i've never been that scared in my life. >> ed lavandera joins us.wo in the clip are charged with engaging in organized activity, same charges as the other 150 bikers. why is that the case? >> this is the fascinating part. it didn't matter if you were in the middle of the melee, pulled the gun or trigger, hiding in the freezer of twin peaks, everyone has been hit with the same criminal charge, and now all of them are out of jail, on bond, trying to figure it out, make sense of it all. many face up to life in prison if convicted. that's the big controversy. why was everyone hit with the exact same criminal charge, if not everyone acted the same in the middle of that fight. >> and in terms of the timetable, any sense of when this may go to trial, if it is going to trial? >> there hasn't been a single trial in waco yet, it is not exactly clear when that's going to happen. waco prosecutors say there's a gag order, they're not talking because of that. some lawyers we have spoken with that believe none of the cases will ever go to trial, there's a supersed

ed lavandera, fantastic correspondent joining me now.i talked about this yesterday, about the federal case that's evolved from all of this. the three guys who do have trial dates who were not even there. >> jeff pike you saw there. >> but now there are motions that have been filed fighting the d.a. and the prosecutors in this case. what's happening? >> this is a motion that is being filed right now in waco and a lawyer for one of the bikers that was wounded in the shooting is filing a motion to get the district attorney and his top two assistants working on this case recused from these cases. >> what's the beef? >> well, they say that the prosecutors came in very early into that investigation, into that scene when investigators were questioning all the bikers there and said the prosecutors determined the course and scope of the investigation and overstepped their bounds and influenced the way police investigators were doing their investigation there in that shooting and influenced it in a negative way that afternoon. whether or not this

to now and survivors telling cnn what it was really like and not just that, they opened up to ed lavanderaut the bad blood and ed is here with me in new york to talk about. this was many, many months of you and everyone working on even getting them to talk to you. who did you get? what are they telling you? >> we wanted to focus on, people asked me how did the fight start? we wanted to get as close to the beginning of that fight as possible. we will have two exclusive interviews with rival biker members there at the beginning of the fight and the national president of the banditos and facing a federal investigation and federally indicted. he's out of jail on bond. but you talked to the most hardened biker in any club around the country saying what happened in waco last year is one of the most insane, wildest chapters in outlaw biker history. ♪ cossacks, banditos. enemies and months of rage and violence led to this moment, an all-out battle in the parking lot of a favorite biker hangout. hundreds of bullets have been fired as armed police officers are nearby watching. dozens are down. wound

ed lavandera.y the agent he thought this was his girlfriend's apartment, is that right? >> yeah. that's what the agent is telling us. it was early in the morning, around 3:00 in the morning. a 23-year-old play e for the new york's pe new orleans pelicans thought he was going into his girlfriend's apartment. turns out he was entering and kicked the door into the apartment right below his girlfriend's apartment and that the resident in that apartment who hasn't been named yet called out to dejean-jones and then shot him and then dejean-jones stumbled back out into the breezeway outside of the apartment, collapsed to the ground. he later was taken to the hospital where he died from the wounds. but his agent said, victor, he was essentially at the wrong place at the wrong place. still many questions swirling around this. also, it's not clear if the resident in that apartment shot dejean-jones. there are states where deadly force can be used when someone inside their home fears for their life. so that i

let's go to ed lavandera. i remember that week to know that this was a crime.hey come to that conclusion, ed? >> reporter: well, a combination of a couple of things according to the atf agents and investigators who have been working the case for the last three years, as you heard there from one of the lead investigators they were able to rule out scientifically natural and accidental causes. and they have gone to great lengths to re-create a model of that fertilizer plant. they've been able to pinpoint exactly where the fire started that eventually led to the explosion. they say it's one of the most costly and in depth investigations the atf agency has ever done. that in combination with some 400 interviews they have done. they say that has led them to believe confidently they were able to rule out the accident and natural causes for inexplosiithe explosion. the question becomes who would have done this. investigators say they do not have any suspects at this time. why they've opened up a crime stoppers hotline hoping that tips will continue to come in. this ha
