it and i don't see this changing outcome and what republicans really should be doing is spending the time in wilderness thinking of how they will solve if they get another shot. paul: republican incumbent lost race, wrote for us this week that john mccain killing repeal and replace was the real in -- in the senate was decisive vote and that got a lot of criticism, how can you criticize john mccain, what do you think of that? >> well, there's something to that, look, it's just the way it was, john mccain was proud of that vote and we should remember that he took it. he and susan collins and lisa murkowski of alaska, the republicans were on a knife edge close enough to get this through, it would have given them as kate said both

stuart: come on in texas attorney general ken paxton. mr., is this enough to slow the influx of asylum seekers? >> we'll see. i think it helps. the president has authority under federal law to do it. the u.s. supreme court upheld the authority with june related to the travel ban. they're using the exact same statute to stop entry of these migrants from the south. stuart: streeten me out, mr. attorney general. they're saying, you want to claim asylum, you have got to come through those specific portals. and if you don't, you try to walk across the border elsewhere, we'll literally keep you out. you won't get asylum. is it that simple? >> it's that simple. the statute gives the president the authority to restrict entry of any class of non-resident aliens that he wants to if he views it as detrimental to the country. the supreme court said he can set the conditions, how it is done, whether it is done, when it is done. it is up to the president to decide how he wants to do it. stuart: you're a border state obviously. do you approve of this? >> y
