kimberly what do you believe would be brought up on appeal?i believe that the defense had one mental health expert who was not permitted to testify. they had a hearing outside of the presence of the jury and the judge found out that he was not qualified to testify on an expert of what he wanted to testify about, and so that i expect that is something that would clearly have hurt the defense, and they had the burden of proof to prove that routh was insane. not the prosecution. but the prosecution had two mental health experts that were very credible and the defense had one. and so the jury would have said what could the defense only find one person who would only say that he thought that he was insane. so that is probably the number one thing that will be front and center of the appeal. you might also see the appeal on the basis that the jury was allowed to watch the oscars and offering some prejudice, and it is a point to be raised, but not a valid point, but another point to make. >> and richard, this is not a death penalty case, right? it is
