let me get your reaction first of all, on kush to what we heard from lanny davis because you were listening very closely that some thoughts. >> yeah. i mean, look, he talked a little bit about the math and how simple the math is. and you just take the hundred 30 and double it and then break it up into pieces. there's a major part of the math missing from that account, which is the $50,000 chris that was allocated to reimburse a tech services company $30,000 of which michael cohen stole so that is not helpful fact from michael cohen's credibility and one of the things we were kicking around here is this notion that we've heard from time to time, that sort of documents speak for themselves or document can be a smoking gun as someone who prosecuted fraud cases, it is often not true. first of all, you do need people to talk about documents and smoking guns are very rare. that's why the metaphor exists. we usually don't have what, you know, it's interesting just what we're seeing right here. the attorneys are now at the bench and not to make too much of too little that we don't know. but this is

lanny davis, i know you'll be watching it closely. we'll check in with you after tomorrow. thank you. thank you for joining tonight. we also have renato and bernard it back here with me. i mean, what do you make of what you're hearing from what the trump team is planning and how that could play out with the jury. >> look, there is a different kind of math that we've talked about, which is that michael cohen was getting a salary of $375,000 from the trump organization. his last check from the trump organization, we've had testimony from jeff mcconney was in january of 2017, his first check from trump or the trump trust is in february of 2017, and it's for $35,000 as i've said, if you divide $375,000 by at 12, you get 31,000 and change the math works out. the timing works out, the problem is, michael cohen says, i didn't do anything. i didn't do any legal work. and the trump team has taken on the burden that they're going to what prove you did do legal work. >> yeah. he said no legal services and also so grossed up but when you look at this and there were there was a big knoc

they speak every night and spoke last night and going back decades, in fact, lanny davis said that cohen will say i own these lies and now i'm telling you the truth. >> there is an old saying in trials, once you lie once, no matter what you do, what the jury sees is a liar, period, end of story. you can double and triple tap that with michael cohen from now until doomsday. as he said, he has to own it and try to convince them this time i'm telling the truth. yeah, they have some paperwork. he will say it. but they will probably look for some way to corroborate all of this, otherwise what do you have? a he said, he said. michael cohen and donald trump trying to tie him to the two charges involved. one of the problems as we've been speaking about. unusual in any trial. we don't know what the second crime is. so donald trump doesn't really quite know how to defend himself. there is a split even among the commentators at fox. some people think the second crime is federal election crime. some say it's the state one. it matters. bragg doesn't have jurisdiction over the federal one. when we spe

the fact of the matter is lanny davis, all of us can speculate. in the courtroom the prosecution hasn't shown any evidence about that. they have shown no intent by trump to violate fec law. so you could have that theory but the prosecution hasn't shown that at all. one other point, a larger point and why brad smith's testimony is also important. the d.a. here, alvin bragg, elected by the people of manhattan to enforce new york state criminal law in manhattan. he is not allowed to take that mandate and rove around federal elections prosecuting whoever he thinks violated federal election law. that's up to the federal elections committee and the biden justice department grabbing at anything it can to throw at donald trump and yet the justice department and fec chose not to proceed with this case. it is a violation, i think, of the constitution as the supreme court has told us for state officials to go around trying to prosecute people for federal law because they aren't responsible to anybody in the federal government. >> dana: amen. that's a questio

that's a really good way because and lanny davis, his attorney, says, we test if we tried the night before michael cohen blow a gasket when they were kind of impersonating what jim jordan and mark meadows would do, and lanny davis said, great if you do that, republicans will be high-fiving you tomorrow. it was a similar method today where where he was really trying to be calm. he was saying yes, ma'am, no, ma'am. he was looking at the jury. i mean, he was really trying to not be the boisterous michael cohen that you see on tiktok or on television. >> i mean, extremely controlled, especially for anyone who's dealt with michael cohen or seen him in interviews, he can be so bombastic can begin so reactive to what someone says and almost always wants to have the last word. and in this he is just true tremendous control on his part of answering the questions even when todd blanche is going toe-to-toe with him parsing things, he is he is not raising his voice. he is answering the specific question and at times he tried to add a little bit more to it and some blanche would punch back and say that

we had lanny davis on earlier. his credibility, that they would have receipts for everything michael cohen had to say. i'm curious what your thoughts are in terms of what he will provide for the prosecution, and then how the defense might handle him. >> after all these years, is there really that much doubt about what michael cohen is going to testify about at this trial? he's told us through podcasts, books, all kinds of different ways. a lot of his testimony we've already heard one way or another. he is going to come in, and he is basically going to say that donald trump ordered me to do these -- make these payments, and that donald trump had the requisite intent when he repaid me for making these payments to stormy daniels. it is going to be really the only true, direct evidence in this case. there are recordings and other things. all the other evidence so far has been circumstantial evidence. in other words, nobody coming in and saying, trump told me to do this. circumstantial evidence can be just as powerful.
