i'm laura jarrett. >> and i'm christine romans. so nice to see you this morning on thursday. >> thursday, and a lot to get to. we begin with the breaking news overnight. texas's new ban of nearly all abortions now blocked. a federal judge granted the justice department's emergency request last night finding texas' law banning abortion as soon as a fetal heartbeat is detected violates a woman's constitutional right to an abortion. in a 113-page decision, judge robert pittman notes that texas deliberately crafted this law to evade judicial review by deputizing private citizens, not the state of texas, to sue abortion providers, essentially creating a system of vigilante justice. he writes, quote, this court will not sanction one more day of this offensive deprivation of such an important right. the white house in the statement says the ruling is an important step towards restoring the constitutional rights of women in texas. the state plans to appeal. i assume very quickly. this is huge news for women waking up in the state of texas

>> cnn's laura jarrett joining me now with more. laura, how did we even get here?to that encounter? >> yeah, erica, it's hard to watch that. police claim this all started when they saw clifford owensby coming out of what they claimed was a suspected drug house. they stop him, they stop the car, and as you saw in that video it turns very ugly very quickly. police later claim they mentioned the drugs, they also mention they found a ton of cash in the car, 22,000. ow owensby said that was his savings. he's been charged with obstruction and resisting arrest, both of which are misdemeanors. now that this footage has come out, he spoke to one of our affiliates about what was going through his mind at the time. >> this is it. this is how i go out? just like every other black man i go out on tv, and this is my turn. the way that they have treated me during that traffic stop, i only feel like i seen -- i was an actor in a movie out of roots, a movie i was taught growing up about racists and slaves. i think this type of stuff probably happens all the time. i'm just thankful

laura jarrett, thanks so much. >>> let's bring in dr. regina bejet, an emergency medicine physician. good to have you back. i want to set aside the politics and the law for a moment and look at the health part of this. a lot of data seems to be showing these mandates are working, right? they're getting very high compliance rates within companies, from a public health perspective, is that helping to stem the spread of the coronavirus, particularly as we saw the delta surge sweeping across the country? >> jim, of course the mandates are working. we have some of the greatest minds in science, some of the best physicians around the globe telling us all what we need to get control of this pandemic and what we need to do to stop covid-19, yet on the other hand, we have politicians who don't have medical training trying to undermine every public health effort we tried to put into place. yes, the mandates work. vaccines are what's going to get us out of this pandemic. i can't say that enough. >> to that point, the fact that the mandates are work

cnn's laura jarrett joins us now.n, this should be a hugely important ruling for women waking up in the state of texas this morning who want access to an abortion. i say should be, because they had their constitutional rights vindicated here on paper, but what about as you say inaction? the unusual part of this law, remember, was that it doesn't just ban abortion when a doctor hears a heart beat, but gives private citizens the ability to sue abortion providers, basically anyone that helps, and we know that this law was deliberately crafted by lawyers because it wanted to make it harder to challenge it. wanted to make it harder to sue. so to get the law struck down, the justice department had to figure out a way to show the harm to the united states. and the interesting strategy here was not just to show the violation of women's rights in texas, but how this law affects interstate commerce here in the united states because all the reporting out there shows the law didn't stop abortions. it just stopped them from women

laura jarrett is with us on this story. laura, what are you expecting to see today? >> guys, the big question this morning is whether anyone shows up. house investigators end up sitting in a room alone. the committee scheduled two depositions for today and two for friday. up first, kash patel. he was trump's defense secretary and is engaging with the january 6th committee. but no word whether he will actually turn up on the hill today. and then former trump adviser steve bannon. he is stonewalling the committee on documents and already said he will be a no-show today. in a statement last night, bannon's attorney said his client isn't participating because trump told him not to, citing executive privilege. bannon, you'll recall, was fired back in 2017, so he wasn't even part of the executive branch on january 6th, making any assertions of privilege about his talks with trump legally dubious at best. as for what happens if witnesses don't show, one member of this committee says there will be swift consequences. >> we're not willing to allow them to play rope-a-dope in
