christie smith live at lake merritt now. the the b.a.r.t. station there and you actually got an inside look by accident this morning. correct? >> reporter: that's right because one door was unlocked here at the lake merit b.a.r.t. station. the rest of them locked up. i just heard from a b.a.r.t. spokesman. word came down late for everyone including the union so they did their best to try to get workers in. even overnight using a phone tree trying to wake people up. basically, the station wasn't open on time and that's what riders ran into. they went inside and it was an odd scene here at the lake merritt station at 4:00 when riders showed up. every door locked except for one. two riders went down inside. there was no station agency, no trains running, ticket machines said he were out of service. the riders arrived to be the first to get the train into the city. they knew it would be limited anyway. after more than six months of back and forth a late might tentative deal was reached. that doesn't mean that the staff was ready at all. >> it's r

you can see that some of the workers are still picketing outside of the lake merritt station in oakland. they still plan on doing that at least through the night. if we did speak with the local 1555. she said that the mean it's sticking point are on wages. and even rules on how employees are scheduled that is what is holding up negotiations right now. go work rules govern our lives lives as workers and we're not going to give those up because those are issues that impact us. these are established practices. to give that of that means anything can happen again do and say anything at all. >> reporter: and the local 1555 is the union that will hold a vote later this week. next week but there is still no time line as one this strike will end. as for bart? he's spokespersons' speaking on behalf of the general managers saying that there will not be talking about negotiations because of the tragedy in walnut creek. >> we are dealing with this situation where the labor situation is not in the forefront of our minds. we just have lost two people in the bart family. that is what our focus is on t

the lake merritt bart station a memorial of candles as they continue to picket. now, we know the names of those two victims involved in this weekend's crash. contractor larry daniels from oakland and also, bart supervisor christopher sheppard. friends say christopher sheppard was only a couple of years from retiring. sheppard had an extensive resume' in the rail industry. he was a senior track engineer at bart and before that, worked for amtrak. we spoke with chris' friend jeff smith. smith said he noticed chris was working longer hours during the strike. we begin with ktvu's brian flores who talked to both sides and joins us live from the lake merritt station where workers are still picketing. >> reporter: good afternoon. workers have been picketing since early this morning, a day after two workers were killed on the b.a.r.t. tracks yesterday afternoon. in terms of the negotiations just in the last few minutes, we understand they may be ramping up again. there was supposed to be an emergency b.a.r.t. board meeting scheduled for 3:00 this afternoon to get an update on negotiations. but those meetings were canceled by the b.a.r.t. board. the only explanation from b.a.r.t. management "it was not needed at this time." a b.a.r.t. spokesperson just texted me and said "we're trying to find a location so talks with the mediator can continue." i spoke to someone close to the negotiations who said, yes, talks between both sides may continue this afternoon. as you recall for several days and weeks, both sides met at caltrans in downtown oakland. back here at the picket line, the members say they just want to get back to work. >> we're doing the best

christie smith live by the lake merritt b.a.r.t. station with the latest. good morning. >> reporter: good morning to you, jon. these b.a.r.t. workers have been holding the picket lines since midnight. they say their shift is from midnight 5:00 a.m. so they are tired but still doing it. these are members of seiu local 1021. they were working they tell me you would see them doing things like fixing the ticket machines and the change machines downstairs instead of course they are up here again. they say they are waiting for word on a counter proposal that they sent to b.a.r.t. this allows for the use of new technology. b.a.r.t. would basically have to sign off on this but they haven't seen it yet. what it would do according to unions is protect workers from unsafe conditions and accidents of course like the tragedy we saw over the weekend. it's clear, though, that might change the tone of the talks but we're waiting to see how. b.a.r.t. had not seen the counter offer but they are waiting to get it. that's the last word we had. both sides have spoke within a me
