the city council is prepared to vote on december 6 whether to did he ktla a fiscal emergency as a resultrising pensions. and also put a pension reform ballot measure on the ballot next march. there would be a special election. city and employee unions say they will fight the ballot measure because they say it's illegal. we heard from a veteran city employee who says that they will fight the election in court. >> we'll file an injunction. it will get tied up in the courts for three to five years. how many more millions do you want to spend on that when you could be negotiating and working with folks? >> reporter: now, mayor chuck reed released a statement yesterday and said that they have been negotiating for the past six months and the time has come to act. he says that city workers in san jose are hard-working. they value their accomplishments and duties but they have been negotiating and the time has come to put this issue before voters. again, the city council will vote on this issue december 6 to declare a fiscal emergency and put a measure on the ballot next march. that's the latest
