this legal first amendment argument, kristy.thing jump out at you that might lead you to believe that judge mcafee would be more open to this argument from trump's attorneys than say judge chutkan was when she rejected a similar argument? >> not at all. look, this is a really fundamental principle that speech in furtherance of criminal conduct is not received first amendment protection, and judge mcafee seemed highly skeptical of donald trump's attorneys' arguments to the contrary. there are various allegations in the indictment here about soliciting state officials, to unlawfully point fake electors, to ask, you know, the secretary of state to find him 11,780 more votes, soliciting the doj officials to make false statements about election fraud, soliciting mike pence to delay the joint session of congress where they would count the votes. all of those things are speech, but they're speech in furtherance of a criminal conspiracy, and so they don't enjoy first amendment protection, and i do think that this is an easy one for judg

kristy greenberg is former deputy chief of the sdny criminal division.a rubin is an msnbc legal correspondent, and she is with me on set. so somehow enough money was brought together for a bond. what does that mean, and are we going to find out where that money came from. >> not necessarily, let's start with what it means. it means that at the end of the appeals process if e. jean carroll prevails, we know that she will get her money because the security for it has been posted, that $91 million plus has been set aside and essentially placed in an escrow account, alina habba trump's lawyer has asked judge lou kaplan for approval of this amount. he today earlier ordered that her lawyers, meaning carroll's lawyers could oppose that if they want. i've never seen that before. i've never seen someone oppose a bond. i think they will be very glad that donald trump has obtained the amount necessary to cover their verdict because, in her case, she doesn't care where it comes from. it's folks like us who care what the sources and terms of that bond were, chris. >>

kristi, i want to start with you. you describe the judge as, quote, coming in hot, explain how the judge got this case back on track today? >> well, so in january, trump's legal team requested documents from the york and trump's legal team said we've got to dismiss the case, discovery violations for the prosecutors and adjourned the trial. trump lost all of those motions decisively today because the law says the das office needs to disclose documents that are relevant and within their custody control and possession. and these documents were not relevant, the das office was asked how many are relevant and they said less than 300. but trump's team couldn't really answer, they said tens of thousands. they really didn't know. at the end of the day these were bank records that had nothing to do with the case. the special counsel reports had nothing to do with it, and then the question came, well, all of these documents from sdny, were those in control of the das office, is that your argument, you who were a prosecutor for

kristi, how is this legal? how can you, how can he keep saying this one thing and doing another? >> i think the big question here will be looking behind all of this is to who is coordinating it? if donald trump is coordinating between his campaign and the pac that is supposed to be third parties and independent, the save america pac is independent third party, if there is sufficient coordination, you could prove that, then maybe you would have something to say. the six managers are not purely personal, these are campaign contributions. and, therefore, they should be subject to the limits of $5000 resents campaign contributions are subject to. it seems to me they are just trying to do an end run around these various regulations and it seems so transparent. the question is, will anybody look into this? will the fec look into this? will any prosecutors look into this ? it is unclear. >> we are on the eve, kind of, of the stormy daniels hush money payments case, which is $107,000. we are talking about a whopping sum of money that is being moved around various pacs and campaign arms a

kristy, this argument hasn't worked before in the two lower courts that rejected the immunity claims.e any reason to believe this argument would work now? >> i don't think this argument will work now. it's pretty clear in the past that former presidents had believed that they did not have immunity from criminal prosecution, and even donald trump himself didn't believe that he had immunity from criminal prosecution. remember in 2021 during the impeachment proceedings his own lawyer said there is no immunity, no former office holder is immune from the judicial process and that's the proper place to take this up. it's interesting that he's making this argument that if he was subjected to criminal prosecution that would make him weak and hollow. that would hollow out the presidency. when he's talking about being a dictator day one. he's the poster child for why you need criminal accountability. i think this particular argument will fall on deaf ears with the supreme court. >> in the brief, danny, trump's lawyers reference brett kavanaugh, justice kavanaugh a couple of times, including cit
