pao is suing kleiner perkins for sex discrimination. the jury reading the verdict in the courtroom in san francisco right this very minute. there are no cameras in the courtroom, but we have a producer inside who will be able to tell us the verdict on the four counts as soon as we can report them from the courtroom. with us now two legal experts fox news legal analyst lis wiehl and mark conkel. jury deliberating 2 1/2 days. short period of time to me. what does that mean? >> usually good for the plaintiff. also in california, you don't have to have the unanimous decision, 9 out of 12 for the plaintiff or the defendant. so it's much easier than a criminal case. david: . gerri: mark to you, she originally sued for 16 million dollars, but the judge said no no no kleiner perkins may have to cough up far far more what are the numbers? >> 16 million in damages and 144 in punitive damages. so it's a really significant number. >> and punitive means that the company went above and beyond to be horrible to this woman. gerri: and some of the facts

pao's gender a substantial motivation for kleiner perkins not to promote her for at kleiner perkins, and was that the case? not necessarily, but if they say they could have found later on that it did not matter and she would not have been promoted, then the firm is exonerated, but even still, the firm is not off of the hook, because then did the firm retaliate against her when she raised claims of sexism, and then they have to determine how much she lost in past earnings, and future earnings, and if she can go on the collect future earnings, and we will see what happened, because we are waiting for the jur ri to arrive in the courtroom. they have had the case for 48 hours almost exactly, because they got it in the middle of the day pacific time wednesday, and came back with the verdict at lunchtime today. had asked a lot of questions about the issue of retaliation, and the performance reviews that the ellen p.o.w. was given, and she claimed that they were trumped up, and meant to retaliate, and that she had been fined. the company says that she was a poor performer, and not cut out t

ellen pao is suing kleiner perkins for gender discrimination.he claims the firm refused to promote her when she worked there because she is a woman. kleiner perkins contends powell did not have the right skills to move up the ladder. the case is happening at a time when the tech industry is facing more scrutiny for its lack of diversity. liz gaines, a reporter for recode, has been in the courtroom all week and joins us now. hi, liz. >> hi. >>. >> this seems like a tantalizing novelful sex point, and power. what are the revelation that's came out in court this week? >> yeah, we've just been waiting for the drugs and rock and roll to come out. no, the biggest revelation was for people who have been following the case was a new witness, and that was trey vasolo, a former kleiner perkins partner who testified she was also harassed by a former partner as well named ajit nasre who is the same person that ellen pao says pressured her into having an affair. and another thing that's really been at issue and i think will continue to be an issue in this mo

it is a generally victory for kleiner perkins, but not enti entirely, and the potential is that if she lost her job for this filing a suit, and doing what she is legally entitled to do, and they could be on the hook for substantial damages. >> and it is not a cause, but the equality and the jend ser not a cause, but it is good for all workplaces. the issue is that she did not prove that because she is a woman she did not succeed at kleiner perkins, and that said, this is an ongoing issue with the venture capital industry, and through lots of industries, and the question is will the venture capital firms shy away from promoting women now, or are they saying, we have a problem, and we need to get the gender gap under control and the same with the racial gaps, and everything else. the discussion has been the most important part of it. and everyone does agree that we need to address the issue, and regardless of whatever the verdict happens to be. >> and we want to bring in david sanford who has been a lawyer on the case -- >> no, this is julia here. >> and you are with us, david sanford? >

the question from kleiner perkins side. they say she was motivated by money. ere's a point to how much money she's looking for. here's the quote, the attorney says for kleiner, when you said to mr. keller that you wanted eight figures as a settlement. is it your testimony that you wanted eight figures to punish kleiner perkins. and then ellen said, i wanted kleiner perkins to have some kind of accountability for their lack of action in these different events when they should have taken action and did nothing. action because she was leaving. asked to leave. ellen in the end said she could have been so huge. partners at kleiner perkins are worth hundreds of millions of dollars. does she stand a chance to say this is money i would have made? >> i think so. well, i mean, that's certainly something that's being contested in the courtroom. there was also in terms of financial motivation, a different wrinkle where the kleiner attorneys asked the judge to reverse his ruling where he had said that we -- the suit would not allow consideration for her husband's financial

we are looking at the ellen pao versus kleiner perkins case.he jury came back just a little while ago. they had verdicts on all four counts -- when the judge went through in the fourth verdict, he found a couple of the jurors did not agree with the majority of the jurors and so they have been sent back into the jury room to deliberate further here on a friday afternoon. nearby on a friday afternoon, sarah frier, one of my colleagues -- sarah, want to know what you think. sarah: what i have been doing since the verdict was -- is talking to people in silicon valley, tracking the reaction to this case. generally what we're hearing is that people feel that in some ways, kleiner has lost no matter what because they stood out there in court and try to make a woman who felt wronged show that she was not to be believed, it was very important to them and they spent days trying to prove it. a lot of women in silicon valley are tweeting this has happened to me and i know it's true. whether or not this happened to ellen pao we trust the american judicial s

also, kleiner perkins got lucky in that in some ways ellen was not an aesthetic plaintiff, but if shen a different kind of plaintiff, if this had been a different kind of a job, for example a job where there were more clear-cut requirements, this could have gone very differently, and remember that the court ruled that kleiner perkins is potentially on the hook for over 140 million dollars of punitive damages. now they have dodged the bullet, but going forward, i think practices will be very, very different, both in venture capital and in tech more generally. cory: so we have all heard about this case, and the jurors were kind enough to speak of, and i want you to your but one of the jurors had they are after. check this out. juror: when you see comparable or similar feedback, meaning areas they need to improve in yes one gets promoted and is fast tracked, and the other is held back in a particular role then to me, it validated the claim as being discriminated against on the basis of gender. gender: it probably had more to do with her sales ability and her ability to get along with peo

and three, kleiner perkins did nothing to prevent the discrimination. ellen pao's attorney, alan exelrod exelrod, began by telling the jury kleiner perkins ran the firm like a boys' club, that men were judged by one standard women by another. he pointed to a 2006 performance review by the managing partner stating "ellen has been un unrelenting and tenacious." in 2007, when she was thinking of leaving the firm he testified "i wanted her to stay" and when she wanted to invest in twitter, she was told it would never be a business. they made mention of an affair she had with a fellow partner, saying the defense was trying to smear pao with the details of that sexual liaison. he said the conflicts between p pao and other women in the office were short-lived and kleiner perkins were raising them as a distraction. following the break, it was defense attorney lynne hermle's turn, who was louder and punchier in her portrayal of pao. she pointed out no other woman in the firm wanted to join ellen's lawsuit and when pao understood she wasn't going to advance, she

we will keep you posted on the kleiner perkins trial. finally a huge move in the tech world.n stanley's cfo routh porat announcing she's taking a job at google. porat does have a lot of experience in the valley, led financing rounds on companies including amazon, ebay and net scape, the head of technology investment banking from 1996 to 2000 at morgan stanley. certainly a very important time for the tech industry. she will start at google on may 26th reporting directly to ceo larry paige. we were talking about the culture of women in silicon valley. google has admittedly been trying to increase the number of women in its leadership ranks. >> it has. >> now poached arguably the most powerful woman on wall street. >> with sheryl sandberg she will be the most powerful woman? silicon valley. m marisa mayor a notch below that. she has experience in washington, mentioned as someone involved in the u.s. treasury, turned that down. experience on wall street, experience in silicon valley. the most interesting thing about routh porat i will say is perhaps not her gender it is her age.

made this ruling he said there sufficient evidence from which a reasonable juror could conclude kleiner perkinsaged in gender discrimination and acted with malice, fraud or oppression. this has really raised the stakes for the firm. cory: i wonder -- does this explain why kleiner went to trial with this instead of just writing a check? they have loads of not just investors money but the partnership itself has a lot of money. >> you have to assume they feel confident they are going to win the case where there would not be a trial. ellen powell herself would not have settled, so they are forced to go to trial. they have 17 witnesses that went in and pointed to key points in her testimony, including the fact that women were left out of events and had high profile clients who said that wasn't the case. the defense has done a good job pulling a pallet -- pulling apart powell's testimony, so you will see both sides some of their strongest point. ellen pao will go in and her lawyers will say this is a firm that has not been good to women. they are going to talk about other instances where they felt el

so has beth seidenberg another partner at kleiner perkins. the bigger question is, was there a system in place in kleiner where women were judged differently than men. >> one of the takeaways, kleiner didn't handle some of the harassment issues well. that doesn't seem to be in much dispute. >> yeah. >> had some issues with harassment as did ellen pao. i mean what is the takeaway for the venture capital industry in silicon valley after this very embarrassing case for pretty much everybody end vofld? >> remember this is a gender discrimination case and a retaliation case not a harassment. that's hanging over this whole thing is this one particular partner who behaved badly. i think that it's an interesting question. they don't handle it well. there are partnerships and partnerships are not always known for, you know -- it's not a company, you know, which has much clear hr policies in place. they didn't react as well. they didn't have an hr person. there's all sorts of questions where the policies were and who had them and the confusion around i

possibly final day in court at a as she is suing her former employer kleiner perkins. based in menlo park. it's been a grueling week of cross-examination by her former employer. she has been portrayed as argumentative and incompetent. she has told stories of stories of and frat boy like behavior and says she was os stra sized from the company after ending an affair with a senior management employee. in venture capitalism women are 4% of the industry and she picked the $16 million award sunday to send a mess an to the company that fixing the -- message to the company that fixing the problem is better than avoiding it. court starts at 9 a.m. it should last until the end of the month. >> kiet, the judge gave pao an important victory yesterday sparing her embarrassment about her personal finances, right? >> reporter: so the judge said that the, um, issues of her own personal finances do not matter at this point, it should be pointed out that it's been widely reported that her husband filed for bankruptcy right at about the same time she filed this sexual discrimination law

pao had testified that she was bringing her case against kleiner perkins because she wanted to expose gender discrimination within the firm. kleiner wanted the jury to hear the motive might have been financial gain. but the judge stood by his pretrial decision to exclude the couple's financial information, saying it could prejudice the jury. instead they grilled pao about why pao never asked to see the hr policies regarding discrimination and retaliation. pao said it was because she was told the company didn't have a written policy and that was backed up by a witness for kleiner perkins. eric keller testified that he had to get the policy drawn up in 2012 seven years after allenellen pao began working at the firm and around the same type she made her kplangtcomplaint. the company agreed to continue paying her for six months plus benefits and keep her on the books as an employee to help her finding another job. that agreement blew up when pao publicly announced that she had been fired and began telling it to the ceos of kleiner's partnering companies. pao still got her $33,000 a month

this afternoon a jury ruled that venture capital firm kleiner perkins did not discriminate against ellen pao had sued the firm claiming it did not promote her because of her gender. the case has focused attention on the lack of diversity in the tech industry. joining me now to discuss the verdict's impact is fran meyer, the founder of match.com and trustee. fran meyer thanks for joining us. >> thanks so much for having me. >> first of all the obvious question. what's your reaction to this verdict? >> somewhat surprised although i think everybody knew that discrimination cases like this could be complex and ellen was complex herself. but i think disappointed. >> as a woman or as someone in the tech industry? why were you disappointed? >> from my point of view as a woman. i think it took a lot of courage to bring this case. i think it exposed a lot of issues that have been somewhat endemic not just to venture capital but with technology firms. and most women i know were really watching this because it was sort of our time in court. that being said, this has had the benefit of making us all

that's how one of silicon valley's venture capital firms says she felt while working at kleiner perkins. the firm being roasted by ellen pooh on the stand today. he' recounting how she was treated after reporting sexual harassment. mark matthews joins us from san francisco where that trial is underway. >> reporter: ellen pao began telling her side of the story and she ended this afternoon in describing a trip to new york in which kleiner perkins partners on the airplane discussed porn movies and victoria secret. she said she felt frozer by the behave of the partners on that flight to new york. and she did not know how to respond when the senior partner told her to take notes. she holds a law degree from harvard, an electrical engineer degree from princeton and she was hired to be chief of staff to the company's leader. she began this morning talking about the so-called loosey goosey way that the call chur venture firm handled her reports of sexual harassment. in 2007 a senior partner gave her a book of erotic poetry for value, tine's day then invited her out to dinner mentioning his wif

sue decker saying, yes, she encountered multiple over time and congratulated pao. >> while kleiner perkinsay have as a firm won this trial fair and square, the jury clearly sided with kleiner here. the anecdotes, the damage is done there. the fact that now you have a lot of lawsuits against publicly traded company, class action lawsuit against twitter right now that could at some point in a year or years to come go to trial. those companies are going to want to make sure that this never gets to trial. if there are anecdotes, that could do damage in and of itself to the way investors and employees feel about the culture or the company of a partnership. fortunate wrote that the lasting and beneficial impact is a lot of workplace males across the country are quietly reassessing their own past conduct praying that sleeping dogs are left to lie. >> also for the industry as a whole, so many facts about the industry came out. i was shocked to read of a substitutstudy that only 6% of venture capital companies are female now. a fortunate story saying only 4% of senior people are women. these are fa

>> at the beginning i see kleiner perkins getting the spotlight. only 6% of v.c.ers are women so that's poor. v.c.s have a big impact on all start-up companies. they sit on their boards. they advise the c.e.o.s. they obviously provide the capital for growth. in many ways, a lot of tech companies take their cues from what they see in the v.c. world. >> sreenivasan: one of the ideas the technology industry or silicon valley is able to portray is this is not like the old boys' club, that your ideas matter and this is where you get ahead. seems like this case uncovered that a little. >> it's one of the important things is is it has shown it's very much about who you know, who you want to work with who likes you. that's why it perpetuates this image. american in silicon valley says hey, we're great, we're going to change the world. that fast-growing companies will get a path or trying to do the things they will be doing. >> even though ellen pao lost, does this end up elevating the conversation in a way? >> i think it's part to elevate the conversation. but women need

the jury found that kleiner perkins did not district against ellen pao. melissa chan reports. >> yes randall. part of the reason why is the track record, when it comes in front of a jury often there's very little sympathy for the female plaintiff so ellen pao must have felt particularly aggrieved to pursue this lawsuit so far. >>> ellen pao believed it was because she was a woman that she never got an a promotion. evidence of male colleagues who underperformed but still received promotions but she did not. >> i'm grateful for my legally teamlegalteam reaching out for support in many different ways and for telling me my story is their story too and their gratefulness for me telling their story. >> but the jury did not buy it. handing the court a sweeping victory. >> she was very driven. you can tell by the e-mails the times they were coming out the consistency of the e-mails she was probably someone who wouldn't take no for an answer. >> only two jurors had sympathy for pao. >> not disappointed because i think the 12 of us did the best job that we could. >
