thanks. >> hello, my name is kendra, i'm with the mission sro collaborative. thanks for hearing me today. i'm here to speak in support of the ordinance. it's been a while in coming. i've been counseling tenants for about 6 years, first the san francisco tenants union, so mostly people living in apartments and now the sro collaborative so people living in sro's across the board. when i have gone to the rent board for hearings they will hear other issues but they just won't hear harassment issues at this point. you know, i worked in 2008 on proposition m and we were excited to get that passed to have something that tenants could go to when they had harassment issues. that was eaten quickly at first and slowly over time by the landlords and their attorneys at the courts. this is something i speak with tenants on a daily basis, when i speak to them in hotels a lot of them are scared to assert their rights. they see neighbors who have complained about building code violations, around mice, bedbugs and when they speak up they are yelled at, they are asked to leave.

tenant reps but also speakers from the apartment association and others so i wanted to first call up kendra brushman and ben from the mission sro collaborative. there are others too, i will call them as i have cards, charley goth from the apartment association, also victoria and stefan moor and also brian davis. >> i am a community organizor with the commission sro collaborate ive. the purpose is to improve livering conditions and fight for housing justice. through my work in sro hotels i've seen a variety of health issues that sro tenants face including secondhand smoke. when the opportunity came up for us to learn more about this, we took it. for about 6 months we surveyed 300 tenants who lived in sro's and apartments in all 11 districts to find out how much second hand smoke affected them and if they would be interested in a disclosure policy. we found 57 percent of tenants had neighbors who smoke in their units and of those people, 59 percent reported secondhand smoke drifts in their apartment. they reported having someone in their unit whose illness was made worse by secondhand smoke.

next speaker. >> good afternoon, supervisors, i am ben chafer, i work with kendra at the sro collaborative. when we were conducting the surveys in the summer and fall in 2011 we found the majority of people, overwhelmingly, 4 out of 5 were in favor of the disclosure policy and even confirmed smokers were in support of the policy because they were concerned about possibly contributing to go neighbors' health issues. basically the sense i got was they wanted it make informed choices to protect their rights as well as other people's rights in the arena of smoking. as a smoker personally i believe this policy is very important to the community because it would provide tenants both in the private apartment and the sro community to make informed decisions based on an important health issue. in conclusion we'd like you to pass the legislation both to mitigate concern and confusion city-wide about the smoking history of apartments and sro rooms, as well as making it fair and equitable to protect smokers who try to be just and fair about not smoking in places where the ordinance is in place. thank

name is ben schaefer, i work with the mission collaborative, i want to echo my coworkers' ben and kendra just cause. my partner and i who rent a room in the mission are living proof this process needs to be reformed and also the fact that when you are a tenant who has been continually harassed by your landlord and you are then in a mediation hearing with said landlord still being harassed in front of a mediation judge at the rent board, something has got to change. this is a particularly hot button issue for myself and for so many of us who work in housing justice because if somebody from the rent board can stand here in front of you and actually say that this issue has never been addressed or they have never heard anything regarding this issue, it makes me livid, absolutely livid. they should be well aware of this. supervisor olage has long been invested in this issue just like the rest of us who are also invested in it, and this ordinance needs to pass regardless of politicking about it, regardless of when it's presented, where it's presented, it needs to be passed. that's all i have t

currently, 1,823 members under kendra's law as it's known in new york state which is court ordered assisted out patient treatment. it's a judge, a doctor, you're a danger to yourself or others or repeatedly hospitalized or can't provide yourself with necessary life sustaining things. the court mandates that you stay on your treatment plan for period of time to ensure safety in the community. >> that is one solution. how much does that help in the scheme of things? would that stop another adam lanza? >> it's not going to stop adam lanza. not all of these instances happen after a long prolonged illness. a lot of the instances we've seen, these persons have lengthy mental health histories of violence. of repeated hospitalizations. it's a readily identifiable group. 44 state have laws, but none of them use them to the extent that they should to ensure that this doesn't happen. >> let me ask you this. there have been proposals and calls for a national database of mentally ill people. there have been other proposals for access to check mental health records when someone is purchasing guns and fir
