i have been working and discussing with the property owner of the kirkland heights about the possibility of creating an easement or some type of assess arrangement to doing to fifth avenue. obviously, there are a private landowner and we need their approval to assess their property. negotiations have been ongoing weigh haven't been able to reach an agreement. but at this point we haven't been able to come to an agreement. we would love to see this happen again, it's outside our ability to grant >> you show on your map does that easement continue down to the end of the street? >> they have the utility easement. >> the issue is it's owned by i believe u c s f by the city is not named on title for that utility easement it's outside my body of knowledge to know. it's along the lines to basically modify that easement to allow an additional overlay of pedestrian walkway >> in if the project gets approved wield you to pursue but i don't know how we can mandate that? >> we can eminent domain it and but some level of funding to do the project if the property owner below would agree to it. i don't

i also spoke with kirkland's brother, kyle.the one who had to go to the hospital and identify his brother's body. here's what he had to say. >> they had me identify him and i went back there and all i seen was tubes and blood everywhere. and after i identified him i ran out. and i couldn't -- i just lost everything. >> reporter: there were two survivors of this crash, 18-year-old brian henry and 15-year-old asher lewis. both -- one of the survivors, brian henry has told us and the police have told us that they got out by punching a hole -- elbowing a hole into the back windshield, swimming through that, out this swamp. they got up here, ran about a quarter mile to a house and called 9-1-1, suzanne. >> that is so sad. it's such a hard story i'm sure for that community when you think about six teenagers, the number of families impacted but also a whole community. you imagine they're all friends, they know each other, the the people who went to school with them and everybody is impacted by this. brian, thank you so much. we're goi

kirkland boehner calls him a hero. >> he can't come through, can't come home, mom, what's for dinner, what did you cook, mom, i'm not going to here none of it any more. >> reporter: police say there was seat belt usage but aren't saying anything beyond that. you have to remember the vehicle was carrying eight people. it can only accommodate five. so there were only five seat belts to use. >> who owns the car, did the owner know they had this vehicle? >> reporter: it is owned by a gentleman named marquise stephenson who lives in youngstown, ohio. police say none of the occupants, neither the driver nor anybody else, had express permission from the owner to be in that vehicle. i asked the police if anybody was any relation to mr. stephenson, they said they were not. that's all they're saying at this point. so it does not appear that he gave permission for anybody in the vehicle to actually have the vehicle at the time of the accident. we tried to call mr. stephenson, weren't able to reach him. >> what a heart breaking tragedy. brian, thank you very much. >>> just ahead, would americans
