let's talk about our top story on kpix 5. a three-month-old baby swiped from a san jose home, now found safe and three people are in custody to answer for it. kpix 5's kenny choi is live with the end to a frantic search. i imagine a lot of people are breathing a sigh of relief. >> reporter: that's for sure. police say there is a connection between the three suspects in custody right now and the baby and the baby's family, but the exact relationship is unknown and no official motive has been released by authorities. witnesses say that police this morning swarmed a small, multiunit apartment complex near the 2300 block of nadler drive in san jose. a person working at a skilled nursing facility across the street says one of his employees recognized the vehicle. authorities had notified the public about it and he called in a tip. authorities took one man away from the scene. several members of the gang unit were also here this morning. law enforcement officials say baby brandon was found in the apartment, unharmed. neighbors saw

kpix is live in sacramento with more on what we're learning about those suspects. max? >> reporter: good evening. we're learning the two brothers are facing charges that range from possession of a machine gun to assault with a firearm and prohibitive possession of a firearm. these are the two brothers. the first suspect arrested, 26- year-old dandrae martin. the second suspect, his older brother, 27-year-old smiley martin. both of these suspects do have a criminal history. smiley martin was injured in the shooting. he is being guard inned the hospital. once he is released, he is expected to be charged with possession of a machine gun and potentially other charges as well. the police say martin was spot and a facebook life video with a handgun hours before the shooting. now, this time it is not clear whether that exact weapon was used in the shooting, but we do know smiley martin scored an early release from prison just last fall. he was serving a 10-year sentence for domestic violence and assault. the sacramento district attorney tried to block his release from prison b
