senator klobuchar: thank you. thank you, all of you. you describe watergate as the greatest constitutional crisis in american history since the civil war. when we discussed the history of watergate, i think the most concerning part for many americans is the concept of government officials believing they were above the law. not accountable for unlawful activity. what set watergate apart from other abuses of presidential power? >> i would say two elements. first, the sheer magnitude of what the nixon administration had done, including burglary of a defendant, daniel ellsburg, in a criminal case. mr. posner: there had been dirty tricks by various sorts in the past by presidential campaigns but the nixon campaign was significantly worse. and then second of all, the obstruction of justice which .as outrageous, pervasive it's hard to -- it's hard to exaggerate how significant that was. other presidents may have hesitated by appointing special counsels in particular cases. as i mingesed truman fired a special -- as i men

klobuchar: thank you. center gu senator: thank you for being before us. i have a broad question, but i will give a specific introduction about right to counsel. judge rae, as a state court judge, you have done some interesting things recognizing the torrents of adequate funding and the utilization of diversion programs. in a 2013 case, a class of fathers was held in contempt of court and sent to prison for violating child support orders. they were not given counsel at the hearing. you found they were not denied counsel because they never asked for counsel. many defendants don't know when they have a right to counsel. the georgia supreme court recognized that when they determined a failure to ask for counsel does not decide the claim. broadly, what steps will you take to ensure that parties that appear before you, especially indigent parties, are afforded access to counsel and that we are careful in making sure that we do everything we can to ensure that parties appearing in front of a judge are effectively represented? the deal case that you mentioned, i

maybe that will make a difference of what we hear from both sides with graham and cassidy and amy klobuchar and sanders on the other, but you look at this, this is a passionate issue and i think republicans haven't necessarily tapped into how people take this so personally because it is about their health. their selling of this had to do with block grants and giving power to the governors in talking to people about their healthcare and the health care industry. i've rarely heard people say i really wish that my governor could handle health care. they usually compare about prices and accessibility in premium increases and so far from what we've seen on this bill there isn't indication that it addresses the real problems that a layoff people have. >> and we're seeing this play out on capitol hill. protests playing out with the hearing that has put on on recess ask they want to wake, and the latest gop health care bill. i want to bring in gloria borger. it's clear, because over the weekend the nfl criticized players for not standing during the national anthem than he did about this health care

senator klobuchar along with several democratic colleagues followed up on this plan by proposing legislation to enact some of these policies into law. although i don't agree with all their proposed solutions, i do agree with my colleagues from across the aisle that antitrust enforcement should be a priority. the best way to ensure that antitrust laws are being properly prioritized is to make sure that our antitrust agencies are fully staffed and that they have leaders in place, leaders who have the requisite expertise and ability, leaders who have broad bipartisan support from sitting senators, practitioners and former agency leaders who know the position and the exacting demands required by the position, leaders who fit the description of making delrahim -- of makan delrahim. given his broad support, these impeccable qualifications and the importance of this position, there is not a good reason to delay this confirmation. quite to the contrary, mr. president, this is an issue that is neither republican nor democratic. it is a position that is neither liberal nor conservative. this position

but as senators sanders and senator klobuchar, an excellent job last night in the debate on cnn, made clear, democrats have a lot of ideas of how to improve health care. there's not just one. there are many. and many democrats support a whole bunch of different ideas. each of our ideas, however, endeavors to increase coverage, improve the quality of care and lower the cost of care. none -- none of the republican plans achieve these goals. that's the difference. the difference is one side wants to cut health care to average americans, increase premiums, give the insurance companies far more freedom, and one side wants to increase care, the number of people covered, lower premiums, better coverage. that's the divide. now, our colleagues can't stand -- won't debate that issue. they believe it. they believe, let the market have more to say. we've learned that left alone, the poor little consumer against the big market gets crushed in health care because there are infirmities, it doesn't work like a regular market for a whole lot of reasons. we're happy to have a debate. does graham-cassid
