he said ivanka trump and jared kushner had nothing to do with the so-called pushing out of don mcgahn. what's going on here? >> people close to jared kushner and ivanka obviously deny this but there's no denying for months now, more than a year they have been suspicious of don mcgahn. they have not felt like he served the president well and this story my colleagues at the "times" did about the extent of his cooperation and the time he spent with mueller got under their skin and prompted ivanka to complain to her father about what she thought was an untenable situation where the council spent all of this time with the special counsel and potentially maybe told him damaging things, now the white house, people around president trump say they're not concerned about that but within of the big divides that has been going on is there are people in the white house and around donald trump who believe he should be more concerned than he is and this goes back to what he will do now when don mcgahn does leave and his deputies preceded him out the door. so there's a divide about how concerned they

he sends that e-mail to jared kushner. jared kushner responds on it.ot heard anymore about that but it is a piece of evidence that will go to the jury, jim, when they pick up deliberations as early as tomorrow. >> clearly at least out of the expectation of some influence with the administration. just final question. i mean, there's been a lot of speculation of the case and some surprised that the defense did not mount a defense. is there a concern among prosecutors, for instance, manafort is playing for a pardon here? >> that's always a potential option. you know, nothing to that element has come up in court. no one discussed any potential of a pardon here but we do know that that is sort of the long game s. there a possibility that manafort would get a pardon? we don't know. he also has another trial coming up next month in washington, d.c. where he's facing other related charges about his foreign lobbying work so there's a lot of risk for manafort if he were to take the stand today and lock in testimony that could be used against him in that next cas

and jared kushner. then you have this line at the end of today's tweet, i did not know about it. the president trying to distance himself here from what happened in trump tower back in 2016. and finally that third issue, that this ran afoul here of federal law. taking those three things into consideration, what's the thing the president should be most worried about? >> well, i think he should be worried about all three. let's start with the nature of the tweet in the first instance. in a courtroom, tweets equal evidence. there is a federal rule of evidence called statement of a party opponent. what does that tell us? it tells us that anything a defendant says whether it is in oral form, written form, tweeted form, if he said it, it can be introduced as evidence against him. now, i know there are some who say, well, you know, you can't indict a sitting president, so those tweets will never see the inside of a courtroom as evidence. as a career federal prosecutor, i actually think there is a pathway to indicting a sitting president. let's set that aside for the moment. even if he w

roger stone, jared kushner, donald trump jr. look, this is a guy who was around the campaign for months and months, who traveled with the president, who was there for conversations, who may have read e-mails, who may have listened in on phone calls. and so, he's not just important for manafort. you're exactly right. in fact, the government could probably convict manafort without gates. this is largely a document case. manafort -- i'm sorry, gates put some meat on the bone, but he is going to be important to mueller and his team in lots of other ways. >> this is what i found curious about subjects gates having to go through, as josh just said, revealing what he got the deal for, having to say in court today that he committed crimes, that he embezzled money from manafort. it seemed obvious that he is maybe apart of this, but are they telegraphing anything, the names you just ticked off, kushner, roger stone, donald trump jr., they are all at that intersection of potential collusion, potential conspiracy around that trump tower mee
