kevin liptak is joining us from scranton, pennsylvania. what do we expect to hear from the president today? >> reporter: the message today is about unions. the president is "get out the vote event at a local union and scranton. he just landed in the last couple of seconds. at the end of the day, his presence on the campaign trail this year has been extra nearly limited for couple of reasons . there is the political imperatives on the part of the vice president to put distance between herself and the incumbent , who remains relatively unpopular. when you talk to democrats there is a concern that president biden could act as a liability on the campaign trail because of his penchant for going off message. is of his penchant for saying things that could open up harris to lines of attack from republicans. and certainly the concerns were born out this week when the president said the comment about supporters of former president trump . the verbal flub in today's headlines that the harris campaign -and the final stretch of the company didn't want

let's get to cnn's kevin liptak, who is in scranton. the message biden hopes to deliver to voters there? >> reporter: he wants to reinforce his credentials among union members and also try to talk with the credentials of his vice president kamala harris. trying to make the point he will be of better president for union workers than donald trump. you saw biden being introduced by the president of the carpenter's union . the science behind them, you see the harris/walz signs and you see the signs that say thank you joe. president biden , here in scranton in his hometown, basking in the support among the people he knows best. this is a constituency that democrats, at least in president biden's mind, hopes he can shore up support amongst. certainly, the white working-class voters he performed well amongst and 2020. president biden has not been a visible presence on the campaign trail this year. kamala harris tried to put some distance between herself and the current administration. president biden is relatively unpopular. they view presiden

joining us now is kevin liptak. what did the judge have to say?reporter: he essentially said that president biden overstepped his authority with his executive action that he did not have the power to do this and in his words he stretched legal interpretation past its breaking point. this is a sweeping action the president by the put into place after june after congress moved on comprehensive immigration reform. it is one of the biggest actions meant to help migrant families in years and what it would have done is protect from deportation, the undocumented spouses of american citizens who had been living in the united states continuously for 10 years. it would have also protected their children. it could have affected hundreds of thousands of people. it was challenged in court by texas and other republican held states who said this would strain state resources and potentially encourage more undocumented immigration into the united states . of course, this leaves hundreds of thousands of people in a great deal of uncertainty , that is layered on top
