i'm eric thomas. >>> and i'm kristen sze.ollege student in his car on his way to class gunned down and kill. now richmond police are trying to find a killer who they say was on a shooting rampage intending to take out a different target. amy hollyfield is live with the latest. >> reporter: we know the name of the victim he's 22-year-old edwin martinez. he lived in richmond, headed to class at contra costa college with his sister when was shot. police don't have much to go on. they don't have a suspect description. just a man ran from the scene. the victim was a passenger in the car his sister was driving. they had just pulled up and parked along side the curb in the 2100 block of nevin avenue. it appears the killer was after someone else, the man was running after a fleeing vehicle. he was shooting at it. then he gave up. he turned and he saw the car with the brother and sister sitting inside and fired into it. the sister raced off trying to escape, she was okay. it was too late for her brother, he died at the scene, suffered

i'm kristen sze. staggering new totals out of oakland we are learning more about the cost of damage number of arrests after occupy protesters clashed with police and vandalized city hall over the weekend. amy hollyfield is live at if plaza. the mayor has a new plan to deal with protesters? >> reporter: yeah, one involves what you see behind me. check out the graffiti left behind here at frank ogawa plaza. the mayor has an idea for those found guilty to put them to work. have them cleanup the graffiti and pick up the trash. police are trying to come up with new tactics many look at this elaborate shield taken from the protesters. officers say they've never dealt with something like this about so they will change their strategy. police confiscated knives, hammer, and other weapons. they made 400 arrests, three officers and one protester hurt. the mayor is considering issuing stay-away orders against repeat offenders. protesters say the situation turned confrontational because police didn't give them eno

i'm eric thomas. >>> and i'm kristen sze. an hour and a half the biggest one day strike involving california's biggest health maintenance organization will begin. 22,000 kaiser permanente employees will walk the picket line. will appointments be affected? >> reporter: they tell me all appointments will be honored every appointment here at the hospital some elective surgeries have already been cancelled. they've brought in replacement nurses to cover the shifts of the 4,000 nurses who are expected to go on strike today. it will look like this one that we saw in september. today will be the fourth strike by in union since negotiations started two years ago. you will see nurses and engineers in solidarity. the employees dealing with the contract dispute are the mental health and optical employees. kaiser says the last strike cost the hospitals 14 million dollars to bring in replacement nurses. this time kaiser plans to fight the move in court. >> we are surprised. we are taking action in federal court with regard to the nurses s

i'm kristen sze. >> i'm eric thomas. are ugly new allegations this morning that may strengthen the legal case against san francisco sheriff ross mirkarimi. the claims are contained in the arrest warrant used to take the former supervisor into custody on domestic violence charges. amy hollyfield is live at city hall. >> reporter: the affidavit gives a lot of details. including the claim by mirkarimi's wife that he has abused her once before. in the court documents, iliana lopez describes her husband as going ballistic on new year's eve. that the couple's 2-year-old son witnessed the entire incident. she told a neighbor it started when she asked if she could go to her native venezuela. she says mirkarimi started yelling, f-you, f-you, you are trying to take theo away from me. she got the neighbor to roll video to document the bruise on her arm from where she says mirkarimi grabbed her. also, police say they've found another neighbor to corroborate some of these statements. >> i think the case is a lot stronger than we prev

i am eric thomas. >>> and i'm kristen sze. sheriff ross mirkarimi returning to court today.er woman is claiming' abused her. meantime, the sherr river has a new defender. -- amy hollyfield is live at superior court. >> reporter: he wants to fight a stay away order that is in place. he wants to see his wife and child. now he's dealing with possibly two new accusers, ex-girlfriends. never one has come forward. she is working with police. she says mirkarimi abused her. another ex-girlfriend is on the witness list, christina flores will be asked to testify about her claims that mirkarimi abused her three years ago. three of mirkarimi's neighbors also on the list of witnesses. he's going to trial on charges that he abused his wife in front of the couple's 2-year-old son. and he is going to trial with a new attorney. he switched attorneys yesterday but he did not say why. >> the former criminal defense attorney mr. wagner did say before the press that he considered mr. mirkarimi a bit of a tyrant if you are trying a case in the court of public opinion that's not the sort of thing

. >>> and i'm kristen sze this could be the bullet to stop the proposed california bullet train. new study urges state lawmakers to pull the brakes on funding the nearly 100 billion dollar project. amy hollyfield is live in palo alto where there's been fierce opposition to this project. >> reporter: it comes down to the money and the fact that the state doesn't have it. this independent panel found they like the concept. high speed rail, but they say the solid plan is not there. the idea is to build a high speed rail line from l.a. to sacramento to san francisco the project would cost almost 100 billion dollars. the panel found that there is no plan on how to cover 90 billion of that cost. supporters of the rail idea say they hate to give up on it, but they are taking this report to heart >> we have so many demands in california for public services and just for transportation we are 300% under funded on our existing demands. all of this -- these are difficult choices. i think the committee report and our questions are meant to find out is this the right thing to do? can we do it?

. >>> and i'm kristen sze. dozens of elderly residents are out of their homes after a fast moving fire overnight. amy hollyfield is live at the mayfair golden manor. what is happening? >> reporter: good morning. fires say with when they got here there was a lot of fire. check out the massive destruction that this fire left. we are at the apartment complex this is called the may fair golden manor, residents are older but still independent, it is an assisted living facility. four of the eight units have been destroyed, 16 people have been displaced. four of the residents were hurt they suffered from burns, smoke inhalation. but no one is in critical condition. and everyone surviveed. >> it could have been much worse. the firefighters took on great risk. when you have seen jurors you have to ensure all you -- when you have seeniors, you have to ensure all rooms are searched. >> reporter: firefighters got the call 1:45 this morning. they say they got a couple of lucky breaks. someone called early with this fire. so

. >>> and i'm kristen sze. >>> one of the new baby bisons injured after an encounter with dogs. don sanchez is live in golden gate park. >> reporter: this is the bison paddock. that bison injured either hit the steps or some other object inside the paddock building gash frightened by dogs. these bison have been around for a long time. in early december they were joined by seven baby bison in the video you can see the babies barely on the other side of the tall fence. the friend of a dog owner tells us what happened. three dogs got into the paddock crawling under a hole in the fence. >> a dog walker had several dogs off leash. two dogs got under the fence and started hurting the bison. this went on for a while until a ranger and police came and they were able to get the dogs out. it went on and on. >> reporter: for as long as half hour. the dog watcher was cited by police as this sign indicates you have to keep your dogs on a leash in this area. they obviously did spoken as quickly as possible. we can neither confirm nor deny the severity of the injuries of bison. the san francis
