i was talking to kimberly guilfoyle about this. she was former prosecutor.od point and said she thinks it is unusual that a judge would give custody of the children back to the prime suspect in what may turn out to be a murder case. >> no, i will tell you why that is wrong. number one, in most states the fact that there may have been domestic violence between the father and the mother ising is to be considered but it is not an absolute that prevents the court from giving him custody. do i agree with it? absolutely not. i sat in court as the judge deciding these cases. until this guy until he has been called a prime suspect until he is actually arrested the courts in spite of the fact that the division of children and family services has said hey, judge, we don't want him to have custody doesn't really have a reason as this judge said to not allow the father to have custody versus a grand parent. >> here is the deal. let me play devil's advocate. if you are the judge you have to decide under the law what is in the best interests of the children. >> right. >>
