but let's look at kim davis. hass is a person represented a lot of different people and the fundamental nature of marriage has been changed, that it had never been in the history of the or america or in the millennia of human history. that is a direct conflict. it is not some tangential, i prefer not to follow this law. it is a direct, absolute collision of two trains on the same track going in apps a direction. ae question now is, is there way to avoid this conflict? if there is not, there is not. in this case, there clearly is there there are a lot of options. rather than say kim davis just violates your cautious and work through the legislature, issuing an executive order. on the governor, help kim davis like you helped the attorney general just a year ago. the executive order. that could be a contemporary -- a temporary fix between now and january. when the general assembly comes back in the discussion because the governor will not call them into special session, but they have this temporary fix and come back

kim davis could have stayed out of jail. the judge told her she could go free if she gave her deputy clerks permission to issue licenses. davis consulted with her attorneys and refused. we get more now from cnn's alexandra field in ashland, kentucky. >> reporter: kim davis is refusing to issue licenses ever since the supreme court made a ruling earlier this summer making same-sex marriage part of the law of the land. davis was forced to appear in the court this summer where she was ordered by a judge to issue those marriage licenses. she has not complied. she is appealing the case. in the meantime, she refusing to issue licenses. brought back to the same federal courthouse in kentucky, the judge ruled she was in contempt of court. he ordered her remanded to the custody of the u.s. marshal. that surprised many in the courtroom expecting davis would be fined. judge said that would not be enough to compel her to follow his orders. while davis is now in jail, the judge called six of her deputy clerks to the stand. five of them ha
