everybody loves tax cuts, lawrence.the president did was get into a bidding war with republicans over more tax cuts. now, as bob says, if it results in a lot of economic growth, then the president wins. but i think there's problems down the road protecting social programs which will be under additional pressure because the funding sources won't be there. however, if the president can lure the republicans into cooperating with him or he can cooperate with them on the spending side of this in the next year or, so i think the president's victory will be complete. el have political protection if he gets boehner and company to go along with spending to equal tax cuts. >> our ambassador from the conservative side of the world, how is krauthammer's article landing over there on your side of the world and do you believe it is correct? do you believe barack obama did win this? >> i think krauthammer has a point about the long-term of this. there's nothing that reduces the debt or deficit the tea party was so worried about. for t

lawrence is standing by to tell us how much colder it's going to get. lawrence? >> yeah. it is going to be one of those chilly cold nights around the bay area. frost going to be developing in some of the valleys. out there right now, we have a few clouds but not many. mostly clear skies. so yeah, nothing to really hold the heat in so those temperatures going to plunge in a hurry. check out the satellite image. you get a good idea of where all that cold air is coming from out in the gulf of alaska. look at it traveling down along the coastline. bringing that cold air to plunge the temperatures into the deep freeze tonight in many spots inland down the freezing mark in napa at 32. 30 in santa rosa. hey, we can see 29 degrees in fairfield, about 32 and freezing in concord, 30 in livermore, not as cold around the bay. but you get the idea, cold enough chilly temperatures about everywhere you go. it looks like things are about to change. we have more rain brewing and that could factor into your new year's over. we'll talk about that coming up in just a couple of minutes, rocke

but we begin with meteorologist lawrence karnow who is tracking the storm right now. lawrence?e in the north bay have been preparing for possible >> we begin with our meteorologist lawrence karnow. >> it has been ripping across the bay area tonight. heavy rainfall pretty much widespread. it looks like we may see the ends of it though in the next couple of hours. still, we are seeing moderate to heavy amounts of rainfall. main focus shifting a little further to the south in towards san jose rain there. just to the north. you've got pockets of some moderate amounts of rainfall and some heavier amounts of rainfall in toward the hayward area. those showers will continue on and off. that rain continuing for at least the next hour or so. then we may begin to see some changes as behind this on the back side you're starting to see things lighten up just a bit north of santa rosa but we have seen some very impressive rainfall all around the bay area. check out some of these totals. we have some automated weather gauges outside. almost three and a third inches there. over 2 inches of rai

meteorologist lawrence karnow says more rain is on the way. hey, lawrence? >> nothing like we are going to have tomorrow. and we have seen those scattered showers around the bay area. had a pretty good band that moved through parts of the south bay but we have got a stronger system off the coastline. high-def doppler picking up on some of the moisture right now. we are seeing scattered light showers showing up outside. so if you are headed out you might want to be prepared. you can see the cell moving on by. further to the south we have got some more widely scattered showers. hanging out over the mountain tops but the main band making its way over the central valley. but we are not done, folks. the main event really yet to come. it is sitting off the coastline and it will bring with it a pretty good punch. i believe especially as we head into tomorrow afternoon. we are going to see a whole lot of wind. some heavy rain coming our way it looks like by tomorrow afternoon. we will have more details coming up in just a few minutes. back to you, ann. >> great, law

lawrence. >> it's just getting going, robert. we're looking at some heavy rainfall developing around the bay area. looking toward the berkeley area right now, yeah, kind of a tough ride out there. a lot of red lights and the rain is coming down just about everywhere you go. in towards san jose, even lighter amounts so far into the san jose area. but that is going to pick up as we head through the night tonight. becoming heavy even in that area. flood advisories up for the north. flash flood watches have been posted and you can see why. check this out. we have a lot of heavy rainfall making its way into parts of the north bay. some pockets of some heavy rainfall into healdsburg. this will intensify. this evening we'll see rain around 3/4" to an inch an hour. that's coming down fast, folks. if that happens, it looks like we could see some creeks coming over the banks. this is a big storm and it's going to work down across the entire bay area. already seeing moderate rain along the peninsula right now. lighter amounts at san jose. t

back to you. >> lawrence, thank you. >>> well, it is being called a catastrophe for the second year in a row. salmon season has been canceled because of the scarceity of salmon in california waters. bay area congressional leaders hosted a summit to discuss what can be done about the near extinction of the salmon policy. >> salmon is the life blood here. >> reporter: all along california's coast and in its rivers the natural resource is drying up in part because water is being diverted from the delta for use all over the state and overfishing. >> you lose salmon and recreational fishery in northern california are gone. >> reporter: these fishermen came to the meeting in half moon bay where local congress members wanted to put pressure on the people in charge of our water and fisheries. >> i'm horrified. and i think most californians will be horrified when they realize that the salmon as a species is about to be obliterated. >> reporter: 90% decrease in the salmon run leading. . >> i think we are at a tipping point here and i think it is important to raise everyone's awareness. >> report

lawrence karnow with a look at what may be a very wet and especially windy christmas day. lawrence. >> yeah, looks like a frightful christmas indeed was eve a good storm that's headed in toward the bay area. don't want to mess with this. some of the clouds are streaming in the bay area right now. most of the vein holding off the coastline -- most of the rain is holding off the coastline and it won't be long. things dry outside now but here comes starting to creep in on us so by tomorrow morning 8 a.m., we are starting to look at some showers beginning to develop in parts of the north bay and watch what happens. just rolling this a few hours later the storm system comes in horizontal to the coastline so it's going to slam us all at once. very heavy rainfall showing up toward the middle of the day tomorrow, all the way from santa rosa down into the santa cruz mountains. maybe one to two inches of rain, as we head into the afternoon on christmas day, it looks like it turns to showers but then there is even the possibility of some isolated thunderstorms along with that and the

what this comes down to -- lawrence verses texas. california has built a fence around their gay and lesbian citizens. it has built a fence around the institution of marriage, which the supreme court says, "not based upon sex, procreation, or anything else it is the most important association in life." the citizens of california, because of their sexual orientation, are denied access to what every other citizen in california has been closed within the other fence. that is a violation of the equal protection clause and it is a violation of due process. >> are we free and in view of the way that the supreme court has told us to decide constitutional issues that the narrowest should be adopted? are we free to do anything other than decide the issue of whether california's repeal of the initiative constitutes a violation? you're closing speech would require that any state that did not permit gay marriage would be in violation of the constitution. there is a possibility, i think, in this case the proposition 8 would draw the right of gay m
