lawrence karnow tracking the storm lawrence how much rain we get. probably going to see another inch. >>maybe a little bit more than that some parts of the area overnight tonight but we're really just kind of get into this. we've seen the lighter amounts coming to look at the storm system what a gorgeous storm is just rapidly developing will call a bomb cyclone is it's really intensifying as it's approaching the coastline now the rain has really just started to pick up the main cold front now making its way into the bay area you see that band that is now moving through that some heavier amounts of rain that are sliding to the bay area we've even had the lightning strike here within the last half hour or so looks like kind of a rough night to travel around the bay area tonight as that rain continues to move through and those heavier bands are sliding through as well. now some that continues into mill valley into richmond stretching across into oakland also into san francisco, the heavier amounts of rain have been dropping as much as a half an inch of rain in some parts of the north bay today, lighter amounts elsewhere. but you can see all the rain moving through right now in the san francisco. it is really just started pick up as we take you down to street level you can see right there. on mission street you've got a pretty good cell coming through your area, the patrol district you're seeing some heavier bands moving to your neighborhood as well up in the north bay, the bands have been pushing through into the napa valley now moving south. hercules there seems a pretty good rainfall also into richmond else also just beginning to pick up now in the concord and that ban will continue to slide to the south so as it does that rain will start to intensify and pick up elsewhere around the bay area and there certainly the possibility of some lightning rain moving now on the pacific and now beginning pick up they're not as much as you head a little further to the southeast you can see just ahead of that cold front but some very strong gusty winds out ahead of this cold front as well we're seeing some winds 3040 miles per hour. in fact some of those winds upper to 50 miles per hour across some of the mountain peaks, san jose just some light showers at this time so you have to wait, but don't worry it is coming your way you see that band that is just about to make its way into san ramon. and of course we've been talking about the sierra nevada, how about that all whole lot of snow and very low snow levels too. >>even plaster bill looking at some snow right now. >>and thank you more from you later of course it has been months us as we've seen any rainfall and also this storm marks the official start of the rainy season for the bay area for those concerned about drought. it's a good sign. but for those worried about landslides it's a whole different story kron four's dan kerman has more. >>from sausalito. like many parts of the bay area rain began to fall in sausalito in the early afternoon. >>i'm glad to see the rain because we need badly. >>but for city officials there's always a heightened concern when it rains i don't think he really can be totaldy confident and in what mother nature throws at us everything from geological hazards to storm damage to everything else so we do our best to to keep an eya on it and manage it. and that's the best we can do. he was in february when the land above sausalito boulevard broke free. >>crossing the street and sending one home crashing down the hill into another on crescent avenue just weeks ago that debris was finally removed, it presented a hazard if you know you're not quite sure if that material will move when the rains hit. and so we wanted to get all that material out of here. before the rains actually showed up seed in green netting is now where the homes and debris once were to prevent erosion and just before the rain hit tuesday, public works crews put in some extra protection to catch green material before it goes into storm drains on crescent and more is coming in a couple of weeks. we're going stolen additional drainage system down below right across the road in front of us and connect it down to a lower drainage system above sausalito boulevard plastic remains on the slope where the actual slide started to keep additional water from getting on to the hillside that should reduce but not eliminate the risk of future slides. the city is also working with the park service to put in additional eyes and ears. they've got a geotechnical from this going to put in some slow meters and some other monitoring devices up there in the next couple weeks. >>in order to manage and keep an eye on what as ever happening with the slope above. >>so we are tracking these way storms as they move through the bay area are forced michelle kingston live for us tonight and walnut creek which apparently michelle turn even see some rain there as well. >>it was really coming down. it's starting to come down once again we're also seeing a lot of wind starting to pick up. and we just saw lightning here in downtown walnut creek. rain jackets umbrella. creek people shopping early sales and kids enjoying time off from school so my friends and i were just shopping around. >>and it looks like about the rain i don't know i want to get too cold or too late. >>some shoppers enjoying the change in weather after a very dry few months so the bay area, so excited. the cold temperatures the brain in the winter finding them. family feels like thanksgiving now. i can't speak for everyone, but i really don't mind the rain it's the call. >>all that's bothering me today it feels like it just kind of slapped us in the face and all the sudden it's here. it is winter, but it's not stop i think people from coming out tonight a lot of people here and downtown walnut creek grabbing dinner and of course shopping some of those early black friday deals back to you guys. >>michelle try to stay dry out there and warmer in county saw some rain earlier than other some rain earlier than other parts of the bay area the to be cautious on the roads because this really is the first significant storm we've had in quite a while the highway patrol says because of the rain oil is coming up out of the asphalt which could make the roads even slicker. they're also asking that you keep a good distance between vehicles just in case, somebody tries to suddenly stop yeah. >>and if you are planning travel to the sierra for thanksgiving officials say you may want to reconsider pushing your departure until 3rd. >>thursday look at that that does not look like a fun place to be already today the highway patrol has closed interstate 80 between try key and all to after several spinouts and crashes it has since reopened but the snowstorm is creating some blizzard-like conditions there let's go live now to dennis shanahan who's in and gold run placer county with conditions tennis we see you all bundled out there bring us up to date on what is like. >>the as you can see we have heavy snow coming down here at gold run this isn't about the 3,000 foot elevation keep in mind during some of the drought years. we didn't see snow at this elevation at all during those years it was usually about 6,000 feet here we have this want to also direct your attention interstate 80 which is just barely moving here through gold run as you're looking at eastbound traffic we're very near the team control checkpoint which is right now at all tested these cars and trucks it is crawling along to get to that checkpoint we can take you to some video that was shot just before sundown this video shot in cold facts in cold facts mind it was just above 2000 feet or on 2000 between 2 3,000 feet and that is where the rain was quickly turning over to snow. so very low snow. they had to close down caltrans and highway patrol closed down interstate 80 between all to in truckee that's the entire donner summit area between about 3 5 o'clock because of multiple spinouts and accidents and they have since reopen the roadway but of course keep in mind even though interstate 80 is now open it could close again spinouts and accidents are likely but to get the chains on the cars that trying to get him safely so here we can show you this live shot again the trucks just creeping along interstate 80 travelers are advised to just avoid this area tonight. if you get your thanksgiving plans are taking up to the mountains, the wait until the worst of this storm passes tonight. hopefully there are some windows of opportunity in the next couple days reporting live a gold run dennis shanahan kron 4 news hayden is real quick a looks like the traffic really is going like 3 or 4 miles an hour. it's that any a time estimates on. >>what i guess typically it's about 90 minutes to get from sacramento to lake any time estimates on how long it takes to get up there right now. >>can tell you we haven't heard anything official on that from the chp va just based on our experience here on the mountain. this is going to take people i would say at least 3 hours because first you just crawling along to get to the team control checkpoint and then the speed limit in the chain control areas is 30 miles per hour so keep that in mind and that doesn't factor in any of this slowdown is because of spinouts and accidents that are likely to happen every time we have conditions like this up the mountain. >>you think quite a picture they're standing in the snow. i you're headed south taking i 5 heading toward the great fight in la to get home for the holidays or visit for the holidays, we're going hear from the fresno highway patrol on the road conditions through that part of the state. that's right after the break. >>and raiders rolled to the bay area now strong cold front moving through at this time checke >>welcome back. we're tracking the storm across the bay area and across northern california is a live picture. the radar scene and you can see a it's a big line this stretching from half moon bay all the way across san francisco across the east bay. covering most of oakland wannacry conquered all the way into antioch and it's moving toward the southeast. so fremont redwood city, san jose cupertino you're going to get hit next and get ready thousands of people of course already hitting the road for >>a day in this rainy weather. they will need to be extra careful because of the potential for dangerous conditions. we're now joined on the phone by shasta tolleson with the highway patrol in the central valley in fresno shasta what's your advice right now, i know you cover a lot of territory people are heading up towards yosemite up the sierra the central sierra. >>and a lot of people going on i 5 toward la what's your recommendation right now. >>and good afternoon. right now we are getting a little bit of rain that through slow down, i'm not only because of the weather but that but also with all that extra to travel. but just reminder that when the rain there coming down slow down increase that following distance from the vehicle in front you make sure that you do have those headlights on and mature winter wafers are in proper working order. >>our understanding is the snow level of grapevine is about 5,000 i guess with keeping the clouds but if you are traveling to or through those higher elevations to make sure that you do carry chains that you do you know how to properly put them on your vehicle. we do kind of anticipate that we are going to have some fell on the ground caltrans is already out ready with the hot rocks and sand trucks as well. but he gets to cut it make sure that you carry some blanket, maybe facts as well. >>do you have extra >>up and down the great time because this bad weather and the heavy traffic for the holiday. >>this is the maximum important weekend for us that we do have extra patrols all throughout the 8. we take more. we paid a more attention to those higher troubled areas at the we'll have officers out there we will have no truck as well and again couch and out there to try and help the travelers long on their way is there a lot of the activity heading toward yosemite this time of year. >>and not too much. headed up toward the mountain. i think a lot of our commuters are headed in the south that or straight through the valley. >>just to tell us and with the chp thank you so much for your insight into what's going on in your direction with all of the lawrence o'donnell. good evening, lawrence. >> good evening, rachel. and don't worry about monday. roger stone cannot be found guilty again. and did you ever imagine that on the day roger stone's verdict would come in and it would come in guilty on all counts, that it would be in my hour, anyway, literally the last story i'm going to be able to get to? >> exactly. you have to like squeeze it in among everything else that not only happened over the course of the day but that's been happening over the course of the night. this is crazy. at least a two-way tie for the most oimportant story of the night on a day when the president tweeted his way into his own impeachment hearing with a tweet that some say might be worthy of its own article of impeachment. we also have congressman erick swalwell racing towards us because we just got word that that closed door deposition just ended one minute ago. and congressman swalwell has been in it all the way and that of course has just taken over the number one position the way we'll begin tonight with new details about the cell phone call from restaurant in ukraine over heard by david holmes and who knows who else. >> i mean i'm very excited to hear what congressman swalwell is able to tell you about the deposition. having access to the opening statement from that witness, that witness is able to give us jaw-dropping detail about the call which puts the president at the center of this scandal. in addition to that, the witness is giving us corroborating information and testimony about other elements of othis scandal in terms of what he was able to see from the u.s. embassy in ukrain and he was there after marie yovanovitch has left. a lotf of the criticism was you weren't there when the worst of all of it happened. and it's a new witness we didn't even know the name of until yesterday. >> when the news of this call emerged and it first emerge said in ambassador daytaylor's testimony, a staff member over heard the phone call. i was so stunned at the imagery of gordon sondland in kiev calling thes of the united states on a cell phone. the unsecure nature of that call is so wild and we've since had john brennan and others on saying of course the russians were listening to the call . of course that call in that atmosphere was recorded by other intelligence services. >> and that time in july the fact that the u.s. was putting this kind of pressure on ukraine, putting aid at risk at other things wasn't being publicly discussed at all. we've had all the expert testimony about how it's so important to ukraine's national security and their ability to negotiate with russia that anybody not know ethere was any rift at all between them and us, their most important ally and the whole world listening. did i get my investigations? to the extent he was broadcasting that by having it on an unsecure line. that means the whole world knew what kindf of improper pressure trump was putting on that country and that alliance. which means that phone call alone hurt ukraine in their war against russia. america will have to pay for that for as long as the rest of us live. >> and this is one of those w k weeks, nights where i can't get the chant out of my head, the idea that the former secretary of state should be locked up because of questionable security practices involving email communication which turned out to not end up being certainly a legal problem at all. but an entire presidential campaign based on how dare you not use the absolute most secure high level forms off communication when we know jared kushner, ivanka trump and uthes have been using personal email and much, much worse. and the gordon sondland phone call is as bad as that gets. >> yes, a sensitive, national security matter that matters most of all in the country likely to be listening in on the call. the president not only talking about crime he's committing but endangering the national security of that ally. but there's roger stone with the lock her up t-shirt. >> here's what we know we don't have on monday. we know we don't have a public hearing but president trump will be allowed to tweet on monday. who knows what happens monday. >> i'm compartmentalizing and refusing to think about that. >>> the breaking news of the night is that closed door deposition of david holmes that started this afternoon and ended six hours after it started going late into the night. and david holmes' opening statement has been obtained by nbc news and rocked washington as much as any of the testimony already been made public and it will have a profound effect on the impeachment inquiry. his testimony, which provoked, very specifically provoked, by some of the it things that republicans have been saying in the public hearings this week. david holmes had no intention in testifying until he saw that republicans kept complaining about what they called hearsay and he realized that he had relevant testimony that was not hearsay. and so he testified this afternoon in a closed door, under oath deposition after former ukraine ambassador testified in a dramatic public hearing this morning. he's a member of the senior staff stationed at the u.s. embassy in kiev. and in a copy of david holmes' opening statement, he explained exactly why he came forward. as the current impeachment inquiry has progressed, i have followed press reports and reviewed statements of ambassador taylor and you von vich. i believe the relevant facts were therefore being laid out for the american people. however, in the last week or so i read press reports expressing for the first time that certain senior officials may have been acting without it president's knowledge in their dealings with ukrain, at the same time i also read reports noting the lack of first-hand evidence in the investigation and suggesting that the only evidence being illicited at the hearings was hearsay. i dime came to realize i had first-hand knowledge that had not others with been reported and they were using the levers oour diplomatic power the ukrainian president and it was at that point i raised to ambassador taylor the incident i had witnessed had acquired greater significance, which is what he reported in his testimony earlier this week. it's a telephone call made by donald trump's ambassador, gordon sondland, from a restaurant in ukraine to the president of the united states, sitting at the table, he could easily hear what the president was saying on the other end of othat call. quote on mr. sondland's phone was not on speaker phone, i could hear the president's voice through the ear piece of the phone. it was very loud and recognizable and ambassador sondland held the phone away from his ear for a period of time, presumably because of the loud volume. i heard him greet the president and explain he was calling from ceebev. i heard president trump clarify that ambassador sondland was in ukraine. he replied yes, he was and that president zelensky loves your as. and ambassador sondland said he's go doing it. adding president zelensky will do anything you ask him to. and the president replied he was in a bad mood, which is usually the case early in the morning. i then asked for his candid impression. i asked if it was true that president didn't give a crap about ukrain. ambassador sondland agreed he did not give a crap about ukraine. i asked why not he added that the president only cares about big stuff. i added there was big stuff going on in ukraine like a war with russia. and ambassador sondland replied big stuff that benefits the president, like the biden investigation. leading up with us is swalwell, he has been in closed door deposition all afternoon and this evening. he has just left the deposition to join us and took part in the yovanovitch public impeachment hearing today. as i understand the deposition has just been completed? >> good evening. we are done with both ambassador yovanovitch's testimony and the deposition with david holmes and of course bright and early tomorrow morning we have one last witness for the week in onb employee. >> we have read, as you know, his opening statement has become public. it is shocking enough, as an opening statement. after this opening statement, what was developed in the six hours of testimony that followed it? >> just what exactly did mr. holmes see, what did he hear and what did he do? it was the reason we called him in today. i will say first and foremost with gratitude to mr. holmes, because he showed up. he came from ukrain and despite mick mulvaney and secretary rick perry refusing to cooperate with our investigation, mr. holmes continues this long line of career foreign service officers honoring the duty to cooperate with congress and each time someone has done that, just as mr. holmes has today, we have learned new information and we learned new inform algz today. >> in terms of the security of that cell phone call, did you learn new details about what kind of device that was was that a personal cell phone? >> i'm not going to go into his testimony just yet. i'll let our chairman characterize that. but i think we're five exits past security concerns. we know donald trump doesn't really execute or carry out operational security taz as it relates to his cell phone. there were concerned about ambassador sondland and his security. what we're focussed on is whether he leveraged taxpayer dollars to his benefit. and as you heard ambassador taylor talk about his interaction with david holmes, i don't think anyone has trouble believing president trump followed up with ambassador sondland to see are they going to follow through with the investigations? because he needed those investigations for his own personal political gain. >> what can you tell us about david holmes' credibility in the six hours and the republican's approach to holmes' credibility? >> and i can tell you just like people beforehand, he has served all over the world. a person of integrity. i did not judge or see any reason to question his truthfulness and again the fact that he showed up, says a lot about who he is compared to so many people that have chosen to defy us. and i don't expect there to be any issues with his integrity or ability. >> the opening statement has many things that there striking. but it's very clear that david holmes is saying he didn't see himself as a witness in these proceedings until he heard republicans complaining repeatedly about hearsay. and he realized that what he has to say is not hearsay. he was a witness physically present listening to the words exactly as they were spoken. was there any complaining about hearsay in the deposition today? >> i did not hear them say anything about that, lawrence. however, the best evidence remains the president's own words that the president put out. that's an admission by the president. the next best evidence is from people like ambassador sondland who told ambassador taylor the president is telling him everything is on the line, not just the white house visit but the security assistance. and of course as ambassador taylor described, you have a new witness in david holmes who heard the president talking incessantly about the investigations with the bidens. and finally we use hearsay all the time. if we're talking about hearsay to find out and take actions. by the way a terrorist named osama bin laden was captured and brought to justice in pakistan based on hearsay evidence. so hearsay evidence can be quite effective. >> and david holmes, in his opening statement, full of praise for ambassador yovanovitch. what was your understanding of of the effect of the public hearing this morning? >> the american lawrence o'donnell. good evening, lawrence. >> good evening, rachel. and i was listening to every word of what you found in that portion of the anonymous book, which is what, two weeks away from being published, approximately? >> yeah. >> and does it give you any setting for these meetings? i mean we don't know in these discussions whether this is a budget discussion or whether it's a homeland security discussion. is that the way it reads that you can't quite fix that? >> well, it reads like somebody who's in direct contact with the president or somebody who was otherwise able to assert confidently that they can directly quote the president and describe not only his actions and his words but his demeanor. and what's described here is security stuff in part and the president's odd fixation on visual memes and visual cues even when he can't absorb anything with a comma in it. basically anything that has more than one concept in it delivered to him in prose at more than one time. >> in many other white houses there'd be ways of narrowing down the possibilities of who was likely to hear conversations like that. the trouble is this was the -- it certainly was for a long time maybe still is, the open door oval office where we have these reports of donald trump just waving all sorts of people in. there really isn't a gatekeeper. apparently john kelly tried to be a gate chemoer to keep people out, but you couldn't really do that. so there's a kind of atmosphere in there where it's very hard i think for people in that white house to keep track of who might be in the room at any given time. >> yes, and that's actually part of what anonymous writes about is that the president would fix his mind on something, often something he got from television, decide he was going to do it and then randomly the next white house aide who he came across would be the person who was in charge of receiving that briefing from the president and potentially acting on it or conveying a message to the white house press spokesperson that this should now be convey today the public as the new idea of the american government and the new action that the president was ordering being taken, that it was somewhat random, that it was whoever he lit upon near him would then be roped into whatever the crazy idea was. but it also very much tells you it could be complicated to figure out who the person was who was at all of these meetings who witnessed all of these things. and the process of elimination may not apply here if literal randos walking by are drafted into these conversation. >> this book comes into after bob woodward has taken us into similar scenes in his inside the trump white house book. how does this read compared to those? what is the difference when you're holding an account that is written by someone who is part of the team in that room? >> this -- i mean, clearly one of the things that is somewhat unique about this is that it's written from the perspective of a senior administration official and somebody who did not come into it disinclined towards president trump's agenda. so it's written from the point of view of somebody who isn't -- isn't there to be critical and isn't there to observe. it's from the point of view of somebody who's there to try to make government. so when i think you've had other authors characterize the feelings of their sources, even multiple sources in terms of how people around trump reacted to him or felt about his behavior, in this case you get in it in the first person, you also are privy to conversations according to anonymous that this author had with people in a similar role. other people in senior administration jobs who were pro-trump nevertheless driven to actual panic in terms of trying to stop him from doing what he wanted to do. so you're closer to the -- i guess i would say you're closer to the source, right, because this is the source wrying in his or her own terms. but it's not inconsistent with the portraits that we've had through, you know, daily newspaper reporting on the behavior of the president and from those books that you described. it is all of a piece. and there is news in this book which has started to be reported elsewhere. other people have started to see passages of the book. but the stuff i was able to read tonight i think gives you particularly a window into the upset of people otherwise inclined to support this president who were horrified by and full of regret for their own decision to be there. >> i think, rachel, for me the shocking part of tonight about hearing you read is not that i felt like i was learning something new about donald trump. the other accounts had all this kind of stuff in it. but it is yet another moment where you kind of sit there and you think about all of the people around donald trump who are going along with this including -- including the author of this piece. now, this author takes us into the interior dialogue of how difficult that is and maybe i should have resigned at charlottesville, maybe i should have done this. but is that -- is that a look inside hundreds of minds of republicans in the house of representatives and in the senate? or have they just stopped thinking about this? have they just gone along with this long enough that they are just now robotically going along with all of donald trump's stuff? >> it's a very good insight and a very good question. i mean, i think if we think the best of our fellow americans who have gone into public service and we imagine the best possible intensions for those whose hearts and minds we don't know ourselves, the best case scenario you can think in some of the worst moments like, you know, after charlottesville when he's praising the neo-nazi side and all of these things is that people maybe did think that they were the adult in the room and that by them being in that job things were going to be better because they were not that bad a person and so not quitting and not speaking out in order to hold their place in the administration or in republican politics was somehow going to benefit the country. clearly this anonymous author was in that position when this person wrote the op-ed last year, saying literally the adults are in the room. we want to reassure you, america, don't worry we're trying to thwart the worst stuff he wants to do. that is not the tone of this book. the tone of this book is people trying to thwart his will the administration is not enough. a, the best ones are gone aur already. and this is warning about danger to the country and the fact having some self-proclaimed adults in the room isn't enough. so if that is the best case scenario of how some people of conscience have been there supporting or sticking up for this president, this is an argument against that. >> a warning is the most kind of understated title that book could possibly have. thank you, rachel. >>> after the democrats' big win in kentucky this week, charlie cook willgyne us tonight with more good news for the democrats about swing states, the swing states of michigan, minnesota, pennsylvania and taking a look where donald trump is now sinking in the polls in those states and why he's sinking. and it is about the issues. it is about tariffs. it's about the issues that democrats are bringing to the campaign. there is surprisely stroingly s support in those states for progressive pra progressive policies like the green new deal. charlie cook will bring us all of that at the end of this hour. first, nbc news has confirmed that the house intelligence kmilty h committee has subpoenaed white house of chief of staff mick mulvaney tomorrow morning at 9:00 a.m. that deposition had been scheduled but the delivery of the subpoena tonight is a new development. we will have more on that in a moment. >>> donald trump wanted to hear the words "biden" and "clinton" from the president of ukraine. we know that now. he wanted to hear those words in a public announcement by president zelensky that ukraine was investigating biden and clinton. that is the under oath testimony of george kent that we will be hearing in public next week in the first televised hearings of the impeachment inquiry. the transcript of george kent's closed door deposition was released today. also today, the impeachment inquiry conducted its first closed door deposition of a member of the vice president's staff. jennifer williams is an visor to mike pence on europe and russia. none of her testimony has yet been released. george kent is the deputy assistant secretary of state for european and eurasian affairs. ukraine is in his jurisdiction, which gave george kent a close up view of what he said under oath was rudy giuliani's campaign of lies about ukraine -- a campaign that rudy giuliani says he conducted entirely on behalf of the president of the united states. george kent is one of the witnesses along with the acting ambassador to ukraine william taylor, whose testimony forced gordon sondland to change his under oath testimony to try to avoid perjury charges. gordon sondland, donald trump's completely inexperienced and incompetent ambassador to the european union added a 4-page supplement to the transcript of his deposition saying he now agrees with ambassador william taylor's testimony and george kent's testimony after reports of their testimony had helped him refresh his memory. george kent testified under oath that gordon sondland told him that donald trump, quote, wanted nothing less than president zelensky to go to a microphone and say investigations, biden and clinton. those were the magic words. those were the words donald trump had to hear before he would hand over military aid to ukraine. investigations, biden and clinton. ukraine's survival depended on those three words -- investigations, biden and clinton. president zelensky even though he was knew at his job realized how wrong it would be for him to say those words. president zelensky's staff made it very clear to george kent that they understood how wrong it would be for president zelensky to be forced to say those words and how wrong it would be for president zelensky to be forced to investigate american political rivals of the president of the united states. george kent was warned by ukrainian officials rudy giuliani was working in the shadows to try to control ukrainian policy. quote, and i said throw mud at whom? and he said a lot of people. i asked him whom and he said towards masha, towards you, towards others. question, masha is marie yovanovitch? cent -- former ambassador yovanovitch, yes. george kent provided hours of details about rudy giuliani's activities which george kent referred to repeatedly under oath, as quote, a continuation of his campaign of lies. rudy giuliani can sue george kent for those words, can sue him for defamation, for calling rudy giuliani a liar, conducting a campaign of lies. giuliani could see if and only if george kent is not telling the truth and the full truth about rudy giuliani. but rudy giuliani will not sue george kent. george kent's description of rudy giuliani's campaign of lies now lives in the congressional record forever. but rudy giuliani could find himself in a courtroom because of his campaign of lies. rudy giuliani is now the subject of a criminal investigation of his activities which has already resulted in the indictment of two associates of rudy giuliani. mr. giuliani spent the last few weeks searching desperately for a criminal defense lawyer to represent him and being repeatedly rejected by a number of high powered attorneys before finally landing on robert costello who served as an intern for rudy giuliani when rudy giuliani was the head of the u.s. attorneys office in new york, the same office that is currently investigating him. and of course the life lesson is always be nice to the interns. you never know when you're going to need them. leading off our discussion tonight is democratic eric swalwell of california. he attended george kent's deposition, and he attended jennifer williams' deposition today. congressman swalwell, thank you very much for joining us. really appreciate it. >> lawrence, as a former congressional intern, that advice is absolutely right. >> i knew that was coming. i knew that was coming. good word for the interns. jennifer williams testifying today, what can you tell us about her willingness to testify and what resistance was put up or not in getting her to testify. >> well, i'll address what rachel read earlier and you alluded to in the opening, the concerns expressed by anonymous. anonymous talks a lot about the adults in the room, and i would suggest the adults in the room respond to lawful subpoenas, and today jennifer williams was one of the adults in the room. she showed up, and that in and of itself is helpful. and every time a witness has shown up, we've learned new information to fill in the time line and understand who was a part of the defense dollars for dirt scheme, and who was doing honest foreign policy work on behalf of the united states. and so we filled that in. we're ready to move into these open hearings next week. and, you know, m

tonight, because at the end of this hour, i am going to be in superfan mode because we are going to be joined by this year's co-winner of the nobel prize in economics whose work is already in the center of the democratic presidential campaign, even if many of the candidates don't realize that. the nobel prize in economics was not established until 1969, and when i became an economics major in college in the 1970s, professors in the economics department at my college won the nobel prize three years in a row, and they were the biggest stars in the world to me. and they still are. and tonight you will meet the second woman in history to win the nobel prize in economics, and she will tell you what you need to know about the most important issues in the presidential campaign that you discuss every day already and that the candidates discuss every day. and you will be surprised which billionaire agrees with her, at least on some of her research. that is at the end of this hour and you don't want to miss that. >>> but we begin tonight, of course, with impeachment. the ukranians knew. the ukranians knew that donald trump was withholding military aid authorized by congress. and the ukrainians knew long before the first public report in "politico" in late august that that aid was being withheld. that was the single most important point in the transcript released today of laura cooper's deposition testimony to the impeachment investigation of donald j. trump. because that destroys the republican defense that donald trump couldn't possibly have committed extortion if ukraine did not know that donald trump was withholding the aid to ukraine. that is one of the republican talking points that they're planning to use in the public hearings, talking points that were obtained by "axios." we'll have more on that later. that particular defense is now gone because ukraine knew. laura katherine cooper is the deputy assistant secretary of defense to ukraine. military aid to ukraine was the most urgent issue to her, not the defense department. she knew the president was withholding military aid and began asking questions about it well before "politico" first reported it in late august. according to what she had been told by kurt volker, the trump special envoy to ukraine, and the acting ambassador to ukraine, william taylor. quote, i knew from my kurt volker conversation and also from sort of the alarm bells that were coming from ambassador taylor and his team that there were ukranians who knew about this. on july 26th, laura cooper found out that both military and humanitarian aid were being withheld from ukraine, and at her level, all of the governing professionals like herself were worried that it was illegal. quote, immediately deputies began to raise concerns about how this could be done in a legal fashion, cooper said. the comments in the room at the deputy's level reflected a sense that there was not an understanding of how this could legally play out. laura cooper testified that ukraine had met all of the requirements for u.s. aid before president trump put a hold on that aid in addition to her worries about the legality of the hold, laura cooper was worried about what it meant for ukraine's very survival. quote, if they are seen as weak and if they are seen as lacking the backing of the united states for their armed forces, it makes it much more difficult for them to negotiate a peace on terms that are good for ukraine. mick mulvaney was drawn deeper into the trump appeasement of russia in another deposition transcript released today of the testimony of katherine kroft, a special adviser to ukraine. she was advised that a piece of a hold was placed on ukraine. katherine kroft was told in a special budget by mick mulvaney was put on hold to ukraine because mick mulvaney expressed concerns that, quote, russia would react negatively. that is exactly why those missiles were authorized to be transferred to ukraine, so that the missiles would have a negative impact on russia's policy in the region. catherine croft testified that the office of the budget was to transfer aid to ukraine and that all the departments, including the security council, supported the transfer. mick mulvaney surrendered to all that pressure and ukraine finally received the missiles. christopher anderson's deposition was released today. christopher anderson, a service officer who had been involved in ukraine, said john bolton made a joke about every time ukraine is mentioned, giuliani pops up and that the president is listening to giuliani about ukraine. turns out that wasn't a joke. william taylor, quote, repeatedly expressed his concern that giuliani would make his job difficult. christopher anderson testified that he agreed, quote, that if giuliani's narrative took hold that the ukranian government was an enemy of the president, then it would be very hard to have high-level engagement, it would be harder for us to pressure russia to come back to the negotiating table in that case. as usual, the democrats issued highlights today of the hundreds of pages of transcripts that they released. those highlights identified by the democrats are all harmful to president trump. the republicans did not release a single page of highlights in any of today's depositions or any of the previous depositions because there are no highlights in these depositions that are helpful to donald trump's defense. republicans were in every one of these depositions. republicans in jordan were in each of the depositions he released today and he did not make one helpful point for donald trump in these depositions. there is no evidence in these depositions of why republicans decided to remove one of their members from the intelligence committee so they could give that seat to jim jordan so he would be the star inkwquisitor r the republicans this week. jim jordan was able to be in the depositions because those depositions allowed three committees to be present, including the oversight and reform committee, and jim jordan is already a member of that committee. but the public hearings will be for the house intelligence committee only and the republicans' big move, their big move for the defense of the president in the public hearings, was to bring in jim jordan on the same week that jim jordan was once again credibly accused of being aware of a team doctor sexually assaulting members of the ohio state wrestling team when jim jordan was a coach on that team. nbc reported last week that ia lawsuit filed on thursday said jim jordan saw the coach masturbate in front of him at a wrestling match, he reported that to jim jordan, who was the wrestling coach. yeah, that's strauss, jordan and th then-head coach russ hellickson replied, according to the affidavit. leading off our discussion tonight, john sarbanes of maryland who has attended many of these impeachment depositions. and ellen farkas, a former staff member of the foreign affairs committee. she is an nbc national security analyst. john sarbanes, i wanted to get your reaction to the depositions today, especially to the point that the ukranians knew this aid was being withheld and they knew it long before it became public. >> well, lawrence, thanks for having me on today. i think we were pretty confident just based on the overall testimony that was coming forward over the last few weeks that it would become clear that the ukranians were aware of this hold having been placed. now you have a direct corroborating testimony to that, and it puts a lie to the republican defense that somehow the quid pro quo wasn't there because there wasn't ukranian knowledge that there was a quid pro quo. they knew exactly what was being done to them. it was a breathtaking abuse of power on the part of the administration to tie this security assistance to a promise that they would investigate, the ukranians would investigate a political rival of the president. that's all becoming clear. it will be much more clear this week, i think, to the broad public when we get the testimony from these three diplomats. these are very professional people. the testimony they delivered in closed session was very compelling, and i think you'll see that will ha

lawrence o'donnell. good evening, lawrence. >> good evening, rachel. and i was listening to every word of what you found in that portion of the anonymous book, which is, what, two weeks away from being published, approximately? something like that. >> yeah. >> and does it give you any setting for these meetings? i mean we don't know in these discussions whether this is a budget discussion or whether it's a homeland security discussion. is that the way it reads that you can't quite fix that? >> well, it reads like somebody who's in direct contact with the president or somebody who was otherwise able to assert confidently that they can directly quote the president and describe not only his actions and his words but his demeanor. and what's described here is security stuff in part and the president's odd fixation on visual memes and visual cues even when he can't absorb anything with a comma in it. basically anything that has more than one concept in it that's delivered to him in prose at more than one time. >> in many other white houses there'd be ways of narrowing down the possibilities of who was likely to hear conversations like that. the trouble is this was the -- it certainly was for a long time maybe still is, the open door oval office where we have these reports of donald trump just waving all sorts of people in. there really isn't a gatekeeper. apparently john kelly tried to be a gatekeeper to keep people out, but you couldn't really do that. so there's a kind of atmosphere in there where it's very hard i think for people in that white house to keep track of who might be in the room at any given time. >> yes, and that's actually part of what anonymous writes about is that the president would fix his mind on something, often something he got from television, decide he was going to do it and then randomly the next white house aide who he came across would be the person who was in charge of receiving that briefing from the president and potentially acting on it or conveying a message to the white house press spokesperson that this should now be conveyed today the public as the new idea of the american government and the new action that the president was ordering being taken, that it was somewhat random, that it was whoever he lit upon who was near him would then be roped into whatever the crazy idea was. and that is interesting in terms of his behavior and the process in this white house. but it also very much tells you it could be complicated to figure out who the person was who was at all of these meetings who witnessed all of these things. and the process of elimination may not apply here if literal randos walking by are drafted into these conversation. >> this book comes into after michael wolff has taken us through similar scenes in the white house. bob woodward has taken us into similar scenes in his inside the trump white house book. how does this read compared to those? what is the difference when you're holding an account that is written by someone who is part of the team in that room? >> this -- i mean, clearly one of the things that is somewhat unique about this is that it's written from the perspective of a senior administration official and somebody who did not come into it disinclined towards president trump's agenda. so it's written from the point of view of somebody who isn't -- isn't there to be critical and isn't there to observe. it's from the point of view of somebody who's there to try to make government. so when i think you've had other authors characterize the feelings of their sources, even multiple sources in terms of how people around trump reacted to him or felt about his behavior, in this case you get in it in the first person, you also are privy to conversations according to anonymous that this author had with people in a similar role. other people in senior administration jobs who were pro-trump who were nevertheless driven to actual panic in terms of trying to stop him from doing what he wanted to do. so you're closer to the -- i mean, i guess i would say you're closes to the source, right, because this is the source writing in his or her own terms. but it's not inconsistent with the portraits that we've had through, you know, daily newspaper reporting on the behavior of the president and from those books that you described. it is all of a piece. and there is news in this book which has started to be reported elsewhere. other people have started to see passages of the book. but the stuff that i was able to read tonight i think gives you particularly a window into the upset among people otherwise inclined to support this president who were horrified by and full of regret for their own decision to be there. >> i think, rachel, for me the shocking part of tonight about hearing you read it is not that i felt like i was learning something new about donald trump. the other accounts had all this kind of stuff in it. but it is yet another moment where you kind of sit there and you think about all of the people around donald trump who are going along with this including -- including the author of this piece. now, this author takes us into the interior dialogue of how difficult that is and maybe i should have resigned at charlottesville, maybe i should have done this. but is that -- is that a look inside hundreds of minds of republicans in the house of representatives and in the senate? or have they just stopped thinking about this? have they just gone along with this long enough that they are just now robotically going along with all of donald trump's stuff? >> it's a very good insight and a very good question. i mean, i think that if we think the best of our fellow americans who have gone into public service and we imagine the best possible intensions for those whose hearts and minds we don't know ourselves, the best case scenario you can think in some of the worst moments like, you know, after charlottesville when he's praising the neo-nazi side and all of these things is that people maybe did think that they were the adult in the room and that by them being in that job things were going to be better because they were not that bad a person and they would stop things from going as bad as they could. and so not quitting and not speaking out in order to hold their place in the administration or in republican politics was somehow going to benefit the country. clearly this anonymous author was in that position when this person wrote the op-ed last year, saying literally the adults are in the room. we want to reassure you, america, don't worry we're trying to thwart the worst stuff he wants to do. that is not the tone of this book. the tone of this book is people trying to thwart his will the administration is not enough. a, the best ones are gone already. and, c, even the ones who are still there are not able to do enough to protect the country. and this is warning about danger to the country and the fact having some self-proclaimed adults in the room isn't enough. so if that is the best case scenario of how some people of conscience have been there supporting or sticking up for this president, this is an argument against that. >> it really -- a warning is the -- is the most kind of understated title that book could possibly have. thank you very much, rachel. really appreciate it. thank you. >> thanks a lot, lawrence. >>> after the democrats' big win in kentucky this week, charlie cook will join us tonight with more good news for the democrats about swing states, the swing states of michigan, minnesota, pennsylvania and wisconsin. those four states, charlie cook is taking a look at where donald trump is now sinking in the polls in those states and why he's sinking. and it is about the issues. it is about tariffs. it's about the issues that democrats are bringing to the campaign. there is surprisingly strong support in those states for progressive policies like the green new deal in charlie cook's new research. charlie cook will bring us all of that at the end of this hour. >>> but first, we have some breaking news, as rachel just mentioned. nbc news has confirmed that the house intelligence committee has subpoenaed white house of chief of staff mick mulvaney tomorrow morning at 9:00 a.m. that deposition had been scheduled but the delivery of the subpoena tonight is a new development. we will have

lawrence o'donnell. good evening lawrence. >> i think you should quiz all the candidates about transcript i think you should quiz all the candidates about transcript entries in the hearings of the depositions. so here you are, you're in atlanta, you're memorizing everything every democratic candidate has said about every thing and every issue, right, for wednesday night. >> uh-huh. >> and you get hit a little around 8:00 with 403 pages of deposition transcript. i don't -- easy week, right, rachel? nice easy week. >> and the paul erickson plea stuff all came in today, and there's still kind of the roger stone stuff to digest, and there's the stuff that came in over the weekend, right? we got the williams and morrison stuff over the weekend, plus we got new public witnesses. this is drink from a fire hose time in american news, and it's our jobs to do it, and it's fine. >> and we have cardiologists on tv wondering why we haven't seen the president since saturday afternoon. but this is where we are. rachel, go back to your homework, get some rest. we're going to be watching wednesday night, and of course we'll be watching you tomorrow night, too. >> thanks, dear. >> thank you, rachel. >>> i remember it vividly. i've never seen anything like this. that's what david holmes said under oath on page 54 of his deposition transcript released tonight as the breaking news story of the night. it's about the incident that made david holmes an important witness in the impeachment investigation of donald trump. david holmes is an important witness who we did not even know existed at this time last week. the first public reference made to david holmes was in wednesday's hearing when ambassador william taylor shocked the hearing room and millions of viewers when he described a phone call from a restaurant in ukraine to president trump that david holmes had overheard. but ambassador taylor did not reveal then david holmes' name. he simply said it was a member of his staff who overheard the call. two days after ambassador taylor's testimony, david holmes was describing that phone call under oath in a closed-door deposition on friday. and on friday night, that became our breaking news, because we were able to report david holmes' version of the phone call from his written opening statement, which nbc news had obtained on friday. and now tonight we have the full transcript. the now famous phone call was made on a cell phone at a restaurant in kyiv by the trump ambassador to the european union, gordon sondland, after ambassador sondland met with ukraine's president zelensky. chairman adam schiff took david holmes through that phone call step by step. the chairman. now, you said the president's voice was loud and recognizable, and ambassador sondland held the phone away from his head, is that right? mr. holmes, yes, sir. he was sort of waiting for him to come on, and when he came on, he sort of winced and went like that a couple of times -- the first couple of exchanges he sort of winced. the chairman: and you heard him on the phone? greet the president and say he was calling from kyiv and then you could hear president trump wanting to clarify that ambassador sondland was, in fact, in ukraine? yeah. yes, you mean ukraine? yes. ukraine. the chairman: and then you said president zelensky on ambassador sondland went on to say that president zelensky loves your ass, meaning that he loves the president? mr. holmes, yes, sir. the chairman, and then you could hear president trump say, so he's going to do the investigation? mr. holmes, yes, sir. the chairman, and sondland replied, he's going to do it? mr. holmes, yes. he said, oh, yeah, he's going to do it. the chairman, and then he went on to say president zelensky will do anything you ask him to? mr. holmes, yes. the chairman, and dhoez are tth words you heard to the best of your recollection. >> yes, sir. >> it left an inprevention mpre, did it? mr. holmes, this was an extremely distinctive experience in my foreign service career. i've never seen anything like this, someone calling the president from a mobile phone at a restaurant and then having a conversation of this level of candor, colorful language. there is just so much about the call that was so remarkable that i remember it vividly. david holmes will testify to all of this in public on thursday morning in a week in which the house intelligence committee will hear from nine witnesses in morning and afternoon hearings. gordon sondland will testify the day before david holmes on wednesday morning. >>> leading off our discussion tonight is democratic congressman denny heck of washington. he is a member of the house intelligence committee. he attended david holmes' under oath deposition. also joining us, jonathan alter, columnist for "the daily beast" and msnbc political analyst covering his second impeachment. he was a younger man for that first one. >> that is correct. >> and norm ornstein, congressional historian at the american enterprise inter-stuut. and norm has watched all three of these impeachments that we've had from nixon forward. congressman heck, let me ask you about this deposition we're getting. it was dramatic enough on friday night when we read the opening statement in which he describes this phone call so clearly, but seeing the testimony that chairman schiff took him through and hearing his explanation of why he remembers it so vividly is all -- all the more powerful, and i couldn't find in the transcript, and correct me if i'm wrong, i could not find any republican members in any way shaking david holmes on anything about that phone call. >> not for one nanosecond, lawrence. >> what do you make of david holmes' general credibility about the range of his testimony? >> i thought he was an excellent witness. frankly, his revelation was jaw-dropping, namely that the president said words to the effect, so there is going to be an investigation. but there were a couple other things there that were pretty stunning, too, as we've talked about some, the fact we were having a conversation between ambassador sondland and president trump on the terrace of a restaurant out in the open in kyiv, ukraine with no doubt russian agents everywhere. but what i think was as offensive as anything was the callous disregard in which mr. holmes represented president trump's regard for ukraine. he said he didn't give an expletive, deleted, about it, that he cared about the big stuff. and mr. holmes said, there is big stuff going on in ukraine, like a war with russia. and ambassador sondland said, no, big stuff like getting his investigations in effect. he didn't care, he doesn't ca
