texas attorney general ken paxton filed the lawsuit sighting and agree. mitt that requires homeland security to consult with the state before making changes to immigration policy. just hours after president biden was sworn into office, he put a pause on deportations for 100 days. this moratorium excludes people who've committed certain crimes and those who came to the u. s. after november 1st. joining us now to talk more about this is bill hang, professor of law and immigration studies at the university of san francisco. it's good to have you on today. t talk about all of this. i want to talk about the challenge from the state of texas in just a moment. but broadly speaking here, you know when you look at this pause on deportations, most of them at least right out of the gate from the biden administration. what what does this signal about how immigration policy is going to change under this new administration? well it's going to change radically because under the trump administration of immigrants were targeted for enforcement from day one. the muslim ban

of course, all of this stemmed from a lawsuit that was filed by the texas attorney general ken paxton. he's a close ally of president trump's who, of course, you'll remember seeing at white house in the last few days that he was in office and he filed this restraining order complaining about this violation from president biden that texas formed this agreement with the department of homeland security, that they had to be conultsulted on any changes or modifications on that policy and now this federal judge who we should note is a trump appointee has granted this temporary restraining order on president biden's order putting pause on deportations, so we're waiting to see what the ultimate outcome of this is going to be, but to be clear. this is a pretty significant roadblock to president biden's early agenda, his immigration initiatives that he took early on in just his first few days in office, and it does speak to this effort that you see that has been the last few days which is governing by executive order and how, of course, something like this can get in the way of that. >> that's

last night, maria spoke with texas attorney general, ken paxton, on why it's important to stop the effortse're going to have open borders. you're not going to get deported. it's an open invitation to come to our state and move ayou cross america. that's a great cost to texans in so many ways. we have health risks, we have covid issues, we don't know whether these people have covid. we have safety issues related to crime, human trafficking and drugs. and the cost to my citizens of education, healthcare, transportation, law enforcement, put on us with no help from the federal government. jackie: congressman, your thoughts on this and possible executive orders coming on friday? >> well, he's exactly right. we found here in texas that, for example, the wall does work and we want people to come to america. we want them to realize the american dream, the other side is proposing a scheme right now. to just reward people to come across and get in front of people that have been trying to do it the right way from a citizenship standpoint is just wrong. and we've got 10 million people looking for job

it had a rapid executive action and you already have attorney generals like ken paxton in texas tech, -- texas saying, i'm going to challenge them in court. what is this court going to do to all these affirmative policies that president biden has taken? there's already a suit in texas on the future of daca. the supreme court has shown time and again it rules against people of color, against women, against equality, against justice, and that anger is going to come back and it's going to come back with a vengeance. the question is whether this commission has adequately set the table so congress can react in order to reform the court as these decisions come down. >> do you by this prediction that the political momentum is going to gain speed and reinforce itself as a conservative court strikes down progressive executive action, or progressive legislation? or, do you see the court protecting itself? is this the fdr threat model that might incentivize more moderate rulings? how do you think it plays out in practice? >> it's something in between those two possibilities. i share chris's view

your state, your attorney general, ken paxton the, launching the first lawsuit against the biden administrationying to stop this moratorium on deportations. now, in -- we are hearing from attorney general paxton who says this, quote: our state defends the largest section of the southern border in the nation. failure to properly enforce the law will directly and immediately endanger our citizens and law enforcement personnel. what are your thoughts and what is your reaction? >> well, griff, thanks for having me. this is just one of a number of 30 executive actions that have been taken in the first week that have sought to weaken our country and our national security, and this is an example of an unfunded mandate that puts the pressure on the state of texas and other states that are really an assault on keeping our citizens safe whether it's human trafficking or the drugs. you know, we have a right to be safe, the federal government should be involved in that, and we're rolling back four years of policies that have been aimed at securing this country. griff: what is the impact of this moratorium?
