kpix 5's linda yee uncovered the list of water hogs. linda. >> reporter: yeah, i have to tell you, ken, there were some awkward moments when we did confront some of those water hogs. out here in dublin and san ramon, their water districts saying to them, everybody has to cut back their water use by 25% or face big fines even possibly water restrictions. lush lawns and gardens come with a price. drought conditions mean no watering or face fines of up to $500. through the public records act, kpix 5 got the list of 82 homeowners and businesses in the dublin-san ramon services district who ignored their first warning and now have to pay up. they include toyota dublin who got caught overwatering the landscaping. >> yeah. we were surprised when we got the notice. we realize there's a drought now. but we, uhm, followed the guidelines now. >> reporter: the bright horizons daycare center said they had a broken pipe and they have since fixed it. dozens of private homes like this one in san ramon were also fined for using more than their 640 gallo

kpix 5's linda yee is live in san jose where the search continues for a second suspect. linda. >> reporter: well, liz, police say that they are continuing to talk to the one suspect that they have arrested but people here say they are used to the minor crimes, the car break- ins. this one was a particularly brutal home invasion. and they have been affected by this so much that it sent chills to everyone involved. not only the neighbors but the police investigating. investigators spent most of the morning looking for evidence. they say the suspect, possibly armed with knives, broke into the elderly couple's house before 4 a.m. >> now, what the victims explained to the officers, uhm, they were, uhm, forced to the back of the house, uhm, at some point, uhm, the 85-year-old female was sexually assaulted. >> reporter: her husband was not hurt. neighbors wonder how anyone could do this to an elderly couple. >> disgusting. i think it's tragic, horrible. i don't know, it's just, uhm, when i heard about it this morning, uhm, felt sick to my stomach. >> reporter: police say the su

mark kelly, kpix 5. >>> 5:05. the man accused of starting a northern california wildfire is facing new more serious charges this morning. 37-year-old freddie smoke iii from sacramento is being charged with involuntary manslaughter. a man's body was found in the fire zone earlier this month. smoke was arrested earlier for marijuana cultivation and accidentally starting the bully fire. investigators think exhaust from the rental truck started the fire. it burned about 20 square miles southwest of redding. >>> new this morning, the east bay municipal utility district, east bay m.u.d. and six cities have agreed to pay $1.5 million in fines to settle allegations that they allowed raw or partially treated sewage to flow into the bay. the environmental protection agency filed suit over the issue five years ago. east bay m.u.d. and the cities of alameda, albany, berkeley, emeryville, oakland and piedmont agreed to invest $1.5 million over the next 21 years to upgrade their aging sewer systems. >>> students at bryman colle

kpix 5's ken bastida in the newsroom. and, ken, this is the third aviation incident in a week! >> reporter: boy, general aviation really suffering as you mentioned in the past week, allen. in this particular case, the trouble came just about an hour after take-off. the passenger jet was apparently headed through some very rough weather. it was flying from burkina faso to algeria's capital in north africa when it disappeared from radar. the plane sent a radio message asking to change course because of a severe rainstorms up ahead. the pilots diverted from their planned route and that is when controllers lost contact with the airliner. the 116 people on board, 50 were french citizens, 26 were from burkina faso. >> there was discussion of poor weather in the area, but clearly lots of aircraft managed to fly successfully through poor weather. >> the wreckage was missing for several hours before officials finally announced the news to the public. there has been unrest in parts of mali in recent years, but senior french officials say it is unlikely the fighters there have weapons pow

kpix 5's anne makovec is near the firelines. she is up in napa county this morning has the very latest. anne? >> reporter: i'm here on butts canyon road. you can see some of the embers, some of the little spot fires breaking out here behind me and that's one of the real challenges firefighters have been dealing with. you can see random little fires along the mountain roads on either side. those are those little fires that can suddenly spark up and then join up and that is what they have been dealing with as far as the extending lines of this fire this morning. so far 180 homes have been evacuated, 2700 acres burned. it started yesterday afternoon in pope valley as frank mentioned at around noon and quickly exploded into this massive wildfire. it's jumped several road and burned five buildings including one home. it is burning in both napa and lake counties and from its behavior so far it is proving very dangerous. >> we're seeing fires burn with intensity we would typically see later into the year. you add weather conditions, ho

kpix 5. >>> new at 5:00, the ath penalty on life support. a federal judge strikes down california's execution system calling it cruel and unusual punishment. the judge said the system is plagued by long delays and violates the constitution. kpix 5's ryan takeo live at san quentin with what's next for the hundreds of inmates on death row. >> reporter: it means a longer wait. they're used to that here. all 748 murderers here on death row in san quentin, they have been on a wait list that is about two decades long, plus. >> i think it's another nail in the coffin, the death penalty system. it's the first time ever in the u.s. that a court has ruled that any state death penalty is unconstitutional because it's so dysfunctional. >> reporter: the federal judge was looking into a southern california case but made a sweeping ruling on the whole system. he called california's death penalty beyond repair saying death sentences are more like life in prison with the remote possibility of death. he noted the long wait time at least 25 years as appeals wo

kpix 5's ryan takeo is live for us right now. ryan, firefighters say that they are getting a handle on it but things keep flaring up. >> reporter: that's right, veronica. in the last 10 minutes we saw that plume of smoke really get a lot darker. we get the sense that the wind around here has been swirling in the area and that provides some issues for firefighters. again, that just happening in the last 10 minutes. we will keep an eye on it. helicopter crews are trying to douse it with water. there was a bit of good news today. we were there at the red cross shelter in middletown right after evacuees heard they were able to go home. they are so glad. they have been worries for two days, sleeping in cots, some sleeping outside so they could be with their pets. now, we wondered how did firefighters get control of this fire? one way was through a controlled burn. and several controlled burns to make sure the fire did not have fuel. >> we fight fire with fire as well as hand tools as well as bulldozers as well as aircraft. we use ever
