wral's lala santiago has been following the story >> reporter: just coming off the stand right now, a sergeant with the wake county sheriff's office that works primarily out of the detention center. she talked about previous issues they had with smith, and that includes having to use pepper spray. when he was released from jail for a case with a stolen car, smith went to his father's home and the officer claims that even his father had issues with him and ended up kicking him out. part of the reasons that the father kicked him out,according to the officer, gang activity which he says that smith admitted. >> did he have any hesitancy in talking to you about that. >> he was pretty up front about his membership. i asked him some further more information, just based upon personal knowledge and intel that i could share with the rest of our departmental unit. he was pretty vague in what he would give me. >> let me talk about what was happening in the stand, in that room right now. the family of melissa huggins jones, the woman murdered and found by her eight-year-old. no one from smith's fa
