kevin strickland was factually innocent of this crime for which he had been convicted. they said the case never should have been brought. the lead prosecutor in that office in jackson county, missouri, came forward publicly and abjectly apologized. she said kevin strickland should be immediately freed. >> i'm here advocating for mr. strickland's freedom and his conviction should be vacated. most importantly, i'm advocating that this man must be freed immediately. my job is to protect the innocent, and often prosecutors show hubris, right. you have probably seen me show some of that from time to time, and today my job is to apologize. it is important to recognize when the system has made wrongs, and what we did in this case was wrong. so to mr. strickland, i am profoundly sorry. i am profoundly sorry for the harm that has come to you. >> since that remarkable public statement, prosecutor jane peters baker who you saw there, she has been trying to fix this. we interviewed her here on the show and she told us she would fight until this was fixed. s again, the republican governor in the state could easily fix this.ta he could pardon mr. strickland, commute his sentence

> getting back to that sensitive issue of black pastors in the courtroom, jesse jackson said he'll be here all week. kevin complaint now put in a formal motion that is to the judge. he's asking that everybody who goes into the public area of the courtroom be monitored and be noted. the judge has said he does not favor that but he hasn't officially ruled on this motion. so we'll have to wait and see. meanwhile, 250 pastors are expected to show up here on thursday to support the family of ahmaud arbery. victor and alisyn. >> martin savidge, thank you. >>> the reverend jesse jackson joins me now. thank you for your time. before we get to the arbery trial, this is our first conversation since you were hospitalized for covid. you suffered a fall. at howard university. how are you? >> i'm very well. you know, covid hit me and i was asymptomatic. i took my wife to the hospital and she ended up with covid because she had not had test of pre-existing condition. so, the doctor gave me a test and hit me i was positive. no symptoms. five days of negative, negative, they put me to the rehab, took me -- i couldn't walk

here's the exchange between kevin gough and the judge about the presence of jesse jackson. >> jesse jacksonivil rights movement. not just a witness to it, the personification of it. and in other circumstances i think everybody would be happy to have a their picture taken and get an autograph. in the context of this trial we object to his presence in the courtroom. >> i find that objectionable from the court's stand point. i have said over and over and over in this trial that i am attempting to ensure that in this courtroom that the defendants receive a fair trial and i will continue to do that. >> reporter: at one point, the attorney said something to the effect of how many black pastors does the arbery family have? reverend raphael warnock the senator from georgia be here next. the judge also described some of his comments about reprehensible. it's been going on now for a couple of days. the activists who support the arbery family said they're going to invite 100 black pastors to come here during the course of this week, and as you might imagine, arbery's family has been vehement that this

again, this defense attorney, kevin goff, who represents wil willia william bryan, asked for a mistrial because of reverend jesse jackson. the judge didn't grant it yesterday, he's not going to do it today. why are they doing this? is this essentially for an appeal or for people at home? what sense does this make? >> victor, it doesn't make a lot of sense to me at all. strategically i'm not seeing what's going on here. i spent about a decade as a federal criminal defense attorney and this is not the sort of move i would have been making. i think all of the attorneys for all three men are thinking about potential appeal. i don't think we're going to get an acquittal in this case. they are thinking ahead, and perhaps if there is something they can point to about media or bias somehow infiltrating the courtroom, perhaps, that's why he keeps raising this issue. but what i want to remind our viewers is trials are public. there is a sixth amendment right. it's connected to the defendant, but also the public at large, that courtrooms are meant to be for the people. and so this idea somehow that the defense should ask to exclud

so the defense attorney, kevin gough, is continuing his push to have the court keep a record of everyone attending the trial. yesterday he complained about reverend jesse jackson was bothered by reverend al sharpton. what is he trying to accomplish here because even the judge, you know, took him to task, saying, you know, what are you doing here? it looks like you have ulterior motives. >> yeah, don. this judge has been incredibly patient with this argument. i'm very surprised. i've been in front of this judge before. he's known as a patient judge, a fair judge. but this motion has absolutely no legal merit to it. you cannot prevent someone from coming into a public courtroom if they're not making a disruption. now, it would be different if reverend jackson came in there and decided to make a speech or interrupt the witnesses or call out somebody's name, but that's not happened at all. he simply sat with the family just like reverend sharpton, and they are absolutely allowed to do that. so the idea that the judge is going to bar black pastors from the courtroom, it's ridiculous. so i don't understand the point of making that motion, and of course it's going to
