cnn's chief legal analyst laura coates, standing by outside laura. >> a day that donald trump thought would never come or perhaps hoped would never come. we remember that it was now, months and months ago, when a jury convicted him of 34 felony counts. he has tried to kick this can down the road, appealing to even the highest court, trying to ensure that he will not convert from a person found guilty to officially a sentenced convicted felon. but here we are in new york city, manhattan, where, frankly, the prosecutor said it all began on this falsified business records case. the catch and kill, prompting the allegations about what has transpired. now he continues to fight back. but here we are today in one of the strangest of sentencings. normally a defendant literally can't phone it in. they've got to be present. they're not necessarily aware of what their sentence is going to be. they have no idea whether it will be a jail or a fine or some probationary period. here this judge judge merchan, who trump is accused of being biased against him, has already signaled to the president elec

laura coates live starts right now. they were able to look at the draft report against the president-elect. smith dropped both the classified documents case and election subversion case he was planning release a report. now the team is urging garland to stop the release calling it a politically motivated attack and cause prejudice against the two trump co-defendants who are still facing charges. those co-defendants made a filing of their own trying to get the judge to block the doj from releasing any report. they argue smith does not have the authority to release it since cannon ruled his opponent to special council was unlawful. garland fired smith as well and they want a decision before they leave the administration. let me break down a little more. what they will get is number one they fear that this will be released immediately. as has been the case and two other special counsel reports filed. one of the reasons they say so they believe it will prejudice the remaining defendants. it will be kind of a huge media fren

and i want to bring in cnn anchor and chief legal analyst laura coates on that note. and it was interesting, laura, sort of as an extension of what caitlin was talking about. judge merchan really emphasized that the protections afforded here for the office of the presidency, not the occupant, not the actual occupant. but he noted, this is just so out of the norm. this is an anomaly. it's a first. and this is very unique. >> in fact, one, we did see the decorum that is supposed to be in every one of these court proceedings at play here. but you have this split screen, the typical sentencing, first of all, would have had a defendant present. you would not have had the preview to know what type of sentence you would hand down or not hand down, whether it be jail, a fine, a probationary period of some form. in that circumstance, that's the typical thing. and of course, the prosecution would be asking and trying to advocate for particular position, bringing in the conduct of the defendant. the very nature of the allegations as a proven burden of proof. here the prosecution
