larry biel has the day off. three former san jose states acushioned of hate crimes against a roommate were found guilty today but not on the more serious charges. david louie is live in san jose with new details, a case that began with san jose state students accused of hate crimes against a roommate were made public. david? >> reporter: the jury of six women and six men were hopelessly deadlocked on two of the defendants although did come back with a not guilty verdict for one of the defendants. they were unanimous in charging them with misdemeanor battery against their roommate d.j. williams who is back. defendant colin warren is seen leaving the courthouse an hour ago. he and two other roommates charged with put a bicycle lock around his neck and hanging a confederate flag in the dorm room. first we hear from the district attorney. >> you have to prove what was going on in someone's mind when they were committing a certain act, so i think there's always difficulties with it, but we believe the evidence very s
