keyyung lah is live with us now. what are you hearing? >> reporter: our city hall sources have been telling us they anticipated mayor filner would be back on the job today, carol, but they say all of this is a big question, because he has been so unpredictable. this video that you are looking at, this is very significant, because this is the very first video that we have seen from mayor filner walking into a building in the streets of san diego in weeks. it's been three weeks since we've actually seen him publicly. he was walking into a mediation session involving the san diego city attorney, two councilmen, attorney gloria allred, who is representing a former mayoral aide who sued filner and the city of san diego were sexual harassment and a number of other things. none of the parties could talk about the details of what happened inside that mediation session, carol, but this is very important. this is very significant, because just like that video of the mayor that we haven't seen in weeks, carol, this is the very first time we've seen

our kyung lah is "outfront" with these new details. >> reporter: outrage spilled on to the front lawnf the yellowstone county courthouse, 500 women demanding a resignation saying it's time for the 71-year-old judge to go. outrage based on the judge's decision in the case of former high school teacher stacy rambold who received what amounted to a 30-day sentence for raping his 14-year-old student. this is a yellowstone county attorney, the prosecutor. >> i vehemently disagree with the sentence given on monday. >> reporter: what he got was a slap on the wrist for the crime and one prosecutors hope to appeal. cnn obtained a copy of this memo from the county attorney's office in the montana attorney general, about the 30-day sentence, they write, we believe the statute was misapplied and the minimum sentence should have been two years. >> this case is very important. as we said before, this resulted in the loss of one of our young people in my community. we take these charges very seriously and we fight for those victims and we fight for our community to let them know we're there to back

cnn's kyung lah joins me from san diego.yung, before we get to this latest person coming forward with these allegations, let's talk about this memo. because how can the city remove this mayor without getting voters involved? >> reporter: according to this memo that we obtained from the city attorney, it's basically another way. they figured out a work around, essentially, using a little known section of the city charter. the city charter being the constitution of the city. this deals with unauthorized payments of city money. taxpayer money. in this case, when we're dealing with bob filner, it's the use of the credit card. cnn earlier this week reported on some unusual expenses on his card at a local hotel. a hotel right next door to city hall. the city attorney says that these are, indeed, personal expenses paid by the city. the card has since been canceled. and at this point we're not talking about a lot of money. but enough, says the city attorney, that under this section of the city charter, that if the city council appro
