kristin fisher is here with latebreaking news. >> reporter: this is william barr's first decision on immigration since taking office and it is a big one. it came down two hours ago and detained asylum-seekers who demonstrated a credible fear of persecution or torture is ineligible for release on bond. thousands of asylum-seekers could now be held in jail indefinitely instead of being released on bail while they await their asylum cases to be heard. the decision was not going to affect 90 days, this does not apply to families or unaccompanied minors and does not affect migrants applying for asylum at designated ports of entry. it only affects people who are apprehended after they cross into the us illegally. the decision is being challenged by groups like the aclu who just put out a statement saying our constitution does not allow the government to lock up asylum-seekers without due process. we will see the administration in court. another blow to asylum-seekers the trump administration resuming the remain in mexico policy which could force asylum-seekers from central america to wait
