as the lake merced tract. it serves multiple purposes including acting as emergency water supply in case of disaster and has a destination for outdoor weighter based recreation such as boating and fishing. in 1950, the public utilities commission adopted a resolution giving the rec and park department the right to "occupy, use, and improve for park and recreation purposes the lake merced tract." your predecessors on the rec and park commission accepted this offer and for the last 53 years rec and park has managed recreation, landscape, maintenance, and property leases on the property. in 2006 the board of supervisors passed a resolution directing our two agencies to reevaluate our roles in managing and maintaining the lake. in particular, the resolution urged the puc to focus on lake merced as an urban watershed and to manage the tract to optimize lake levels and water quality. in response to this direction from the board, the puc and rec and park have collaborated on a new memorandum of understanding defining

and this lake should be seen as a habitat primarily. and yes, like i said in the rational world, we would expect that rec and park could have the recreation and that would be done in harmony. that is not what we see in the park and other instances and so. i would concur, with your local community folks that live around that lake, that even though it can get unusual, it is really the sfpuc who has the expertise and showing the kind of commitment on the lands like this to actually manage them properly and so would i urge you to do everything and regardless of what you pass and i would urge you to do everything that he can to retain as much control over this situation as the sfpuc can get and that you put in rigid auditing power so that if smaoeg goes wrong you catch it fast and correct it fast and if necessary, pull back the responsibility of the commission of seeing this park to yourselves instead of rec and park that does not have a good record. >> i need five minutes to review the resolution. so we could break for about five minutes. >

merced to talk about the issues related to the lake and this item is as important to move forward now and really established the structure of the relationship between the puc and the recreation and parks department and relative to the mutual responsibilities out there but again, clarifies that the puc is ultimately responsible for the land out there as the owner of the property. and we made one minor change from last month, or last, july 9th we had to continue the item and added the clause that to clarified that in effect as almost a land relationship that you are sure that that rec and park would not allow the conditions to exist out there and that would be in part to make sure that we don't end up with a case of pollution or something that again the pec would have been ultimately have been responsible for and we do have a couple of additional proposed changes to the mlu. one of those is to item b, which basically was say that the commissioners adopt this and that the commissioner and not the general managers would have the ability to approve any extensions to this mlu over time. and
