we began to save the water that comes down the canal adjacent to lake merced and divert it back intothe lake, and there has been a huge increase in the water level and i think we could bring it back up to its full height by doing things in park mereced. commissioner sugaya: a couple of things. that may be helpful for the commission to have the emphasis in other cases that might affect the development agreement. i think some people are nervous, although we have been assured everything is ok, something from the city's attorney's office might be helpful. just starting as a consultant on a project in marin county which involves an institution which has property that is a lot smaller than this, they have done a complete carbon footprint analysis, which was interesting. i have not seen the results, but involved everything from looking at the number of conferences that would have at the site and figuring out the number of people that would attend, and generally where there would be coming from, including things like the carbon footprint of the airplanes it would be taking back and forth and

we are actually here at lake merced right now and you might be able to see some of the wild foul out the lake right now. earlier today we watched one of the collared birds out here this afternoon and although you can get within a few feet of those birds, it is tough to catch them. they are raising money to buy specialized netting to catch them. one of the collared birds was among the flock of sea gulls gathered at lake merced this afternoon. the director of wildlife rescue says the bird is one of as many as five birds wearing the beer can collars. there is no chance the birds could have collared themselves. someone did it on purpose. >> they would have had to have set a certain trap and would have been a malicious act. >> reporter: reports of the collared birds began filtering in over the last two months. the birds aren't in immediate danger. >> because he is getting cold. and so he is miserable and he wants this thing off of him and he is going to probably spend more time doing that than eating. >> reporter: they used a hand net to try to capture one but he is skiddish. >> the second

things i did not know is the kind of reenergize in -- putting the water back into the ground for lake merced, which is a huge problem for anybody on the west side. it has been a problem and it continues to go there. the other thing, it is smart growth. it is something where you have a responsible developer who is coming up and taking most of the burden from the city. i believe the development agreement is enforceable, and i think we have had a recent success with another project on market street where it was promised that some of the units would stay affordable. they moved into a brand-new building, and i have not told anybody there, but everything i have heard is that has been a huge success and the people who moved in their are happy with their new and improved, safer, cleaner, better development. these guys are giving us everything that we want with this. i urge you to have an open mind and work with them. thank you. president miguel: thank you. is there additional public comment on this item? if not, public, disclosed. commissioner moore? commissioner moore: thank you. this is a difficul
