in san jose, len ramirez, kpix 5. >>> workers in the east bay are fighting to save their jobs. independent truckers tried blocking traffic at the port of oakland to make their point. the conflict is over a new law that requires truckers to be employees of a trucking company instead of independent operators. what would shut out all the truckers who own their own rigs. the truckers on the protest line say they shouldn't be forced out of their lifestyle while local union leaders say it could give the truckers more ride. >> the greedy trucking companies are denying drivers the basic human right of forming a union if they want to by miss classifying them as non-employees. that's not right. every work arer, every driver deserves to have a union and all the benefits that come with that. >> an owner operator becomes an owner operator because they want to be their own boss. >> the independent trucker says if the law takes effect it could increase supply chain issues. >>> covid cases are rising once again fueled by what's considered the most transmissible variant of the pandemic. accordi

. >> kpix's don lynn live on the scene with the latest. >> we understand there was a birth-day partyened at the same time of the shooting. was it related to what happened? >> reporter: not relateed, juliet and brian. police are still inside. they're inside searching and gathering evidence as we speak. they're also looking at surveillance footage. witnesses tell me there were at least two birthday parties taking place when the shooting broke out. one girl just turned 8 and another young lady who turned 21. >> i was by the vending machine and then -- so i just heard five gunshots and like i ran out. and then from there my 'causin came out running too and she told me, she was like there was one person that died immediately and one guy hit on the chest and the back. and that guy was my uncle. >> your uncle was shot? >> yeah. >> in the chest. >> yeah. >> reporter: this teenager asked us to blur his face, fearing for his safety. police say his uncle is one of the injured victims. investigators say the shooting killed a 28-year-old man and injured two other adults also in their 20s. police

kpix 5's anne makovec joins us with more on the tech saga with big financial consequences. this could get really ugly. >> and it's going to be a trial that could force musk to buy twitter is now set for october. the judge said a delay threatens irreparable harm against twitter. musk pledged to buy it earlier this year for $44 billion, but now he wants to back out. he claims the company has failed to provide enough info about the number of fake or spam bot accounts, and that twitter breeched its obligations by firing top managers and laying off employees. twitter argues that musk has operated in bad faith and is deliberately trying to tank the deal because it no longer serves his interests. i talked with cnet about what it could mean for twitter to have a leader who doesn't even want to be there. >> a lot of people don't have the warmest feelings about him. so it doesn't look like he had kind of a clear idea what of what he wanted to do it and how he was going to do it. yeah, there is that other side of it where do you really want somebody like elon leading the company. >> b

kpix 5 has documented the complaints from these truck drivers. they're fighting a new law that requires them to be employees of the trucking companies they do business with. as kpix 5's john ramos reports, they tried to fight the bill in court. that didn't work, so now they're taking it to the streets. >> reporter: we've been telling you how ab-5 will impact the trucking industry. today the drivers showed up to demonstrate how it might affect consumers as well. it was not business as usual at the port of oakland this morning. the independent truck drivers who make up 90% of the operation are on strike over ab 5. the new law requires trucking companies make their drivers employees shutting out the independent operators who own their own rigs. protesters blocked other trucks from entering the port as a way to get lawmakers' attention. >> if the port got affected, the government will listen and they will have to. that's what we're actually doing. we'll continue until we get it. >> reporter: trucks lined up down the streets as police made a deal with
