janine de la vega is joining us live. we just talked to a man who said he heard those shots. >> reporter: yes, he was one of the people who heard the gunshots. this has just left him feeling very uneasy. right now behind me you see police are still here. they're about to wrap up their investigation at least out on the scene. but there is also a crime scene cleaner. because it appears that the shooting happened right here in this area. this is just a couple blocks away from mcculllam elementary school. let's go to video of the shooting. we know a 911 call came in around 11 crank last night that a man had been shot at least once. he was rushed to the hospital by family members. we are told family members do live in the area and a couple of hours later he was pronounced dead. we from receiving some information from police that the car that he was driving in that is being taken as evidence because it's a possibility that he might have been in that car when he was shot. homicide detectives have been out here all night. they ha

janine de la vega has been on the story since 4:30. you are joining us to tell us what firefighters are saying about the people who live in the home. janine? >> reporter: it's a very grim mood out here. i just spoke with sunnyvale police who is handling this investigation along with their firefighters. and they tell me they don't know who the two people are they found inside. they weren't able to determine their genders. everyone fears it's the elderly couple who lives here. take a look at this home. it's completely destroyed. sunnyvale's department of public safety is just beginning their investigation. flames shot out of the windows. smoke was billowing near 101 and north fair oaks at 2:00 this morning. police evacuated neighbors as well as a man in his 50s who lives in the home. the fire was knocked down in 20 minutes. no other structures caught fire. but concern quickly turned to that man's parents because they were unaccounted for. police tried their cell phones all morning. they hadn't been able to locate them. neighbors say the

janine de la vega is joining us now from san jose with more on this story. janine. >> reporter: pam, we expect emotions to run high when people file into this courthouse later this morning. right now there is a caravan of buses traveling here from l.a.. they want the judge to know they don't want a man who terrorized women to live in their community. serial rapist christopher was convicted of raping and assaulting 40 women between 1971 and 1982 throughout california. including the bay area. he's been in a state mental hospital since his release from prison in 1996. this morning a judge in santa clara county will hold a hearing to determine if he should be released in unincorporated palm dale which is about an hour out of the l.a. area. that plan has sparked outrage among people who have lived in that community. nay have organized a facebook page urging people to come to the bay area to tell the judge that hubbard is not wanted and to keep looking for another city to relocate him. now when the protestors arrive we plan on talking to them about all of this and
