we have a future of 1375 koor lating to 1376 and we're starting to come up against resistance. very interesting that we're coming up the resistance on the s&p 500 and it has outperformed oil. it's similar to the pattern that we saw last november. down here it's something that has to give and it will be interesting to watch for the rest of the day because we're only five handles away from the s&p 500 big resistance level as they start to come out at that level. >> interesting. along with the vix lower since july and a lot of people talking about if you can contain it at that level or somewhere close to it, you're in a vix sweet spot, where it was in august 2010 and into february of 2011 right before the spring rally this time last year. how likely is that? >> well, again, since it correlates directly to the s&p 500, we have to get to this level on the future in order for us to get down there. i think the reason it was up, even though the s&p was up slightly and one of the reasons that you may see the vix for a little while is get the confidence that you can get through this resi

studies found that since the state kicked hybrids out of the koor pool lane, traffic increased for all of us. >> our investigator, he lease kir much ner has been taking a closer look. here's a preview of what she found. >> you're increasing the flow for everyone. >> his research revealed what many of us fear. we're spending more time fighting traffic. >> the idea was that by having fewer cars now in the carpool lane, the carpool lane would travel faster. it seems that hope has kind of backfired. >> one nearly 85,000 hybrid cars were kicked out of the carpool lane last summer, ending a program that began in 2005 to give consumers an extra incentive to buy low emission cars, a uc berkeley civil engineering professor studied the impact. he showed his report to engineers at cal trans and says they didn't care. >> cal trans is an agency that made a decision and they're not terribly eager to hear inconvenient facts. >> now, tonight on nbc bay area news at 11, you'll hear how cal trans responded to the accusations. in the meantime, if you have a tip or comment for the investigative unit. call

how does this koor late to the increased risk of these problems? >> well, to explain that, the patients had more health problems before they took sleeping pills and after. now, there was nor increase in the patients who took sleeping pills but it's hard to interpret whether it's the sleeping pills that were associated with those increases in other health risks. so we're not very persuaded that the sleeping pills caused those increases. we're not sure of that. >> and when you think about the sleeping pills being related to this early death, i mean, is there a direct cause and effect? were you able to establish that? >> no. our study is a study of association. the sleeping pills are associated with much higher deaths. you could argue that that doesn't prove that sleeping pills are causing the deaths and it's true. it doesn't prove it. it's just, we can't find any other explanation. it's the same situation with cigarettes where there was no proof but cigarettes are associated with cancer. >> we do want to point out that the drugs that you studied are
